Dear Mike,
In anticipation of the Planning & Development Board
reviewing the above-referenced Project on June 9th,we
want to submit the following issues for consideration during
the deliberations by the Board. Prior to the meeting on the
9th, several meetings have been held between represent-
atives of Via Lago and the proposed Banyan Cove Apartment
project.
These discussions have been constructive and have
demonstrated the willingness of the Project principles to
work closely with the residents of Via Lago as the project
moves through the approval process. Our intention this
evening is to formalize our primary issues and to make them
a part of the Board's minutes.
The issues ( and references to your Board packet, where
applicable ) are as follows :
1. Every effort should be made to reduce to an absolute
minimum any glare from the Project lighting into the the via
Lago residences. As part of this issue,it is requested that
lighting be provided for the walkway north of Building 16
along the walkway connecting the Project property to the Via
Lago property ( refer to Comment 43 ).
2. Consideration should be given to the drainage issues from
the proposed project to the Intracoastal. Use of retaining
walls,sea walls,etc.,should ensure the continued viability
of the existing beach front and natural landscaping ( refer
to comments 10 and 36 in the Board packet ).
3. Efforts should be made to remove and replace the manholes
at the end of the exisitng common road running through Via
Lago and ending at the property line of the proposed Project
( refer to comment 46 in the Board packet ).

4. Every effort should be made to landscape around the
periphery of the parking spaces located on the Eastern end
of the project. Such landscaping will alleviate the
starkness of the asphalt as seen by the residents of Via
Lago. Also,pavers should be used on the parking spaces at
the Eastern end of the project ( refer to comment 23 and 45
in the Board packet ).
5. Consideration should be given to eliminating some of the
parking requirements for the pool area and buildings 8,9 and
16 so that Buildings 8 and 9 can be set back further from
the water and beach area.
6. The roofing materials,colors,etc.,should be consistent
and compatible with the general appearance of the Via Lago
community ( refer to Comment 41 ).
7. Consideration should be given to reducing the number of
stories for Building 15 to two ( vs. three ). Such a change
will help to maintain the compatibility between the Project
and Via Lago ( refer to comment 44 ).
8. Consideration should be given to continuing the wall from
the northwest corner of the Via Lago property to the
existing wall running between Ben Venuto's Restaurant and
the Project's property.
9. Provide mature landscaping between Building 16 and the
Vai Lago property..the Northeast corner.
Your careful consideration of these issues during your
deliberations will be sincerely appreciated.

The easements are now reflected on the landscape plans. All utilities will be
underground and canopy trees will be planted outside of easements for their root
systems.
An HRS permit for water and sewer will be obtained.
Fire flow calculations will be submitted with HRS submittal that will meet or exceed
city code minimum requirements.
The capacity reservations fee will be paid upon final determination of fee.
Engineers certification for drainage is included herewith.
The utility easements are shown on the conceptual engineering plans.
All points of the building will be within 200' of the proposed hydrants as reflected on
the plans.
Back flow precentors are included on the fire sprinkler lines as reflected on the plans.
Water and sewer plans will be submitted to the city prior to permit issuance.
The hydrant locations are reflected on the site plans and site engineering plans. The
emergency vehicle acress gates will be provided by Knox Box method or other method
as approved by Boynton Beach Fire and Police Department.
# 11. Detail drawings of the signs for this project are included in the "Sign package" enclosed
herewith.
# 12. Details of the handicap striping and signage are included in the revised site engineering
plans,
# 13. Entrance details are included herewith which includes a "Knox Box" emergency vehicle
access system.
# 14. Traffic demand and effect is analyzed in the enclosed traffic report as prepared by
Yvonne Ziel, Traffic Consultant.
#15. The project was approved by FOOT Variance committee for the existing median
improvements. The median acress was improved within the last few years and is a "T"
intersection with no East Bound movements as a potential source of conflicts. Please
see enclosed recent approval (March 1998) of the median access by FDOT.

The plans will be submitted to all agencies having jurisdiction thereof for permits.
The additional stop signs and stop bars are included in the revised engineering plans
and site plans..
The engineering plans have been modified to reflect all recent changes to the site plans.
Pavement markings at the entrance islands are reflected on the revised engineering
plans and site plan.
All drawings are now signed and sealed by the design professionals.
The paver concrete bands are now reflected on the site engineering plans.
A general note regarding the site triangle was added to the site plans.
(a) The project signage will be illuminated as now indicated on the site plans.
(b) A "Sign Package" is included herewith. The location of signs are included on
the site plan.
(c) The site signage, entrance wall and fence are included on the site engineering
plans.
The accessibility route is identified on the revised site plan between the accessible
parking spaces and accessible buildings.
The aa:essibility route is identified on the revised site plan between the lease building
and US I.
The computations for fire ratings are included on the revised architectural plans.
The distance between the buildings and property lines will be reflected on the permit
drawings.
The addresses for the buildings will be determined with the City and Post Office at the
time of permit application.
The mail room is indicated on the site plan and architectural plans.
The inconsistency between the square footage on the floor plans and site plans have
been corrected.
The easements are shown on the site, landscape and site engineering plans.
The height of the fence has been reduced to 4' within the front set back.
A symbol has been shown for each type of building.
The clubhouse drawings were added to the index.
The architectural floor plan drawings reflect the area calculations.
The recreation dedication requirements is acknowledged.
The recreation items are as listed.
The existing dock will be totally replaced with the construction of the project.
The children's playground equipment is as noted on site plans consisting of high quality
equipment.
The nature path will be included with the permit drawings. The existing concrete
gazebo structures will be rehabilitated.
The media room shall contain a large screen television with digital surround sound,
VCR, Stereo Phonic equipment, Video cassette library, and library of books and books
on tape for the residents on a check out basis. A computer room will be available for
the residents for on line services, fax modem and Xerox reproductions and included in
the Leasing Office building.
FORESTER/ENVIRONMENTAL:

indicated.
Favorable review of the proposal generally means that you may develop plans complying with the Review
comments and submit them, within six months, to the Department for permit processing. When permit requests are
submitted subsequent to a Pre-application Review, Department permits personnel have the duties of checking the
viability of the design plans in terms of standards compliance and constructibility. In keeping with the spirit of the
Rule, the Department will attempt to abide with the Review comments favorable to your plan to the extent that

As discussed. you have requested that the portion of th~ overall property that is shown as C-3 (Community
Commercial District). appro"jmately 1.84 acres, be rc.zoned to the R-3 (Multiple Family Re$identiaJ District)
although the use is permitted in the C.3 zoning district. The majority of the property (see property map) is
presently ~oned R-3.
The detennination of the commercial zoning line was based upon your review of the city':I :toning maps and reflects
approximately 253 feet east of US Highway One right-of.way line.

The following are requirements of Chapter 4, Section 8 of the Code of
Ordinances and applicable NFPA Codes that must be addressed:
1. Hydrant and water main size and locations are not provided.
2. Roadway gates must meet Fire Rescue requirements (NFPA 1141 3-4.7).
3. Trees planted in the entrance median are too large.
4. Two (2) means of access for fire apparatus shall be provided.
5. Access to two (2) sides of each building is required (NFPA 1141 3-4.4).
I do not recommend this project go forward until sufficient corrections have been
made.

Banyan Cove, New Site Plan - 1st Review
We offer the following comments on this project:
GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utilities easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7,5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Dept. of HRS permits will be required for the water and sewer systems serving this project. (Sec.
26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal.
4) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project
either upon my request for signature on the Health Dept. application forms or within 30 days of site
plan approval, whichever occurs first. This fee will be determined based upon final meter size, or
expected demand.
5) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements. Please show all proposed easements on conceptual engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated via separate instrument to the City as
stated in Sec. 26-33(a) of the Code.
2) LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants.
3) Appropriate backflow preventers will be required on the fire sprinkler lines, if present, in
accordance with Sec, 26-207.
4) A building permit for this project shall not be issued until this office has approved the plans for the
water and/or sewer improvements required to serve the project. (Sec. 26-15)

I have the following comments in reference to the purposed Site Plan for BANYAN COVE.
1. Show a detail drawing of planned signage for building and apartment designation.
2. Show a detail drawing of handicap striping and signage.
3. Show detail of planned entrance and add note discussing planned method for emergency vehicle access.
4. Add note or document discussing effect of new development on current traffic in relation to current trips
vs. additional trips caused by new development. Also the effect on major intersections in the area.
5. Given SR 5's 40 MPH speed limit and the amount of traffic currently using SR 5 for north and south travel,
I feel that a left turn exit from the development to travel south on SR 5 would be dangerous and detrimental
to traffic flowing in and out of Banyan Cove, as well as traffic traveling north and south on SR5.

Site Specific Requirements
1. The applicant has submitted a tree survey and tree management plan for the site the
exact location of some of the existing trees shown on the plans is inaccurate. There
should be a second surveyed of these trees for accuracy and the appropriate amended
sheets of the plans resubmitted to the City.
2. All of the trees shown on the plans to be preserved in place or relocated must be
protected with proper barriers in accordance with the Tree Protection Ordinance. The
protective barrier design must be shown on the plans and installed around all of the trees
prior to issuance of the clearing and grubbing permit. Tree wells or walls will be required
around trees where the ground elevation changes would be detrimental to the health of
the root systems. These structures should be shown on the plans and installed at the
appropriate time of the site work.
3. The Environmental Impact Study is approved as submitted to the City. The applicant
must have approval letters from all environmental agencies, which require permits prior
to issuance of the clearing and grubbing, permit, by the City.
4. The applicant must submit a planting plan for 50% ofthe lake perimeter. The plan
should include upland and littoral zone trees, shrubs and understory plants.

We have reviewed the subject plans and offer the following comments that should be addressed prior to the
project being forwarded for Board review:

I. Land Development Regulations, Chapter 9 - Community Design Plan, Section 10.1.1. states, "Signs shall
be designed and treated as part of the architecture of the building and shall be reviewed at time of site plan
review." Therefore, add to the submittal, the detail drawings of proposed site and building signage. The
detail drawings shall include:
a. Identify with a note on the plans whether the .'Iite .'Iignage will be illuminated and, where
applicable indicate the type of illumination,
b. Ifthere is additional .'Iite .'Iignage proposed such as; directional signs, recreational area signs,
lease office sign, etc, add them to the site plan and provide detailed elevation view drawings of
each type of sign. The detail drawing shall include location, quantity, size, area, height and
color. The signage shall comply with the regulations identified in the sign code. [Section 1 and

residential building, lease office building and recreation area. Place a note on the site plan next to the
labeled symbol indicating that the accessible route complies with the regulations specified in the Florida

compliance with table 600 of the Standard Building Code, add to the elevation view drawing computations
that would identify the fire rating and percent of wall openings that are required for the proposed minimum
22 foot building separation, Also indicate, where applicable, the location of protective openings. The fire
rating, protective openings and percent of wall openings shall comply with table 600 of the Standard
Building Code.
5, Add to the site plan drawing the distance (setback) from the leading edge of each building to the adjacent

6, At time of permit review submit for review a plan that identifies the addresses of all buildings.
7. Indicate on the site plan how mail will be delivered to the residential units, lease office building and the
pool cabana/exercise room building.
8. Correct the inconsistency between the square footage proposed for the pool cabana/exercise room as
identified on the floor plan of the building and the building shown on the site plan versus the square
footage indicated in the site data found on sheet I of2.
9, To verify that the structures and specific landscape material do not encroach into an easement show, on all
plan view drawings of the site (site plan, landscape plan and preliminary engineering plan), the type, size
and location of all existing and proposed easements, Where applicable, remove all buildings and
structures from encroaching into and/or over an easement.
10. Reduce the height of the tence located within the front setback area from six (6) feet to the code required

The Leisure Services Department has reviewed the new site plan for Banyan Cove
Apartments. The following recreation-related comments are submitted:
1. Based on 180 multi-family units, the recreation dedication requirement is calculated
to be:
180 d.u. x .015 acres = 2.7 acres
2.7 acres divided by 2 for private recreation credit = 1.35 acres.
2. The devloper has indicated a desire to apply for one-half credit for private recreation
provided. The following recreation items are included in the applicants request:
a. swimming pool
b. pool cabana/exercise room
c. wood dock
d. gazebo with bench (landscaped quiet area)
e. children's playground
f. nature path
g. media room
3. The existing wood dock must be repaired and upgraded to meet the needs of
additional residents.
4, Specifications for the children's playground must be shown on the plan to be of
sufficient quality and quantity to meet the needs of this size community.
5. Layout (including length) of the nature path must be shown on the permit submittal.
Path must be constructed of asphalt, concrete or similar permanent material.

NEW SITE PLAN 2nd REVIEW COMMENTS
We have reviewed the subject plans and recommend that the request be forwarded for Board review with the
understanding that all remaining comments will be shown in compliance on the permit drawings:
Huildine Division (Site Specific and Permit Comments)
1.
Add to the proposed 1st tloor plan drawings of the residential buildings and lease office building the
continuation of the accessible route that is shown and labeled on the site plan. Also, add to the
submittal an enlarged drawing of the pool area and cabana building. Show on the drawing the
continuation of the accessible route that is shown and labeled on the site plan. The accessible route shall
be shown to the accessible entrance of the cabana building. Place a note on the drawings next to the
labeled symbol indicating that the accessible route is in compliance with the Florida Accessibility Code
for Building Construction. [Florida Accessibility Code for Building Construction, Section 4.3,
Accessible Route] Note: Following site plan approval the subsequent working drawings that are
required to be submitted for permit review shall include identifying the location, width, type of material,
curb cuts, slope and surface finish texture for the required accessible route, The permit plans, where
applicable, shall also include detail drawings of accessible ramps. The drawings shall depict the
location of the ramp(s) including specifying the type of material, surface finish, width, length, slope, size
oflanding required at the top and bottom of the ramp and where required the appropriate handrails.

A minimum building separation of twenty-two (22) feet is identified on the site plan. Therefore to verify
compliance with table 600 of the Standard Building Code, add to the site plan the location of the
assumed property line, Also identWy the dimension from both sides of the assumed property line to the
face of the building, The proposed calculations found on the elevation drawings do not reflect
compliance with table 600 of the Standard Building Code. Amend the calculations and, where
applicable, the building elevations to comply with the regulations of table 600 of the Standard Building
Code.

At time of permit review add to the site plan drawing the closest distance (setback) from the leading
edge of each building to the adjacent property line, The location of each building shall be identified with
no less than two dimensions from one side (long side) of the building and one dimension from the
adjacent side. The distance shall comply with the minimum setbacks allowed per the zoning code,

On the tloor plan drawings correct the inconsistency with regards to balconies versus patios. Some of
the calculations list a balcony and the associated floor plan drawing identifies a patio, Amend the
designation of the buildings so the designations identified on the architectural drawings match the
designations identified on the site plan or change the designations identified on the site plan to match the

6. Show on the site plan and floor plan the accessible route leading to the mailroom. [Florida Accessibility

7, Add to the elevation view drawings of each building the overall height from average finish grade
adjacent to the walls of the buildings to the highest point of the roof The maximum height of the
buildings shall not exceed forty-five (45) feet. [Chapter 2 - Zoning, Section 4,F.]
8, At time of permit review submit a copy of the South Florida Water Management District permit that
verities the proposed tinish floor elevations meet the minimum standards.
9, The submittal included drawings and data that are not required to be submitted for site plan review but
rather required for permit review. Please note that the permit data and drawings were not reviewed at
this time and will be reviewed at time of permit review. The permit plans will be reviewed for
compliance with the applicable Building Codes, Energy Code, Accessibility Code and other applicable
codes and regulations identified in Chapter 20 - Building, Housing and Construction Regulations of Part

Eneineerine Division (Site Specific Comments)
1. All plans submitted for specific permits shall meet the city's code requirements at time of application,
These permits include, but are not limited to, the following: site lighting, paving, drainage, curbing,
landscaping and irrigation. Permits required from other permitting agencies, such as FDOT, PBC,
SFWMD, DERM, LWDD, DEP and any others, shall be included with your permit request.
2. Provide additional stop signs and stop bars on civil plans to the southwest of building # 13 and at egress
lane from parking lot adjacent to pool area. Also, show all these traffic control markings and signage on
site plan. [LDR Chapter 4, Section 7,B,2.]
], Need to show pavement markings around entrance islands. [LDR Chapter 4, Section 7,B.2.]
4, Show "limits of clear sight" as specified by FDOT Index #546.
5, Remove the note "Extruded Curb (TVP)" to the west of building #13 and replace with D curb per City
standards.
6, Change the color of the handicap pavement symbol to white per D.O,T. Index 17346 and specify the 5 x 5
sIze.
7, Specify double stripes for all parking stalls in accordance with City Standard Drawing B-900 12.
8. On the Engineering plans extruded curb shall not be used as wheel stops. All stalls shall use either 6'
concrete wheel stops, "0" curb or 14 W' curb per Standard Drawing B-900 12. Note: The use of a
continuous curb allows you to move the curb into the parking stall 2 feet providing more pervious areas
(see B-900 12).

We offer the following comments on this project:
SPECIFIC CONDITIONS
1) Canopy trees may be planted outside of the easement so that roots and branches will not impact
those utilities within the easement in the foreseeable future. LDR Sec. 7.5-18.1 gives public utilities
the authority to remove any trees that interfere with utility services, either in utility easements or
public rights-of-way. Note that some of the oak and mahogany trees shown on the revised plan
will have canopies encroaching within utilities easements, and will impact the proposed
systems. These must be deleted or relocated
2) Utilities easements containing gravity sewers may have to be wider than the 12-foot minimum due
to depth of the sewer being installed. A general guideline is that easement width shall be twice the
depth, plus 4 feet to allow proper clearance. Please adjust easements accordingly on the final
Health Dept. submittals, and the site plan.
All other comments have been either addressed or acknowledged by the applicant. One not addressed
is included below for inclusion in the Development Order.
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal.

utilities. In general, palm trees will be the only tree species allowed
within utilities easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within
the easement in the foreseeable future. LDR Sec. 7.5-18.1 gives public
utilities the authority to remove any trees that interfere with utility

4. Sec. 26-34(E) of the city code requires that a capacity reservation fee be
paid for this project either upon my request for signature on the Health
Department application forms or within 30 days of site plan approval,
whichever occurs first. This fee will be determined based upon final
meter size, or expected demand.
5. Provide an engineer's written certification that drainage will conform to
all rules of the city and the South Florida Water Management District.

The following are requirements of Chapter 4, Section 8 of the Code of
Ordinances and applicable NFPA Codes that must be addressed:
1. Hydrant and water main size and locations are not provided.
2. Roadway gates must meet Fire Rescue requirements (NFPA 1141 3-4.7).
3. Trees planted in the entrance median are too large.
4. Two (2) means of access for fire apparatus shall be provided.
5. Access to two (2) sides of each building is required (NFPA 1141 3-4.4).
I do not recommend this project go forward until sufficient corrections have been
made.

I have the following comments in reference to the purposed Site Plan for BANYAN COVE.
1. Show a detail drawing of planned signage for building and apartment designation.
2. Show a detail drawing of handicap striping and signage.
3. Show detail of planned entrance and add note discussing planned method for emergency vehicle access.
4. Add note or document discussing effect of new development on current traffic in relation to current trips
vs. additional trips caused by new development. Also the effect on major intersections in the area.
5. Given SR 5's 40 MPH speed limit and the amount oftraffic currently using SR 5 for north and south travel,
I feel that a left turn exit from the development to travel south on SR 5 would be dangerous and detrimental
to traffic flowing in and out of Banyan Cove, as well as traffic traveling north and south on SR5.

Banyan Cove, New Site Plan - pt Review
We offer the following comments on this project:
GENERAL COMME.NTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utilities easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Dept. of HRS permits will be required for the water and sewer systems serving this project. (Sec.
26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal.
4) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project
either upon my request for signature on the Health Dept. application forms or within 30 days of site
plan approval, whichever occurs first. This fee will be determined based upon final meter size, or
expected demand.
5) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LOR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements. Please show all proposed easements on conceptual engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated via separate instrument to the City as
stated in Sec. 26-33(a) of the Code.
2) LOR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants.
3) Appropriate backflow preventers will be required on the fire sprinkler lines, if present, in
accordance with Sec. 26-207.
4) A building permit for this project shall not be issued until this office has approved the plans for the
water and/or sewer improvements required to serve the project. (Sec. 26-15)

The Leisure Services Department has reviewed the new site plan for Banyan Cove
Apartments. The following recreation-related comments are submitted:
1. Based on 180 multi-family units, the recreation dedication requirement is calculated
to be:
180 d.u. x .015 acres = 2.7 acres
2.7 acres divided by 2 for private recreation credit = 1.35 acres.
2. The devloper has indicated a desire to apply for one-half credit for private recreation
provided. The following recreation items are included in the applicants request:
a. swimming pool
b. pool cabana/exercise room
c. wood dock
d. gazebo with bench (landscaped quiet area)
e. children's playground
f nature path
g. media room
3. The existing wood dock must be repaired and upgraded to meet the needs of
additional residents.
4. Specifications for the children's playground must be shown on the plan to be of
sufficient quality and quantity to meet the needs of this size community.
5. Layout (including length) of the nature path must be shown on the permit submittal.
Path must be constructed of asphalt, concrete or similar permanent material.
6, More information must be supplied concerning the equipment, materials provided and
size of the media room to ensure it is sufficient to meet the needs of the residents.

Find attached for your review the plans and exhibits for the above-referenced project. Please
review the plans and exhibits and transmit formal written comments to me no later than
5:00 P.M. on April 22. 1998. When preparing your comments, please separate them into
two categories; code deficiencies with code sections referenced and recommendations
that you believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable
the applicant to efficiently obtain Technical Review Committee approval:
1.
Use the review standards specified in Part IV, Land Development Regulations, Site Plan
Review and the applicable code sections of the Code of Ordinances to review and
formulate comments.
2.
The documents submitted for the project were determined to be substantially complete,
however, if the data provided to meet the submittal requirements is insufficient to
properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be
requested by the reviewer by contacting Scott Barber.

3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4. Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements
may conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their review
comments with the name of the appropriate TRC Member that is responsible for the
review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within
the time frame stated above, to me. The memorandum shall state that the plans are
approved and that they do not have any comments on the plans submitted for review and
that they recommend the project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to me for distribution to the applicant.
Please include the name and phone number of the reviewer on this memorandum. Scott Barber
will be the Planning and Zoning staff member coordinating the review of the project.
Planning and Zoning staff will send the applicant a cover letter which includes the comment(s)
and directions to amend the plans to comply with the comments and the procedures for
resubmission. When Planning and Zoning staff receives the amended plans, we will distribute
the plans with a cover memorandum to all TRC Members for review and approval.

Prior to Engineering sign-off, the applicant shall satisfy the following comments:
1. Revise the "Concrete Curb Detail Type D" of the paving details to show a minimum height of 18"
per D.O.T. Standard.
2. Correct section "D-D" of the paving details to show a 27' aisle-way instead of26'. Also, provide a
statement verifying that all aisle-ways having 90% stalls have been designed with a 27' back-up
distance.
3. Provide an engineer's certification that the drainage will conform to all City rules, regulations and
codes including Chapter 6, Article IV, Section 5 of the Land Development Regulations.
4. Prior to issuance of the Land Development Permit a Fee in Lieu of Land Dedication shall be paid
based on the acreage requirement per unit (.015) and the cost per developable acre ofland per
Chapter 1, Article V. of the Land Development Regulations.

Re: MANA TEE BAY RECREATIONAL IMPACT FEE
Dear Mr. Hansen,
The Development Department has reviewed your project and has determined your impact fee to
be $229,865.00. This amount includes a recreational credit of50% of the amount due. The fee
was based only on the useable acreage upon which your development is built. Although the City
allowed additional units based on your submerged lands and some credits toward the reduction
of your recreation fee, the value of the submerged lands are not on a parity with the uplands.
Should you disagree with the fee amount, there is an appeal process you may enter as specified
in Chapter 1, Article VII of the Land Development Regulations. It should be noted that as part
of any appeal, the Development Department shall recommend that an M.A.!. appraisal of the
submerged lands only, be done to determine their true fair market value. This value will then be
deducted from the sale price to determine the upland value.
