AGENDA DOCUMENTS STAFF REPORT BOARD OF ADJUSTMENT september 19, 1994 Case #197 Location: 215 SE 8th Avenue Owner: Carol White Request: The request for variance involves the following sections of the Boynton Beach Code of Ordinances: Appendix A - Zoning, Section 8.A.G. The request is to reduce the rear setback from the required 20 feet to the existing 2 feet, 6 inches. Analysis: The site is located in the M-1 industrial zoning district off of SE 1st Street and SE 8th Avenue. The surrounding properties are as follows: North - Property developed for industrial use. East - Florida East Coast Railroad right of way. South - SE 8th Avenue and farther south property developed for an industrial use. West - property developed for an industrial use. The request for variance is the outgrowth of the inability of the applicant to obtain a building permit to rectify a situation created when the physical addition was made without a building permit. Find attached Exhibit "A", a document prepared by the applicant, which represents the statement of special conditions for the variance request. The following items are provided to assist you in making your evaluation: 1. The properties that abut the subject property are all located in the N:-1 industrial district and developed for industrial use except for the property to the east which is Florida East Coast Railway land. 2. The discrepancy in the rear setback is the result of the construction, without permits, of an open- sided hard roof addition that was installed to the rear of the existing building. 3. Allowing a reduction in building setbacks will increase the area of the lot the building may occupy. However, the maximum area the building may occupy of the lot (lot coverage) is limited to 60 percent. The proposed reduction in building setback will not violate the maximum allowed lot coverage. 4. The request is to allow a 17.5 feet reduction in the rear setback, 20 feet to 2.5 feet. a:boa197 /
