OPINION OF TITLE
This Opinion of Title has been prepared by Jeff Tomberg, Attorney at Law, 626
S. E. 4th Street, Boynton Beach, Florida.
The effective date of the title search is: July 21, 1998, at 11 :00 p.m.. The purpose
of the search was to determine the ownership and encumbrances upon the following
described property:
Lot 7 and the South 25 feet of Lot 8; the South half of Lot 13 and all of
Lots 14,15, and 16, Block E, HATHAWAY PARK, according to the map or
plat thereof as recorded in Plat Book 13, Page 17 of the Public Records of
Palm Beach County, Florida.

That certain Mortgage and Note in the original principal sum of $90,000.00 in
favor of Darrell H. Hinson and Sue R. Hinson, his wife, dated July 28, 1997, and

That certain Mortgage and Note in the original principal sum of $40,000.00 in
favor of Elizabeth Pettinicchi, dated September 12,1997, recorded September 17,1997,

The above-described easement was dedicated by instrument executed on July 7, 1925,

Subsequent to the department's memorandum #00-173, dated August 9th, department personnel met with
the applicant in the Department of Development's Planning and Zoning Division conference room on
August 11th. At this meeting, it was agreed that the department would consult with their stormwater
consulting firm, Camp, Dresser & McKee, Inc., for an evaluation of any future needs of the East Railroad
Avenue right-of-way for stormwater drainage purposes.
The department's consulting firm responded in their letter of August 22nd that the proposed stormwater
drainage swale along the railroad in this area was not necessary. Therefore, the department is removing
its recommended disapproval of the application for right-of-way abandonment.
However, it is requested that the applicant grant a 12-foot utility easement adjacent to the railroad right-
of-way for future utility construction as may be required to connect SE 8th A venue with SE 1 Oth Avenue.
This requirement was discussed with Mr. Burl Gentry, representative to the applicant on Monday, August
28th, to which he indicated no objection.
Therefore, this department recommends approval of the application for right-of-way abandonment,
subject to the above noted proviso. If you have any questions, please contact the sender.

Dear Mr. Rumpf,
We are the property owners abutting Mr. Daly's property on the north side. Mr.
Daly has kept us informed of the progress of his application for abandonment of the
right-of-way which sits on the west side of his property. We are in favor of this
application to vacate the right-of-way and have no opposition to it.
In the near future, we will be making a similar application to vacate the
right-of-way adjacent to our property. This unmaintained 30 foot right-of-way has never
been used by the City and we want to clean it up and include it in our landscaped back
yard. We have no intentions of selling this property in the future.
