PLANNING & DEVELOPMENT BOARD MEETING
PART OF EAST RAILROAD AVENUE
LOCATED BETWEEN SE 8TH & 10TH AVENUES
Subsequent to the department's memorandum #00-173, dated August 9th, department personnel met with
the applicant in the Department of Development's Planning and Zoning Division conference room on
August 11 th. At this meeting, it was agreed that the department would consult with their stormwater
consulting firm, Camp, Dresser & McKee, Inc" for an evaluation of any future needs of the East Railroad
Avenue right-of-way for stormwater drainage purposes.
The department's consulting firm responded in their letter of August 22nd that the proposed stormwater
drainage swale along the railroad in this area was not necessary. Therefore, the department is removing
its recommended disapproval of the application for right-of-way abandonment.
However, it is requested that the applicant grant a 12-foot utility easement adjacent to the railroad right-
of-way for future utility construction as may be required to connect SE 8th Avenue with SE 1 oth Avenue.
This requirement was discussed with Mr. Burl Gentry, representative to the applicant on Monday, August
28th, to which he indicated no objection.
Therefore, this department recommends approval of the application for right-of-way abandonment,
subject to the above noted proviso. If you have any questions, please contact the sender.

The department is in receipt of the abandonment application request for the above noted location, received
on August 4,2000. The subject request is to abandon a portion of the roadway right-of-way within the
City, specifically:
That part of East Railroad Avenue lying west of and adjacent to the south half of Lot 13,
and all of Lots 14, 15 and 16, Block E, HATHAWAY PARK, according to the plat thereof
as recorded in Plat Book 13, Page 17, of the Public Records of Palm Beach County,
Florida, bounded on the north by westerly extension of the north line of the south half of
said Lot 13, and bounded on the south by the westerly extension of the south line of said
Lot 16.
It should be noted that any abandonment consideration would require a unity of title declaration to prevent
the above noted lots from being landlocked.
The City, through the Utilities Department has been studying all key areas of the City for stormwater
improvements since 1992. A recent Final Letter Report to the Stormwater Master Plan Update Swale
Areas, dated September, 1999, as prepared by the consulting firm of Camp, Dresser & McKee, Inc.,
reflects that East Railroad Avenue in Section 28, Township 45 South, Range 43 East, will be required for
stormwater piping and swale activity for improvements in this section ofthe City.
Therefore, this department recommends disapproval of the application for right-of-way abandonment.

of the CITY OF BOYNTON BEACH, FLORIDA, will conduct PUBLIC HEARINGS at CITY

on Tuesday, May 11, 1999 and on Tuesday, May 18, 1999, respectively, at 7:00 p.m. to
consider a street abandonment, submitted by Mark Daly, located on East Railroad Avenue
between S.E. 10th Avenue and S,E. 8th Avenue. Said property is more particularly described as
follows:
That part of East Railroad Avenue lying west of and adjacent to the south half of

designated Community Redevelopment Area. The CRA was directed to
prepare a Community Redevelopment Plan in order to increase the
economic viablity of entire area. This plan, which adopted in
1984, recommended that a Central Business District (CBO) be
established in the core of the Redevelopment Area. The CBO lies
between the Florida East Coast Railway and the Intracoastal
Waterway, and is bounded on the north by N.E. 7th Avenue and on
the south by S.E. 2nd Avenue.
Major goals for the CBO include enhancement of its attractiveness
by requiring streetscape improvements, architectural continuity,
and coordinated signage; using a waterfront orientation to create
a unique retail/entertainment environment; providing
pedestrian-scaled amenities; providing for perpetual public use
of a newly created waterfront; and protection from the negative
impacts created by the railroad. The CBO Plan encourages
.mixed-use development, including office, retail, service,
financial, restaurant, entertainment, lodging, residential uses,
and a civic center. A detailed description of the current status
of projects in the CBO is provided in section VI.
I~ order to promote residential development in the CBD district, I
resi~ential densities up to ~O dw71lings ~e~ acre should be ~ pvrr<
perm1tted. Furthermore, res1dent1al dens1t1es should be . ~c<~
permitted to be applied to parcels, in addition to the commercial
intensity permitted by the City's development regulations.
Two additions should be made to the CBO zoning district: First,
the row of C-3 zoned lots fronting on u.s. 1, to the south of
S.E. .2nd Avenue should be added to the CBO; second, the C-4 zoned
lots lying along the east side of the FEC tracks between Boynton
Beach Boulevard and N.E. 5th Street should be added to the CBO
zoning district, if redeveloped for uses that are allowed in the
CBO district. The Future Land Use Plan for these lots should be
construed to be changed to Mixed Use, if redevelopment for CBO
uses occurs.
The entire CBO District should be shown on the Future Land Use
Map as Mixed Use. All future development within The CBO district
should be generally consistent with the adopted Community
Redevelopment Plan, the CBO design guidelines, and the
development regulations which were adopted pursuant to the
Redevelopment Plan.
1.m. S.E. 3rd street and Vicinity
The residential-zoned portion of this area should be protected
from encroachment by commercial uses by maintaining the eXisting
R-2 zoning. In addition, special attention should be given to
site planning, use limitations, buffers, and setback requirements
on the commercially-zoned parcels which surround this residential
area. In particular, bUildings on the C-3 zoned lots which abut
the FEC tracks between S.E. 6th Avenue and S.E. 12th Avenue .

should be limited to 2 stories (25 feet), in order to ensure
compatibility with the residences which lie to the east. In
order to minimize industrial and commercial traffic on S.E. 12th
~
Avenue, access to Gulfstream Lumber, should be prohibited on S.E.
12th Avenue and other local streets in the vicinity, if this use
is expanded.
1.n. Undeveloped Parcel Adiacent to Intracoastal Waterway. at
S.E. 23rd Avenue and u.s. Hiahway 1
This parcel is shown on the Future Land Use Plan as Special High
Density Residential; however, the Conservation and Coastal
Management Elements recommend that the portion of this parcel
which is vegetated by mangroves be preserved as such. In
recognition of the need to preserve these mangroves, this site
has been placed in the Conservation Overlay category on the
Future Land Use Map.
1.0. Neiqhborhood in Vicinity of S.E. 20th Avenue and S.E. 3rd
street
Tnis is a small neighborhood, which is largely surrounded by
commercial uses, and which is showing some signs of
deterioration. The existing zoning allows for multiple-family,
duplex, and single-family housing, and as a result, a mixture of
housing types has been established. Several actions should be
taken in order to upgrade this neighborhood and prevent further
decline: First, the City should consider acquisition of property
along the FEe tracks for a mini-park, which should be construed
to be in the Recreational land use category, if acquired for such
use; second, the City should pay particular attention to
minimizing conflicts between surrounding commercial uses and the
residential uses that are located in this neighborhood; third,
the city should provide concentrated code enforcement, in order
to help improve the condition of buildings, yards, and swales;
finally, buildings should not be permitted to exceed 2 stories
(25 feet), in order to minimize encroachment on the low-rise
residences in this neighborhood.
1.p. Parcels at Northwest Corner of U.s. 1 and Old Dixie Hiqhway
Due to the limited demand for commercial floorspace along this
segment of u.s. 1, the Coastal Management Element originally
recommended that these parcels be taken out of the Local Retail
Comrner~ial land use category, and placed in the special High
Density Residential category. However, because a site plan and
construction drawings for a shopping center on this site have
been approved by the City, the city Commission decided to keep
these parcels in the Local Retail Commercial land use category.
