We have just received some unexpected news of David's employment transfer to the west coast of Florida effective immediately upon the sale of our home here in Boynton Beach. We regret having to move from Boynton Beach because we love the city and all of the exciting developments going on around us in the city! We have thoroughly enjoyed the two and a half years that we have lived here and are proud of this city and it's leaders. Mr. Rosenstock inquired about vermin around the building. Mr. Carlson said that any board member would be welcome to visit the facility at any time. The U.S.D.A. inspector is there daily and performs random checks. If the inspector sees a problem on site, the operation is shut down. The facility is sanitized before each operation everyday and at the end of the operation everyday. Also, there are vermin traps outside the building approximately every 20 feet. Mr. Friedland noted that when Mr. Rumpf reported on the application at the last meeting, he commented on the cleanliness of the operation. Motion Vice Chair Dube moved to approve the request to amend the M-1 zoning district regulations, Sections 8.A.3 a (5) and 8.AA.e to allow as a conditional use the cutting of sub-primal portions of meat and pre-cut poultry into serving portions, including packing and shipping where pre-cut portions will not exceed 10 pounds in weight and waste generated will not exceed 1 % and to clarify the list of prohibited uses, subject to the changes and recommendations made at this meeting. ,. Mr. Ensler asked if the cleanliness standard was key to the approval, would it be pOSSible to add some kind of cleanliness standard which would be required for any future operations? It was noted that this would come under the Board of Health and is not in the control of this Board. Motion seconded by Mr. Friedland. Motion carried 7-0. 7. New Business C. Variance Request: Request relief from the City of Boynton Beach Land Development Regulations, Chapter 2, Zoning, Section 5.C.2.a, to allow a 9 % foot reduction from the twenty- five (25) foot rear yard setback required within the R-1-AA single family zoning district to allow a 15 % foot setback. BACKGROUND The subject property and nearby neighborhood is currently zoned R-1-AA, single family residential. The lot is currently developed and conforming with the R-1-AA zoning district requirements. Currently, the subject neighborhood is mostly developed (see Exhibit "A" - Location Map). ANAL YSIS The code states that the zoning code variance can not be approved unless the board finds the following: a. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district. b. That the special conditions and circumstances do not result from the actions of the applicant. c. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would work unnecessary and undue hardship on the applicant. e. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure. f. That the grant of the variance will be in harmony with the general intent and purpose of this chapter [ordinance} and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. (Exhibit "B" contains the applicant's response to the above criteria.) Staff has conducted this analysis focusing on items "a", "b" and c" above, which require that the request is initiated by special conditions and circumstances that are peculiar to the subject land, structure, or building, which are not a result of the actions of the applicant, and that granting of the variance would not confer on the applicant any special privilege that is denied by the regulations to other properties within the same zoning district. According to the applicant's response to the above-criteria, the applicant feels that other property owners in the neighborhood have been allowed the privilege of reduced rear setbacks. The applicant therefore feels that he is also entitled to the same privilege, and accordingly, he has provided a proposed floor plan depicting the proposed addition (see Exhibit "C" - proposed floor plan). Staff researched City records and was unable to verify that any similar variances for setback reductions have been granted within close proximity to the subject property. Furthermore, the subject request has been initiated for the sole expansion of a home that is situated on a standard lot within this neighborhood. Therefore, the circumstances are generated by the applicant, solely for individual benefit. There exists approximately 25 feet between the rear of the existing single family home and the rear setback line. Therefore, it appears that sufficient space exists to design and construct either an attached or detached improvement to this home without the necessity for a variance. CONCLUSIONS/RECOMMENDA TION Staff recognizes that the applicant is in need of extra living and personal office space within the subject home; however, staff feels that the desires of the property owner are attainable within the current buildable envelope as defined by the R-1-AA zoning district regulations. Staff therefore recommends that the request for a 9 % foot rear yard setback reduction be denied. No conditions of approval are recommended; however, any conditions of approval recommended by the Planning and Development Board or City Commission will be placed in Exhibit "0". BACKGROUND The subject property and nearby neighborhood is currently zoned R-1-M, single family residential. The lot is currently developed and conforming with the R-1-M zoning district requirements. Currently, the subject neighborhood is mostly developed (see Exhibit "A" - Location Map). ANAL YSIS The code states that the zoning code variance can not be approved unless the board finds the following: a. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district. b. That the special conditions and circumstances do not result from the actions of the applicant. c. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would work unnecessary and undue hardship on the applicant. e. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure. f. That the grant of the variance will be in harmony with the general intent and purpose of this chapter [ordinance] and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. (Exhibit liB" contains the applicant's response to the above criteria.) Staff has conducted this analysis focusing on items II a" , lib" and c" above, which require that the request is initiated by special conditions and circumstances that are peculiar to the subject land, structure, or building, which are not a result of the actions of the applicant, and that granting of the variance would not confer on the applicant any special privilege that is denied by the regulations to other properties within the same zoning district. According to the applicant's response to the above-criteria, the applicant feels that other property owners in the neighborhood have been allowed the privilege of reduced rear setbacks. The applicant therefore feels that he is also entitled to the same privilege, and accordingly, he has provided a proposed floor plan depicting the proposed addition (see Exhibit "C" - proposed floor plan). Staff researched City records and was unable to verify that any similar variances for setback reductions have been granted within close proximity to the subject property. Furthermore, the subject request has been initiated for the sole expansion of a home that is situated on a standard lot within this neighborhood. Therefore, the circumstances are generated by the applicant, solely for individual benefit. There exists approximately 25 feet between the rear of the existing single family home and the rear setback line. Therefore, it appears that sufficient space exists to design and construct either an attached or detached improvement to this home without the necessity for a variance. CONCLUSIONS/RECOMMENDA TION Staff recognizes that the applicant is in need of extra living and personal office space within the subject home; however, staff feels that the desires of the property owner are attainable within the current buildable envelope as defined by the R-1-AA zoning district regulations. Staff therefore recommends that the request for a 9 Y:z foot rear yard setback reduction be denied. No conditions of approval are recommended; however, any conditions of approval recommended by the Planning and Development Board or City Commission will be placed in Exhibit "0". We moved to Boynton Beach for several reasons but mostly for the excitement of Vision 20/20 and being a part of a beautiful historical coastal town that is getting a new updated facelift! So now that we have decided to make Boynton Beach our hometown to raise our family, we have outgrown our three bedroom home. One of our bedrooms is currently used as an office for David's employment as a sales representative for Oxford Industries Golf Apparel. We then have the master bedroom and the third bedroom is our 3 year old daughter's room. But since we are now pregnant with our second child. We have run out of space. We have also researched four bedroom homes in our area of which we definitely wish to stay and have found that they are out of our affordable price range. Therefore, we are asking for an acceptance of our application for an addition of a 24' x 14' 4" free-standing office off of our master suite. We have already secured a home equity loan and have also interviewed and selected several well-respected and licensed contractors and sub-contractors. Furthermore, I have studied architecture and plan to have this structure completely match the style of architecture to our existing home including roofline and windows. We can assure you that this addition to our home will not only increase the value by making it a four bedroom home but will be a well-thought out, well-developed and well-designed asset.
