Dear Rocky:
A Board of Adjustment variance request regarding reduction in
number of required parking spaces for the Boynton Lakes Plaza
Shopping Center will not prohibit the issuance of C.C. 's or
C.O. 's for the project. This determination is based on a fact
that no changes occur to the project and/or permit plans under
consideration for C.C.'s or C.O.'s that would result in
additional parking spaces being required above the number of
parking spaces provtded at the shopping center and/or project
site. It should be noted that the Building Department, not the
Planning and Zoning Department, issues C.C. 's and/or C.o. 's,
therefore, this question has been directed to the wrong
department. You should question the Building Department on the
process they use to verify that the appropriate count of parking
spaces are in place at the site prior to issuing C.C.'s and/or
C.O.' s.

requirements for the parking variance. As I expressed during the
meet ing , a 1 though we current 1 y meet code, we do not want thi s
variance to impact us getting a Certificate of Occupancy.

variance from the Board of Adjustments does not administratively
prohibit us from receiving our final C.C's or C.O. 's on the

Dear Mr. weisberg:
The purpose of this letter is to correct the approveQ OU1~Q1ng square
footage that is recorded for Boynton Lakes Plaza. The proposed Boynton
Lakes plaza project is located at the southeast corner of Congress Avenue
and Hypoluxo Road, within Traffic Analysis Zone #417.
Prior to being platted, the approved building area for the Boynton Lakes
Plaza included an outparcel, located at the northeast corner of the
project. A portion of the total building area was transferred to the
corner outparcel (4121 square feet), leaving 133,712 square feet for the
greater plaza. This figure of 133,712 square feet was used for comple"Cin'J
the previous approval record.
On July 7, 1992 the City approved a site. plan for the corner outparcel.
This approved plan, with 1,570 square feet, is considerably smaller than
what was originally planned and, was accounted for within the traffic Stl1dy
submitted by the developer and approved by your office. consequently, th~
owner of the shopping plaza has now requested that the City transfer back
to the Boynton Lakes Plaza the unused building area, which amounts to tii~
difference between what was originally transferred from the plaza and whc~
was subsequently approved.
The City's concurrency records con"C1nue to indicate the original, comolned
total of approximately 137,833 square feet (on December 10, 1991 the
planning and Development Board approved "Che extension of concurrency for
137,833 square feet). However, the City;s previous approval list indica1:e3
the reduced bUilding area resul~ing from the ex~raction for the outparcel.
It is our desire to update all associated project lists to account for the
transactions that have involved this project. Please update any lists of
the City;s approved projects that you maintain to show this correct tlg~l~~
of 137,&33 square feet. If you have any questions, do not hesitate to

Dear Ms. Hayden:
Pursuant to our recent telephone convetsat1on, I am providing the foll owi 09
information regarding the Previous Approval status for the Boynton Lakes Plaza.
This project was determined to be a PreViOUS Approval by the City and concurred
by the County, with an intensity of 137,833 square feet. This is the intensity
officially on our records.
The Palm Beach County Traffic Division has reviewed two traffic studies for a
parcel of land on thp. immediate southeast corner of Hypoluxo Road and Congress
Avenue, identified as Boynton Lakes Commercial. The first traffic study was for
11. 000 square feet of commerci a 1. The secon,j traff1 c study was for a gas
stationt car wash and 1,570 square foot convenience store. When two uses have
different traffic generating characteristlcs, any change from one use to another
would have to address the traffic generation of the two uses. A reduction in
traffic due to an amendment to a site plan would be deducted from the project
traffic of the original approval.
It is possible for approved intensity to be transferred within a project. The
proj~ct must be subject to a single development order for a single applicant.
In the case in Questioot these are two separate projects and intensity can not
be transferred from one project to another.
