FACTS:
1. This site is presently zoned R-1-AAB and was formerly zoned R-1-AA.
2. The land adjacent to the rear of the subject property is zoned
R-1-AAB and the present use is a church/school, st. Joseph's
Episcopal Church. The remaining property bordering said property is
zoned R-1-AAB and is presently occupied with single family
residential structures.
Variance #1 - Rear Setback Reduction
1. The required rear setback for the R-1-AAB zoned property is
twenty-five (25) feet. Appendix A-Zoning, Section 5.B.2.a.
2. The variance is requested to allow for the placement of a 207.06
square foot wood shed in the rear yard of the subject property.
3. The request is for a 17.6 foot variance to reduce the required
twenty-five (25) foot rear setback to 7.4 feet.
Variance #2 - Fence Heiaht
1. The maximum height of a fence located in a residential zoned
district is six (6) feet above finish grade. Appendix A-Zoning,
Section 4.J.1.
2. The variance is requested to allow for the installation of an eight
(8) foot high wood fence to be placed along the rear property line
of the subject property.
3. The request is for a two (2) foot variance to increase the maximum
height of the fence above finished grade from six (6) feet to
eight (8) feet.

ITEM NO.
A. FENCE: The subject property is located adjacent to St.
3oseph's Episcopal School and Church. There are adults,
teenagers and young children on the adjacent property a
majority of the day. Florida Power and Light recently
cut-back the larger trees and hedge thereby eliminating the
buffer between the property and the school and church area.
Due to the fact that I am a part-time Boynton Beach resident
and my property has an open pool area on the portion which
abutts the school and church, the higher fence is necessary
to provide the security to the property and deter children
from cl imbing a shorter fence and wandering into the
property unattended.
In addition, the property's elevation is lower than Seacrest
Boulevard, specifically the elevation for Seacrest Boulevard
is 23.12 feet and the subject property's elevation is 16.55
feet and is in a low lying flood zone. The 8' fence will
also shield the lights from the numerous automobiles which
turn off of Seacrest Boulevard onto Mission Hill Road.
SHED: Much of the same reasons for the fence apply to the
requested variance for the shed. As previously stated, I am
a part-time resident of Boynton Beach. The subject property
does not contain a garage and when I return North, I leave
an automobile, motorcycle and a large amount of landscaping
tools. My property has already been vandalized and the shed
is needed to secure these items and best fits into the area
within which the variance is requested.
B. The previous owner buil t the house below the elevation of
Seacrest Boulevard as stated in the above paragraph and the
School and Church existed before applicant purchased the
property. Florida Power and Light caused to have destroyed
the large amount of trees and hedge that was located on the
property and provided some of the security which is
necessary.
C. That is correct. Any property which would have this same
problem would be set back further from Seacrest Boulevard,
have a higher elevation and do not contain a pool which
abutts the school and church.

D. If the variance were to be denied, it would deny the
applicant the additional security and protection that is
need in this area that is already set-up as a "Crime Watch"
area. As stated above, the property has already been
vandalized during one of my absences.
E. Correct. The minimum variance for the additional 21 fence
height will make possible the security and elevation
blockage necessary to make the best possible use of the
residence.
In addition, the 12' variance for the shed would allow it to
remain in the area which would not block the gate and the
aesthetic beauty of the brick wall.
F. The granting of this variance would lend itself to more
harmony and security to the area involved, which as stated
above is already a Crime Watch area.
If both variances are not granted, it would lend itself to
increased vandalism, and, perhaps, to the possibility that a
child could climb a lower fence, and as stated, the property
contains an open pool area.
In addition, the Vestry of St. Joseph's Church and School,
on which the entire South boundary of the property is
located, has no objection to the addi tional height of the
fence. A copy of their letter is attached for your review.

FACTS:
1. This site is presently zoned R-3 and was formerly zoned R-3.
2. The required rear setback for the R-3 zoned property is forty (40)
feet. Appendix A-Zoning, Section 5.G.2.a.
3. This is the second request for a reduction in setbacks for the
described property.
4. The previous request was approved (Case #160). The request was
presented by showing a proposed site plan that identified the
location of two (2) buildings that would require approval of setback
reductions in order to be constructed. The variance request was
based on specific distances that would make each building buildable
for the location shown on the site plan. The previous request did
not take into consideration the rear setback reduction that is
described in this variance request and needed in order to place the
building as shown on the previous proposed site plan.
5. The land adjacent to the rear of the subject property is the F.E.C.
Railway right-of-way with a Planned Unit Development and a R-2
zoning district located west of the railroad tracks. The remaining
property bordering said property is zoned R-3 and is presently
occupied with single family and multifamily structures to the south,
east and vacant land to the north.
6. The present request is for a five (5) foot variance to reduce the
required forty (40) foot rear setback to thirty-five (35) feet.
