Edward Testa, President of Amerope Enterprises, Inc., and property owner of lot 16, block 2 of the "Cedar Ridge, a PUD and High Ridge Commerce Park, a Pion, is requesting a use approval for wholesale distribution of x-ray and nuclear shielding glass products within the High Ridge Commerce Park PIO (see attached location map - Exhibit "An). On June 17, 1997, the city commission granted Amerope Enterprises Inc. a use approval allowing manufacturing and warehousing of x-ray and nuclear shielding glass products within the PIO. Chapter 2 - Zoning, Section 7(E) of the Boynton Beach Land Development Regulations requires that any use proposed within the Planned Industrial Development (PID) district has to be approved by the Planning and Development Board and City Commission. To date, the list of permitted uses within the High Ridge Commerce Park includes the following: · wholesale and service of turf maintenance equipment · truck and solid waste container storage · manufacturing and warehousing of x-ray and nuclear shielding glass products Recent interest in providing wholesale distribution services within the subject use has spawned the need to provide rental square footage within the existing facilities to support the additional-..Jse. .. BACKGROUND Unlike other conventional zoning districts, the zoning code does not set forth specific uses permitted in a PID. Pursuant to Chapter 2 - Zoning, Section 7.E., in a PID, a building and its customary, ancillary structures and land use~ may be erected, altered and occupied for any office, professional, business (wholesale and retail), educational institution, adult entertainment (consistent with Section 11.M. of the zoning code) or industrial uses provided that such use or uses is/are approved by the Planning and Development Board. To approve such a use, the Planning and Development Board must make findings that the proposed use will not be in conflict with the performance standards listed in Section 4.N. of the zoning regulations, and that the use proposed is consistent with the intent and purposes of the / Page 2 Use Approval Staff Report Memorandum No, 98-158 Amerope Enterprise - USAP 98-002 Planned Industrial Development district. The land development regulations, specifically the Planned Industrial Development (PID) district guidelines, were designed to provide a zoning classification for light industrial development that would better satisfy current demands for light industrial zoned lands by encouraging development that reflects changes in technology, relates the development of land to a specific site and conserves natural amenities. In addition, it is intended "to accomplish a more desirable environment for industrial development in relation to existing and/or future city development, permit economies in providing public services, allow for economies of scale in industrial development, and to promote the public health, safety, convenience, welfare and good government of the City of Boynton Beach." The land use designation of this PID is "Industrial". The Comprehensive Plan allows for the development of light manufacturing and research and development activities in the industrial land use category which encompasses the M-1, and the PID, Planned Industrial Development districts, It should be noted for comparison purposes that wholesale distribution of glass and glass products are permitted in the M-1 zoning district. The following is a description of the zoning districts and land uses of the properties that surround the subject request (see Exhibit "An - Location Map). North Undeveloped, multi-family portion of Cedar Ridge PUD. East Seaboard Airline Railroad right-of-way and farther east is 1-95 right- of-way. South Parking and storage facility for Waste Management of Palm Beach, zoned M-1. West Right-of-way of High Ridge Ro~d and farther west is unincorporated Palm Beach County. .. ANALYSIS The purpose of the City's j)6rformance standards is to ensure that uses will nofbe a nuisance or hazard to persons, animals, vegetation or property located on adjacent or nearby properties or right-of-way; or to interfere with the reasonable use or enjoyment of adjacent or nearby property by reason of noise, vibration, smoke, dust, or other partiGulate matter; toxic or noxious matter; odor, glare, heat or humidity; radiation, electromagnetic interference, fire or explosive hazard, liquid waste discharge, or solid waste accumulation. The applicant has been asked to provide a response to the Chapter 2, Section 4N. ;< Page 4 Use Approval Staff Report Memorandum No. 98-158 Amerope Enterprise - USAP 98-002 be created by this uses. 11) Hazardous Materials and Hazardous Waste: The applicant states that no hazardous materials or hazardous waste will be created, stored or handled with the proposed uses. After reviewing the proposed uses in accordance with the performance standards contained in Chapter 2 - Zoning, Section 4N of the Land Development Regulations, the Technical Review Committee concurs with the above evaluation provided by the petitioner. RECOMMENDATION Based on the above analysis of the proposed use, it is recommended that the list of permitted uses within the High Ridge Commerce Park PID be amended to include wholesale distribution of x-ray and nuclear shielding glass products, subject to Environmental Review and approval (see Exhibit "e" - conditions of approval). This revision would include the entire facility, 19,449 square feet, which houses our corporate offices (1,761 s,f) And warehouse (6,235 s.f). Our previous use approval request on May 7, 1997 included only warehouse and manufacturing. Our facility also contains a maximum of two (2) rental units (one that has acquired both units at the present time), Rental Bay No. 1 is 6,855 s.f and Rental Bay NO.2 is 4,598 s.t: . These units, as mentioned above, would be incorporated in this revised request (warehouse, manufacturing and/or wholesale distribution). In any case, all areas shall conform to the approved list of intended uses by the City of Boynton Beach and any future tenant will have to apply individually for the Use Approval prior to occupancy, .. Regarding the request for wholesale distribution, this is limited to "industrial" purposes and does not receive any walk-in customers via delivery trucks. Amerope Enterprises, Inc, and all present and future tenants within this facility will comply with all of the City's performance standards. They are individually addressed as follows: -1- ? I, Noise: No sound will be created which is in violation of section 15-8 of the City of Boynton Beach Code of Ordinances. 2, Vibration: No ground vibrations will be generated by the proposed uses. 3, Smoke, dust or other particular matter: No emission of smoke, dust, dirt or other particular matter will be created. Revised Use Approval Dear Ms, Hayden: Please accept this letter as our formal request to revise our use approval status, incorporating wholesale distribution as one of our uses, Weare located on Lot 16, Block 2 of Cedar Ridge, a PJ,D, as recorded in Plat Book 46, Pages 58-61 of the Public Record of Palm Beach County, Florida, This revision would include the entire facility, 19,449 square feet, which houses our corporate offices (1,761 s,f) And warehouse (6,235 s.f). Our previous use approval request on May 7, 1997 included only warehouse and manufacturing, Our facility also contains a maximum of two (2) rental units (one that has acquired both units at the present time), Rental Bay NO.1 is 6,855 s,f and Rental Bay No, 2 is 4,598 s.f , These units, as mentioned above, would be incorporated in this revised request (warehouse, manufacturing and/or wholesale distribution). In any case, all areas shall conform to the approved list of intended uses by the City of Boynton Beach and any future tenant will have to apply individually for the Use Approval prior to occupancy, Regarding the request for wholesale distribution, this is limited to "industrial" purposes and does not receive any walk-in customers via delivery trucks, Amerope Enterprises, Inc, and all present and future tenants within this facility will comply with all of the City's performance standards. They are individually addressed as follows: -1- ? 1. Noise: No sound will be created which is in violation of section 15-8 of the City of Boynton Beach Code of Ordinances. 2. Vibration: No ground vibrations will be generated by the proposed uses. 3, Smoke, dust or other particular matter: No emission of smoke, dust, dirt or other particular matter will be created. The proposed uses will not allow the emission of any substances in violation of any federal, state, county or city laws or permits governing the emission of such substances. 4. Odors and fumes: No objectionable or offensive odors will be readily perceptible at any point beyond the industrial district. 5. Toxic or noxious matter: The proposed use will not allow any toxic or noxious matter to be discharged in such concentrations as to cause damage to property orvegetation discomfort or harm to persons or animals, or prevent the reasonable use and enjoyment of property or rights-of-way at or beyond the property line or to contaminate any public waters or any groundwater. 6. Fire and Explosion: The proposed uses will not create a fire or explosion hazard, 7, Heat, Humidity or Glare: The proposed uses will not produce heat, humidity or glare which is readily perceptible past the property boundary, The lighting will conform to the City of Boynton Beach's standards, 8. Liquid Waste: Any disposition of liquid waste will be in conformance with the provisions of Chapter 26 of the Boynton Beach Code of Ordinances of any applicable federal, state or county laws or permits. 9. Solid Waste: Any accumulation or disposal of solid waste will be in conformance with Chapter 10 of the City of Boynton Beach Code of Ordinances and will not be transferred to adjacent or nearby property or rights-of-way. 10.
