This application is provided for under mandate from District Court of Appeal of the State of Florida, Fourth District. The Board of Adjustment is herein petitioned to examine the facts and exercise their authority under the code as pertaining the substained delay in processing -a Certificate of Occupancy by the Building Offical . A decision by Palm Beach Circut Court Judge Rodgers on 10-3-89, originally directed this appllent to appear before the Board of Adjustment for relief . under Sectio 10, C&D a review of orders and decisions. The application was altered by the building offical from Section 10, C&D to Section 4J 1&2 a section dealing with exemptioncfut side of the code, a variance-, when in fact the issue is of mis-stating the situation as defined by code. All construction is in code guide lines as precluded by Federal Insurance Mapping Agency recommendations for flood level (7) first floor elevations. The owner only requests the same as would be afforded had it not been required to meet the FIMA criterion as adopted by the city. Under permit 88-3162 issued by the City of Boynton Beach for the construction of the single family residence on Lots #40-43, Lakeside Gardens, all final inspections have been approved. The process necessary to issue a certificate of occupancy is stalled due to a biased interpretation by the Building Official as cited on the NOT APPROVED tag stating a violation of 103.6.1 & 103.8.6 CWA to SBC88. 1. West wall around pool higher than permited 2. Inspection not requested for tie beams & columns in wall - Pg.2 ", - Ihreferance to #1. West Wall, higher than shown on the architects plan. All walls are of equal height on architects plan Only West Wall height was changed on the architects plan. Change not made by architect on architects plan. Change made by Building Offical. Change violates Florida State Statues. #2. Inspections were requested for all points_ of construction to be inspected, including wall tie beam & columns. Affidavits were offered in evidence of walls construction integrity, but were refused by Building Offica1. Florida State Certified Professional Engineer testing results confirm proper construction, also not recognized by Building Offical. The arbitrary requirement that only the west wall be 2' shorter is inconsistent and unfounded by code or logic. Wall elevation is provided from grade as adopted by the city, Zone 7 Flood Level (FIMA). The altering of certified plans to facilitate a unfounded decision is against the law. The refusal of accepted methods to show construction integrity illustrates the discrimination present in dealing with the Building Offical. It is therefore petitioned of the Board of Adjustment to find that the requirement to lower the west wall only has no credence, and is held equal with the other connecting walls in code. Second, that the opinion of the building offica1 to refuse standard practice methods to substantiate construction integrity in this case be acceptable and affirming. He stated he has been getting ready for this hearing since August and was not happy that the meeting was scheduled at a time when certain members of the Board would not be in attendance because of the observance of a holiday. Mr. Cutro explained that this meeting was originally set for Monday, September 28, 1992. It was learned that was a religious holiday and the meeting was moved to Tuesday night. As of this morning, six Board members were expected to attend. At approximately 1:00 p.m., a fourth member contacted the City Clerk to advise that he would not attend the meeting.
