The Dec~aration of Protective Covenants for Woolbright place make reference to a pictorial drawing titled "Exhibit liB". The text identifies the property as four (4) parcels, however, Exhibit "B" depicts the following parcels: 1, 2, 3a, 3b, 4, and C.A.. Modify Exhibit "B" to show, with titles, four parcels or modify both the text and exhibit to show, with ti tIe, 'the seven parcels shown on the exhibit. Note the exhibit and text shall coincide. 2. The association documents refer to single-family units, however, there is no approval for single-family units in the PUD. Modify the documents accordingly. The following uses have been approved for this project; multi-family apartments, duplex units and a Church parcel. The remaining property is conunon ground; i.e. preserve area and a drainage tract. 3. The last surveyor's note shall be modified to read: "The building setbacks shall be consistent with the building setbacks established on the approved master plan for the project". 4. Provide language on the plat dedication that covers the buffer areas delineated on the plat. Identify the buffer as a "buffer easement". 5. The private recreation facilities shall be bonded with approval of the plat and completed wi thin 21 months of approval of the plat. Submit a cost estimate to be reviewed by City staff, for the five (5) required recreation amenities. A bond adjustment shall be made, within 30 days of the City's approval of the estimate, by phases, based on the value of these improvements. Pursuant to condition 5D, page 6 of 7 of the October 17, 1990 agreement between Tradewinds and the City. 6. All plats for planned unit development shall contain the text "PUD" in the title. [Appendix C, Article VIII, Section 6.E] 7. A rectified master plan shall have the unconditional sign- off by all Technical Review Committee (TRC) staff prior to plat approval. HISTORY The Planning and Development Board has previously reviewed and approved both master plans and site plans for subject project, subject to staff comments. The City Commission and the Technical Review Committee have similarly reviewed and approved master plans and site plans. Developer Trammell Crow has submitted plat and construction documents to the City Engineer and to the Technical Review Committee and they have been found to be in substantial compliance with State and City regulations except as outlined in the letter from the City Engineer to CCL Engineers. RECOMMENDATION The City Engineer recommends that the Planning and Development Board accept the Developer'S proffered fee in lieu of land dedication ($60,000); approve plat and construction documents for the Vinings PUD subject to compliance with outstanding staff comments; and submit an appropriate recommendation to the City Commission for placement on a City Commission agenda by the City Manager. Show existing utility easement located parallel to the north boundary of the PUO, which will eventually contain a sewage force main to replace one that currently exists inside the project. The construction of the new force main will be addressed at the site plan stage. 2. Construction of the PUD is predicated upon the abandonment of an existing, recorded easement which runs through the project. We anticipate this easement will be abandoned once the required off-site force main is completed and placed into full operation. 3. We reserve the right to comment on landscaping that may fall within utilities easements. (Sect. 7.5-18.1 City Code) We have no objection to this project moving forward for City Commission review and action, subject to the above conditions.
