Cirillo and Bonnie Altadonna Request: A variance to Appendix A Sec. 4.B.2. of the Boynton Beach Code of Ordinances 1. reduce the side setback for an accessory building from 3 feet to 2' 8". 2. reduce the rear setback for an accessory building from 3 feet to 2' 6". 3. to allow an accessory building of 144 square feet where 100 feet is allowed. 4. to allow an accessory building of 12' 6" where 7 feet is allowed. Analysis: The applicant claims that the shed for which the variances are being requested replaces an old dilapidated shed on the property with approximately the same setbacks (see attached survey). However, no record of a building permit exists for either shed. Accessory buildings in residential districts are required to be constructed to conform to the following: i. All accessory buildings shall be located only in the side or rear yard at least twelve (12) feet from the principal building; and ii. Detached storage structures of any type construction not exceeding one hundred (100) square feet in floor area and seven (7) feet in height may be erected to a point at least three (3) feet from the side property line and/or at least three (3) feet from the rear property line providing no easement rights are abridged. The old shed that was removed had a side setback of 2.5 feet, a rear setback of 3.5 feet, a floor area of 121 square feet. No information is available on the height of the shed. The impact of the location, height and size of the shed would be minimal. The rear of the subject property is adjacent to Industrial Avenue which has industrial use on the east side of the street. If the Board should decide in favor of this variance, we would ask that a condition for a hold harmless agreement regarding construction in the easement be added to the approval. Jerry Altadonna 1220 N.W. 7th Street Boynton Beach, FL 33426 A. The shed was built on an existing slab which has been in the yard for seventeen (17) years. B. Changes in the shed were made because the old shed was rotted and falling apart. The contents was also being destroyed from the rotting metal shed. c. The wood shed is now a beautification to our property and not a degrading looking shed to the property. D. The shed is a good looking shed. On West Industrial Avenue there are 13 sheds in violence and degrade the property and are also rat infested. E. We feel we have upgraded our property and the property around us. F. The granting of this variance will not be injurious to the area. It is attractive to the eye, not degrading.
