You have told me that FP&L does have cable in this 5 foot easement but that the cable is not under Mrs. Mandina's screen porch extension. Mrs. Mandina has signed this letter. By her signature, she acknowledges the existence of your cable in that part of the 5 foot easement which extends westerly of the boundary of the slab on which the screen porch is built. She will hold FP&L harmless from any damage, and from any loss of electricity, that may result to her property from any entrance by FP&L into the 5 foot easement to repair or replace your cable. Mandina Variance Application Addendum This separate sheet is a part of the application of Constance C. Mandina for variance from the zoning code of the City of Boynton Beach. The purpose of this sheet is to answer question 5 on the Application. 1. The rear of Mrs. Mandina's Leisureville home is adjacent to the Leisureville Golf Course. Thus, the rear area is open and faces no other homes. Mrs. Mandina and her now deceased husband bought this home on August 15, 1970. 2. In late 1971, the Mandinas contracted for the construction of a "30 X 9' Permanent Aluminum Room, 30 X 8' Screen Room, and 30 X 8' concrete slab". (This language is quoted from the sketch of proposed work prepared by the contractor.) This patio, or Florida room, fits into an "L" on the northerly side of the house and extends 2.3 feet west of the rear line of the main Mandina structure. 3. Even though the Mandina property was and is not located in a PUD, the Mandinas applied for permission to the Architectural Control Committee of the Leisureville Community Association for permission to do the work. On December 21, 1971, the Committee approved the work in writing, describing the work as a "30 X 9' Permanent Aluminum Roof" and a " 30 X 8 ' Screen Room". The bill of Advance Home Centers, Inc., dated January 10, 1972, recites the sale to the Mandinas of a "Roof, Screen Room & Protek-N-Guard". The documents referred to will be produced at the Hearing. 4. No objection was made by anyone to this construction and it stood in place until late 1989 when Mrs. Mandina decided to fix it because of leaks, etc. 5. Mrs. Mandina hired Pat Silvester, trading as Father & Son, to do the work for $7,590.00. Mr. Silvester applied for a Building Permit, obtained it, and completed the work. He replaced the roof and installed aluminum and glass walls, etc. 6. Mr. Silvester, unknown to Mrs. Mandina who took no part in the process, lied to the City about the nature of the work he would do in his Building Permit application. 7. After completion of the work, Mrs. Mandina complained of continuing leaks which complaints were not satisfied by Mr. Silvester. City inspectors came to see the work in May of 1990, and made periodic visits until October, 1990, when Mrs. Mandina was cited for encroaching on the easement. 8 . Mr. S il vester has been through Chapter 7 bankruptcy proceedings and his whereabouts are unknown. Constance C. Mandina Variance Application Addendum Page 2 9. Apart from miscellaneous violations of the building code, the city officials discovered that the Mandina Florida Room, past and present, extended about 2.3 feet into what appeared on the maps to be a 5 foot utility easement at the rear of the Mandina home. The easement separates the Mandina home from the golf course but there is nothing on the surface to indicate that it is anything but the Mandina back yard. 10. The City Engineer's map of this section recites that there is a 5 foot building setback and that "Easements are for Public utilities, unless otherwise noted." Since the main part of the Mandina structure abuts the easterly part of the easement, the 5 foot setback must be coterminous with the easement. 11. An investigation revealed that this easement was a so called municipal easement and that, in fact, no municipal utili ties were located in it. At the Hearing, we will produce an Easement Approval Agreement executed by the City Director of utilities. 12. The neighbor immediately to the south of the Mandina house has a home identical in exterior configuration to the Mandina home. In late 1971, this neighbor also constructed a Florida Room which also extends west of the rear line of their home 2.3 feet into the easement. The neighbor's Florida Room was identical to that of the original Mandina room and was constructed at the same time as the original Mandina room by the same contractor. In November of 1981, the neighbor upgraded the Florida Room so that, as built, it is the same as the recent Mandina improvement. No complaint against this neighbor has ever been made and we do not suggest that one should be. The point is that extensions into this empty easement have caused no inconvenience for the owners, neighbors or the City for over 20 years. 13. A visual inspection of the nearby easement area reveals the existence of trees either in or close to the easement. The roots of these trees have to be growing underground throughout the easement area making it impossible to maintain any pipes or wires in this easement. An aerial photograph obtained from the County Appraiser's Office shows several adj oining properties with patios which apparently intrude into the easement. The photograph also shows the many trees which are either in the easement or very near to it. This aerial photograph will be produced at the Hearing. 14. This easement was provided for on the original plat in 1969. In 20 plus ensuing years, Mrs. Mandina has not seen or Constance C. Mandina Variance Application Addendum Page 3 heard of any utility using the easement area. No one has ever been observed digging in the easement, maintaining it or otherwise exercising any dominion or control over it. 15. Mrs. Mandina does not seek approval to do any work. The work is done and at the great expense of $7,590.00. A condition has existed for over 20 years that now appears to encroach upon an easement no one has ever used. Mrs. Mandina seeks to keep her Florida Room and be spared the additional expense and inconvenience of having to remove it or cut it back in size. 16. Forcing Mrs. Mandina to remove or cut back her Florida Room would advance no legitimate municipal purpose. The easement is unused so no utility's rights are being violated. The neighbor's Florida Room will stand regardless of what action the City takes toward Mrs. Mandina. The tree roots will continue to grow and spread in the easement area no matter what action the City takes against Mrs. Mandina. The current situation did not result from the actions of Mrs. Mandina. She was not consciously aware of the existence of the easement even though she may be charged with imputed knowledge. 17. Since the easement was never used, the grant of a variance would grant any special privilege to Mrs. Mandina that others cannot enjoy. A neighbor enjoys the same privilege. The trees enjoy the privilege. 18. The literal enforcement of the municipal codes in this case would work a considerable hardship on Mrs. Mandina because she will have been put through the expense of rebuilding her Florida Room, the expense of legal representation in this proceeding and the expense of tearing down the Florida Room. 19. The requested variance is the minimum variance that will make possible the reasonable use of the land and building. 20. The granting of the variance will be in harmony with the general intent and purpose of the zoning laws of Boynton Beach and the variance will not be injurious to the area involved or otherwise detrimental to the public welfare. .
