FACTS:
1. The property is zoned C-4 and requires a lot depth of 100 feet
(as per Appendix A-Zoning, Section 6-D-3).
2. This property was formerly zoned C-l and C-l zone at that time
had no such site regulation (ordinance #62-9).
3. This lot was platted with 92 feet lot depth (north side) and
99 feet depth (south side).
4. This property lost 10 feet of its depth to u.S. 1 right-of-way
(presently 82 feet and 89 feet respectively).
5. This property has the railroad on the west and Federal Hwy. on
the east and can't expand in depth.
6. This lot has a residential district to the west next to the
railroad right-of-way. Appendix A-Zoning, Sec. 6- D-3* requires
a 30'rear setbac~ and applicant wishes a 10' rear setback.
7. Appendix A-Zoning, Sec. 4-L requires a buffer wall where a
commercial or industrial district abuts a residential district.

STATEMENT OF JUSTIFICATION OF AN EXCEPTION AND VARIANCE
TO THE CITY OF BOYNTON BEACH'S ZONING REGULATIONS FOR THE
DOMINIC IANDlr1ARINO BOARD OF ADJUSTMENT PETITION
a)
The property in question was platted in 1950 as a singular
lot having a average depth of less than 100 feet. In the
1950's the East 10 feet of ~he lot was deeded to the public
as an additional right~of-way for U. S. H'wy. No.1 (N. Fed.
H'wy.), thereby causing the present average depth of 85.5
feet.
The lot is bordered on the East by U. S. H'wy. No.1 and on
the West by the F.E.C. Ry. Rd.; therefore, additional lands
cannot be purchased to meet code requirements.
b) The Zoning Regulations (Sec. 6-D-3) allows a rear yard set-
back of 20 feet except when the property abutts a residential
district.
It is our contention that the FIE.C. Ry. Rd. and N. E. 4th St.
(Railroad Ave.l. rights-of-way cause a sufficient buffer from
the residential district.
c) Section 4-C of the regulations requires a 6 foot high masonry
wall constructed along side and rear yards except on corner
lots where the code requires the wall only along interior lot
lines. This property is buffered from the residential district
by the rights-of-way for N. E. 4th St. (Railroad Ave.) and the
F.E.C. Ry. Rd. being some 90 feet of right-of-way. There are
five (5). parcels of commercial property along the West side
of N. Federal H'wy. from N. E. .10th Ave. (Martin Luther King
Blv'd.) North to the Boynton Canal. Four (4) of these pro-
perties are presently developed without the masonry wall along
the F.E.C. Ry. Rd.
If we are required to construct the masonry wall it would be
the only wall along commercial property that extends for
oyer 800 feet.
It is our belief that by the installation of a vine covered
landscaped chainlink fence this would be in keeping with the
existing neighborhood character and aesthetics.
In conclusion, we feel that the exceptions and/or variances to
the code requested in this application meet the following~
1. That special conditions and qircumstances do exist which are
peculiar to this property which would not be applicable to
other lands in the C-4 District.

2. That the special conditions and circumstances referred to
are not the result of this applicant or previous owners.
3. That the granting of the applicant's request will not confer
on him any special privilege.
4. That the denial of the request would deprive the applicant
of rights commonly enjoyed by other properties in this same
district and under the terms of the ordinance would work
unnecessary and undue hardship on the applicant.
5. The request are minimum variances that will make possible
the reasonable use of the land.
6. The granting of the applicant's request will not be injurious
to the area involved nor detrimental to the public welfare.
