FACTS:
1. This property is presently zoned C-3 and was formerly zoned
C-1.
2. In 1976 the building was constructed with 33 parking spaces
and is presently used as a Pizza Hut restaurant.
3. The existing 33 parking spaces would be all that is required
to add the cooler and dry storage unit along the rear of the
existing building.
4. The 12 foot extension to the existing building would render
four of the existing spaces useless for parking a standard
car.
5. The elimination of the four spaces would require a variance
to construct the addition as requested.
6.
The balance of the pavement will still park a sub-compact
car but our code does not give any credit.for compact car
spaces or spaces which do not meet the minimum requirements
of the Parking Lot Code.

STATEMENT OF SPECICAL CONDITIONS
A. The current Pizza Hut restaurant built in 1976 does
not operate under current operation standards,
which will require Pizza Hut management to upgrade and
improve their restaurant to meet current operation
standards.
This up grading will requi+e the addition of a pre-fab
cooler and dry storage unit added along the rear of the
building 12'-0" wide.The space required for this addition
will required the elimination of four parking spaces,
because proper back up space for these parking spaces
will be eliminated.
B. Special conditions and circumstances are not the result
of Pizza Hut management, but the result of an existing
restaurant that needs up grading and renovation to
current operation standards if this restaurant will
continue in business.
C. This will not give Pizza Hut restaurant any special
privileges that would be denied to newer restaurants
in the same zoning district, because they can design
their buildings to current operation standards and
current parking lot design that the existing Pizza Hut
restaurant has to implement thru the granting of the
proposed variance.
D.
Literal interpretation of the parking ordinances would
deprive the Pizza Hut management the chance, to upgrade
and improve their restaurant to current operation
standards if they want to stay in business.The newer
restaurants in the same zoning district are able to
implement current parking lot design and current
operation standards in their new structures that the
Pizza Hut restaurant could not,because of their existing
structure and parking lot design.
E.
The variance granted ~muld be the minimum required to
help make possible the up grading and renovation of an
existing restaurant'which needs improvement to current
operation standards.This would be a benefit to the city
of Boynton Beach,Pizza Hut employees and the general
public.
F.
The granting of this variance would still be in
harmony with the general intent of the parking
ordinance and would not be injurious or detrimental to
the public welfare,because adequate parking would still
be provided to customers patronizing this restaurant, it
would in turn create a better facility to be used for
the general public and Pizza Hut employees.
