FLORIDA, AUTHORIZING ABANDONMENT
OF A PORTION OF A 20.8 FOOT WIDE
ALLEY SOUTH OF FIRST METHODIST
CHURCH, LOCATED AT 101 NORTH
SEACREST BOULEVARD, BEING MORE
PARTICULARLY DESCRIBED IN EXHIBIT "An
ATTACHED HERETO; AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A
DISCLAIMER FOR SAID ABANDONMENT;
PROVIDING THAT THE ATTACHED
DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH
COUNTY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Michael Corbett, Agent for David Lynch, Trustee for First
Methodist Church, Owner, has requested the abandonment of a portion of a
20.8 foot wide alley south of the First Methodist Church located at 101 north
Seacrest Boulevard in Boynton Beach, Florida; and
WHEREAS, comments have been solicited from the appropriate City
Departments, and public hearings have been held before the City's Planning
and Development Board and the City Commission on the proposed
abandonment; and

WHEREAS, based on the foregoing information, the said utility
easement to be abandoned no longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, "=LORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach,
Florida by and through its City Commission, does hereby abandon a portion
of a 20.8 foot wide ally south of First Methodist Church located at 101 North
Sea crest Boulevard, as depicted on the attached Exhibit "A", located in the
City of Boynton Beach, Florida.

Section 2. The Mayor and City Clerk are hereby authorized and
directed to execute and deliver the attached Di~claimer and cause the same -
to be filed in the Public Records of Palm Beach Countv, Florida.
Section 3. This Resolution shall take effect immediately upon
passage, provided that the applicant has complied with the conditions of the
Development Order approved on Consent Agenda at the March 3, 1998, City
Commission Meeting.

of $50,960
Commissioner Denahan asked for clarification as to the scope of this work and reason for these
services being contracted out when the Oty employs custodial staff.
City Manager Willis explained that we have been in discussion about how to split some of our
work. The Parks Division has been experimenting with some contracting out of services. This
is one of those experiments. The parks involved are in outlying areas. It is more cost effective
to contract out these services. We are also in the process of evaluating other services as well

WHEREAS, Michael Corbett, Agent for David Lynch, Trustee for First
Methodist Church, Owner, has requested the abandonment of a portion of a
20.8 foot wide alley south of the First Methodist Church located at 101 north
Seacrest Boulevard in Boynton Beach, Florida; and
WHEREAS, comments have been solicited from the appropriate City
Departments, and public hearings have been held before the City's Planning
and Development Board and the City Commission on the proposed
abandonment; and
WHEREAS, based on the foregoing information, the said utility
easement to be abandoned no longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY.OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach,
Florida by and through its City Commission, does hereby abandon a portion
of a 20.8 fOQt wide ally south of First Methodist Church located at 101 North
Seacrest Boulevard, as depicted on the attached Exhibit "A", located in the
City of Boynton Beach, Florida.

Section 2. The Mayor and City Clerk are hereby authorized and
directed to execute and deliver the attached Disclaimer and cause the same
to be filed in the Public Records of Palm Beach County, Florida.
Section 3. This Resolution shall take effect immediately upon
passage, provided that the applicant has complied with the conditions of the
Development Order approved on Consent Agenda at the March 3, 1998, City
Commission Meeting.

overhead power and phone lines. A copy of the recorded easement shall be
provided prior to the Commission adopting a resolution for the
abandonment.
2. No utility company shall be held liable for the repairs to or replacement of, X
any portion of any structure(s) and any repairs to, replacement of, or
removal of any structure(s) for the utility company's access to the easement
will be done at the expense of the property owner. In addition, no utility
company will be held liable for any accidents that could result in any injury
or lawsuit. This language shall be included in the recorded easement
agreement as requested by the city attorney.
