REVIEW COMMENTS STAFF REPORT BOARD OF ADJUSTMENT May 10, 1993 Case #179 Location: 802 North Road Owners: Thomas Diddle & Lettie Tallent Request: The subject property is located on the southeast corner of North Road and Northeast Drive. The applicant is requesting approval to construct a pool to wi thin six point seven (6.7) feet of the property line along Northeast Drive. The request also includes installing a screen roof screen enclosure to within three point seven (3.7) feet of Northeast Drive. The code specifies that "on corner lots, property bordering both streets shall be considered as front yard". The code also specifies that no pool and/or screen enclosure shall be built in front of the front building line. Analysis: Thomas Diddle and Lettie Tallent are requesting the Board consider allowing them to construct a pool and screen roof screen enclosure on the east portion of their corner lot located at 802 North Road. The lot borders North Road and Northeast Drive with the front of the house facing North Road. The proposed pool and screen roof screen enclosure will be on the portion of the lot that borders Northeast Drive. Section 11.E. and F. of Appendix A zoning specifies that no pool or screen enclosure shall be constructed in front of the building line and on corner lots, property bordering both streets shall be considered as front yards. Find attached Exhibi t "A", a document prepared by the applicant, which represents the statement of conditions for the request. The following list is provided to assist you in making your evaluation: 1. The front yard setback for the subject property is 25 feet. 2. The actual front setback for the residence is 27.2 feet south of North Road. 3. North Road and Northeast Drive are both City streets that have a 20 foot wide right-of-way and 20 foot width of pavement. 4. All lots adjacent to and abutting the subject property are developed. 5. The proposed screen roof screen enclosure will align with the front line of the building 27.2 feet from North Road. 6. The proposed enclosure will be 3.7 feet west of Northeast Drive and 17.5 feet north of the south property line. 7. The proposed pool will be 31.2 feet south of North Road, 6.7 feet west of Northeast Drive and 25.8 feet north of the south property line. A.The conditions and circumstances are that our property has a very limited yard area. The yard area in the back of the house is even smaller, than what we have on the East side of the house. But from the oevelpper, by how. the houses were placed so very close to each other to allow a tiny road between every 3 houses. In a row of 15 homes we have a total of 5 access roads. This was truely an inacuseible use of the land waist of land ) for the home owners. c. By granting the variance requested will not confer us ( the applicants ) any special priviledge that is denied by this Ordinance to the other lands, buildings or struct- ures in the same zoning district. This variance occurs on our own property... which does not enter fear or go onto any neighboring properties. D. That literal interpretation of provisions of the chapter would deprive us ( the applicants ) of rights commonly enjoyed by other properties in the same zoning district under the terms of the Ordinance and would work unneces- sary and undue hardships on us ( the applicants ). We have neighbors that have pools who invite us to use theirs, but we don't want to always use theirs. We also have a beach permit sticker, but many times the water conditions do not permit swimming. We have to Delray to use the public pool. Here again and again we are caused -3- ~5 2 '1'2.. an undue hardship. E. The variance granted is the minium variance that will make possible the reasonable structure. By granting the variance we ( the applicants ) will be able to make the maost reasonable use of our small yard area. F. The granting of the variance will be in harmony with the general intent and purpose of this chapter and such variance will not be injurious to the area involved or other wise detrimental to the public welfare. The yard is already fenced in with latches on the inside.
