The following is the result of the Board of Adjustment
deliberation, November 4, 1991 meeting, regarding your request
for a special exception to the requirement(s) of Appendix
A-Zoning, referred to as Case Number 164.
Variance request - reduce the required forty (40) foot rear
setback to thirty-five (35) feet was approved with the condition
that the approved rear setback be limited to lots 12 and 13 of
the subject property and that approved variance Case Number 160

FACTS:
1. This site is presently zoned R-3 and was formerly zoned R-3.
2. The required rear setback for the R-3 zoned property is forty (40)
feet. Appendix A-Zoning, Section 5.G.2.a.
3. This is the second request for a reduction in setbacks for the
described property.
4. The previous request was approved (Case #160). The request was
presented by showing a proposed site plan that identified the
location of two (2) buildings that would require approval of setback
reductions in order to be constructed. The variance request was
based on specific distances that would make each building buildable
for the location shown on the site plan. The previous request did
not take into consideration the rear setback reduction that is
described in this variance request and needed in order to place the
building as shown on the previous proposed site plan.
5. The land adjacent to the rear of the subject property is the F.E.C.
Railway right-of-way with a Planned Unit Development and a R-2
zoning district located west of the railroad tracks. The remaining
property bordering said property is zoned R-3 and is presently
occupied with single family and multifamily structures to the south,
east and vacant land to the north.
6. The present request is for a five (5) foot variance to reduce the
required forty (40) foot rear setback to thirty-five (35) feet.

I 'WOuld ask the Board for the sake of clarification, to grant a 5' exception to the 40'

The variance of 25' granted at the September meeting (a 15' rear setback in lieu
of 40' required) will be for lots 10 and 11 only.

the applicant's property to give them a chance to voice their opinion on the
subject. Comments may be heard 1n person at the meeting or filed in writing
prior to hearing date, If further information is desired, call 738-7408,
City Clerk's office.
All interested parties are no~ified to appear at said hearing in person or
by attorney and be heard. Any person who decides to appeal any decision of
the Board of Adjustment with respect to any matter considered at this
meeting will need a record of the proceed1ngs and for such purpose may need
to ensure that a verbatim record of the proceedings is made, which record
includes the testimony and evidence upon which the appeal is to-be based.

A. Individual lot dimensions as platted were intended for minimal single family use
