Request:
The applicant is requesting a reduction in the number of required
parking spaces. The manufacturing uses that presently occupy the
51,386 square foot structure require 103 parking spaces. The
applicant wishes to provide 61 parking spaces. Therefore, a
reduction of 42 parking spaces is requested.
Appendix A-Zoning, Section 11.H.16.f. (1)
f. Industrial, research and development, trades,
wholesale, and warehouses:
(1) Manufacturing and industrial uses not listed elsewhere:
One (1) parking space per two (2) employees, but not less than one
(1) parking space per five hundred (500) square feet of gross floor
area; plus required parking spaces for any other principle uses,
including office or retail floor area.
Analysis:
Mr. Rollyson, represented by Luis Nievas, is requesting approval of
the above stated variance. Find attached Exhibit "A", a letter
prepared by Mr. Nievas, which represents the statement of
conditions for the request. The following list is provided to
assist you in making your evaluations:
a. Mr. Rollyson sold the south 2.346 acres of his property to
Waste Management of Palm Beach. The 2.346 acres that was
subdivided away from the site included an existing
ingress/egress to the site from Industrial Way, thirty-five
(35) parking spaces with the remaining area of the vacant lot
covered with natural vegetation.
b. Prior to the property being subdivided a total of ninety-eight
(98) parking spaces existed on the site.
c. The property retained by Mr. Rollyson contains an existing
51,386 square foot building on a 4.05 acre site.
d. One hundred three (103) parking spaces are required for the
present manufacturing uses that occupy the existing building.
The method to determine the required number of parking spaces
for the manufacting uses is Section 11.H.16.f.(1)
e. The site has pervious area that would allow for an expansion of
parking spaces. An expansion to gain the required number of
spaces (103) would result in a total redesign and upgrade of
the existing parking facility.
f. The applicant has proposed a redesign of the existing parking
lot. The new design will provide a total of sixty-one (61)
parking spaces for Mr. Rollyson's property. (see Exhibit "B").
g. Approval of a site plan modification is required to implement
the proposed changes to the existing parking facility.

h. Waste Management of Palm Beach is presently processing a site
plan to develop their new property into a vehicle storage area
and parking lot.
i. The applicant is requesting a forty-two (42) parking space
reduction from the number of parking spaces required by the
Code for the uses that presently occupy the existing building.

H. Legal description
I. Number of acres to the nearest one-hundredth (1/100) of an acre
J. Location sketch of property
K. Surveyor's Certificate
2. A site plan properly dimensioned and to scale showing:
A. All proposed structures
B. All existing structures that are to remain on site
C. Setback lines for all structures drawn perpendicular from the
properly lines to the closest vertical wall of structures
D. Use of each structure (or uses within multiple occupancies)
E. Use of adjacent properties including right-of-way lines for all
streets and alleys, sidewalks, turn lanes and driveways
F. Elevations of the lowest finished floor of all structures on the
site
3. Certified list of names and post office addresses of property owners and
legal descriptions of their property within 400 feet of subject
property, as recorded in the County Courthouse. Such list shall be
accompanied by an Affidavit (see attached) stating that to the best of
the applicant's knowledge, said list is complete and accurate.
4. Proof of ownership of property by petitioner ( s ), such as deed or
purchase contract agreement. If an agent is submitting the petition., a
notarized copy of a letter designating him as such must accompany the
petition.
5. Statement of special conditions, hardships or reasons justifying the
requested exception or variance. Respond to the six (6) questions below
(A-F) on a separate sheet (Please print or type):
A. That special conditions and circumstances exist which are peculiar
to the land, structure or building involved and which are not
applicable to other lands, structures or buildings in the same
zoning district;

B. That the special conditions and circumstances do not result from
the actions of the applicant;
c. That granting the variance requested will not confer on the
applicant any special privilege that is denied by this Ordinance to
other lands, buildings or structures in the same zoning district;

deprive the applicant of rights commonly enjoyed by other
properties in the same zoning district under the terms of the
Ordinance and would work unnecessary and undue hardship on the
applicant;
E. That the variance granted is the minimum variance that will make
