Adjacent lots are also "built out". B. That the special conditions and circumstances do not result from the actions of the applicant; ANSWER: The conditions evidently existed when I bought the building in 1980, but never came to light until 9/92. See attached. c. That granting the variance requested will not confer on the applicant any special privilege that is denied by this Ordinance to other lands, buildings or structures in the same zoning distric1 ANSWER:Granting the variance will allow me the same privileges other neighboring property owners enjoy. Without the variance, I will have to remove a tenant from the building to meet the parking requirements. D. That literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the Ordinance and would work unnecessary and undue hardship on the applicant; ANSWER: Without the variance, I would not be able to use the property to its fullest and best use in this zoning. E. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building or structure; ANSWER: I have 8 parking spaces, 10 are required. F. The current tenant mix has been clean and good for the community. Bay #1, Solar Guard, provides window tinting for cars, homes, and commercial buildings. Bays #2,3,&4, Wooden Wonders, custom builds cabinets and delivers to customers when finished. The remainder of the building is occupied by Colonial Glass and Mirror, which ins'talls windows and mirrors. All of the businesses currently have city occupational licenses with the exception of Wooden Wonders (cabinet maker) who has a license for bays 3 & 4, which he has occupied for a number of years. Approximately 18 months ago he needed additional space and he began occupying bay #2 in addition to bays 3 & 4. During a routine (9/92) city inspection, it was discovered that .he was occupying bay #2 without a license. He then applied for an occupational licenses but the application was denied due to lack of parking. Evidently, when the original developer built this building, he used the parking formula for warehouse storage, which required 8 parking spaces. To rent as Industrial- business, I need 10 spaces. Since I have no additional land to provide these spaces nor is any adjacent land available, I am requesting relief from the required 10 spaces and to be allowed to continue to rent the building to businesses with the 8 spaces provided.
