STATEMENT OF SPECIAL CONDITIONS
A, Individual lot dimensions as platted were intended for minimal single family
use fifty years ago. The property has been rezoned to R-3, but planning setbacks of
40' front and 40' rear are too severe for the maximum 100' depth, leaving only 20'
building area,
B, Applicant purchased the property in 1991. He has in no way influenced the
shape of the site or has he had anything to do with the zoning laws,
C. Granting this variance will not confer any special privilege. It is hoped that
the Board will grant relief to any applicant with similar property restrictions,
to
D. Strict interpretation of the zoning code will deprive applicant of the right to
develop the property in a reasonable manner.
E. The request for the variance is the minimum required to build a reasonable

STATEMENT OF SPECIAL CONDITIONS
A. Lot 9 has right-of-way frontage only along an unimproved roadway, and on
the railroad tracks, The north-to-south dimension of 100', with front and rear
setback, leaves only 20' to build on. The east-to-west dimension is worse - 84' and
less, giving a net of 4' for a building. Lot 8 is similar: setbacks leave only a 20' x 30'
buildable area.
B, The applicant has not created the special conditions and circumstances from
which he is seeking relief.
C. It is hoped that the BOA will grant a variance for any property in the city with
similar hardships. Applicant does not seek any special privilege in this request.
D, Applicant believes that literal interpretation of the zoning code will prevent
him - or any other owner - the right to develop the property.
E. A reasonable use of the property, zoned R-3, is to build a modest dwelling
unit on it; that is the purpose of the zoning. It is the unreasonable setback
requirements that should be modified for this site.
F. Variance will permit construction of two rental apartments (lots 8 and 9) that
will fit well in the area, and fulfill the general intent of the zoning code.
