INTRODUCTION
David A. Silva, agent for the American Legion of Boynton Beach, property owner, is requesting to rezone this
0.17 acre parcel from the PU - Public Usage zoning district to the R-2 Residential Duplex zoning district (see
Exhibit "A" - Location Map).
BACKGROUND
In reviewing this request, staff has prepared a brief analysis using site history, current zoning regulations for
both the PU and R-2 zoning districts, and current conditions and possible development impacts. This property
was purchased by The American Legion of Boynton Beach in May 1992 and rezoned from R - 2 Residential
Duplex to PU Public Usage on November 1992, subject to a condition requiring the recording of a deed
restriction that limited the single family house already existing on Lot 5 (subject of this rezoning request), to
be used as a single-family residence (see Exhibit "B" - survey). The then American Legion officials confirmed
their intention of using the single-family house in accordance with the deed restriction by renting it out to assist
in paying the mortgage of the property.
To date, the house remains unaltered since being rezoned (to PU), and the current lessee has manifested his
interest in purchasing the property and continuing its use as a single-family residence (see Exhibit "C" -
Contract for Sale and Purchase). As stated in the application, the Legion desires to sell the property and use
the profits for charitable causes and other Legion purposes.
ANALYSIS
The potential buyer is proposing to use the property as a private single-family residence. The property, once no
longer owned by the Legion, should not remain in the PU zoning district. This proposal is generally supported
by the neighborhood as shown by several letters of support signed by neighbors.

In summary, the proposed rezoning is compatible with the established land use pattern in the area, is consistent
with the existing zoning districts, and represents the return of the property to its previous zoning designation.
Although, only single-family zoning (such as R-I-A) would be needed for the proposed use, the subject
property immediately abuts property already zoned R-2, which is intended to separate the adjacent single-
family zoning district from the railroad right-of-way located to the east. It should be noted that the land use
designation of Medium Density Residential remains unchanged and, therefore, consistent with the
Comprehensive Plan Future Land Use map.
CONCLUSIONS/RECOMMENATIONS
Based, in part, on the findings and conclusions described herein, staff recommends that this request for
rezoning from PU to R-2 be approved. This recommendation for approval is conditioned upon satisfying any
conditions of approval contained in Exhibit "D" - Conditions of Approval. There are currently no conditions
of approval recommended by staff; however, if any conditions are ultimately required by the Planning and
Development Board and the City Commission, said conditions will be placed in "Exhibit "D".

In accordance with the provisions of Standard "V", which allows modifications and changes to the Contract, Buyer and
Seller agree as follows:
1. Seller's Warranties and Representation: Obligations with R_peeI to the Property: Limitations.
(a) Paragraph XIII, Standard "0" and Standard "N" are deleted.
(b) This Rider does not relieve Seller of Seller's obligations under Standard W" for facts known to Seller.
However, except as required in this Rider and in Standard "W", Seller extends and Intends no warranty and makes
no representation of any type, either express or implied, as to the physical condition or history of the Property.
(c) Seller has received no written or verbal notice from any governmental entity or agency as to a currently
uncorrected building, environmental or safety code violation.
(d) Subject to the provisions and limitations of this Rider, Buyer waives any claims against Seller and, to the
extent permitted by law, against any licensee involved in the negotiation of the Contract, for any defects or other
damage that may exist at closing of the Contract and be subsequently discovered by the Buyer or anyone claiming

NOTICE IS HEREBY GIVEN that the Planning and Development Board of THE CITY
OF BOYNTON BEACH, FLORIDA, will conduct a PUBLIC HEARING at CITY HALL
COMMISSION CHAMBERS, 100 East Boynton Beach Boulevard, on Tuesday, August
10, 1999 at 7:00 p.m., to consider a request for rezoning submitted by American Legion
of Boynton Beach <property located on 571 West Ocean Avenue. The City Commission
of THE CITY OF BOYNTON BEACH, FLORIDA, will also hold a public hearing to
consider this request on August 17, 1999 at 7:00 p.m., or as soon thereafter as the
