Location: 1613 S.W.3rd Street
Owner: Carl Lindner
Request: To reduce the required rear setback of forty (40) feet
to thirty-two (32) feet. The request is in connection
with the proposed expansion of the existing facility.
Analysis: Carl Lindner, owner of the facility, is requesting the
Board consider reducing the rear setback for the subject
property in connection with the proposed expansion of
the existing building. The property is located in the
R-3 zoning district, and Section 5 G. 2. of Appendix A
Zoning specifies forty (40) feet as the required rear
setback. The following is a description of the abutting
land uses and zoning district classifications:
North - across Woolbright Road (Interstate 1-95 right-
of-way), residential homes, property zoned Single Family
R-1-AA
South - mUlti-family units, zoned Multi-Family R-3
East - across S.W. 3rd Street (City road), City Park,
zoned Recreation REC
West - 1-95 right-of-way
The use at the subject property is a thirty-two (32) bed
Adult Congregate Living Facility. The facility has been
in existence since 1985. Through the development of 1-95,
the intersection of S.W. 3rd Street and Woolbright Road
was closed. Therefore, the project has frontage on S.W.
3rd Street, however, the street dead ends at the northern
border of the subj ect property. The request is to reduce
the rear setback. The rear property line is located on
the west side of the property and, as previously stated,
the west property line abuts the 1-95 right-Of-way.
Find attached Exhibit "A", a document prepared by the
applicant, which represents the statement of special
conditions for the variance request. The following list
is provided to assist you in evaluating the request:
1. The subject property is zoned R-3. The proposed
expansion requires conditional use approval and the
conditional use request is currently being processed.
2. The building expansion equals a total of three (3)
beds. The three (3) beds are being added to the
existing thirty-two (32) bed facility.
3. The expansion is towards the west property line. The
west property line borders the 1-95 right-Of-way. The
northwest corner of the proposed expansion is the
location of the setback encroachment.
4. The required rear setback is forty (40) feet. The
request is for a thirty-two (32) foot rear setback.
The requested thirty-two (32) foot setback is measured
measured from the west property line to the leading
edge of the one point five (1.5) foot building
overhang.
