ANALYSIS
The subJect prcperty is located on the north slde of N. W. 10th Avenue
approximatE~ly 550 feet west of N. W. 4th Street. The property is in the R-2
(Single - and Two-Family Dwell1ng) zoning dlstrict, The following 18 a
descript10n of the zoning districts and land uses of the properties that
surround the sUbject property:

City records lndicate the building was completed November 1, 1993, and built
in compliance with the building and site regulations in effect at that time,
The subject lot WhlCh consists of Lots 260 and 261 of the Cherry Hills
subdivis10n 1S a nonconforming lot as indicated below.

NOTE:
The maximum allowed lot coverage is 40 percent. The lot
coverage, including the proposed 285 square foot addition, 18
less than 28 percent.
Section 11.1, C. '/, of Chapter 2 Zoning of the City's Land Development
Regulations specifies the minimum side yard setback for a nonconforming lot
which lles 1n a residential zoning district shall be fifteen (15) percent of
the required lot frontage/width, If fifteen (15) percent of the lot width is
less than the requlred side yard setback specified in the R-2 zoning
regulations then that dimension shall be the minimum side yard setback and
take precedence over the side yard setback specified in the zoning
regulations. Ten (10) feet lS the required side yard setback for lots
located ln the R-2 zoning district. As previously stated, the required lot
widtl1 is 60 teet, Fifteen (15) percent of 60 feet is 9 feet. The applicant
is seeking approval to reduce the minimum allowed side yard setback of 9.0
feet to 6.1 feet.
As indicated on the attached survey, the exist1ng building is nonconforming
with regards to slde setbacks. At the time the existing residence was built,
the minimum slde yard setback was six (6) feet and the minimum lot width was
fifty (50) feet. The proposed addltion is to be constructed on the west side
of the bUllding, specifically the southwest corner, The existing side yard

setback along the west property line 1S 6.1 teet. The side yard setback at
the location of the proposed addition is eighteen (18) plus feet. The width
of the addition is twelve (12) feet, therefore, the proposed addition will
align with the existing bUllding.
Find attached Exhibit "A" - application, compos1te Exhibit "B" - survey of
the subJect lot and proposed site plan with variance request delineated.
Also, find attached Exhibit "C", a document prepared by the applicant, which
represents the statement of special conditions tor the variance request. The
summary ot facts area as follows:
1, The eX1sting building 1S located on a nonconforming lot in the R-2
zoning district. The lot 1S nonconforming with respect to lot area and
lot wldth (see chart above).
2. Section 11,I.C.7. of Chapter 2 - Zoning of the City'S Land Development
Regulations allows the m1nimum slde yard setback of a nonconforming lot
to be tifteen (15) percent of the required width of the lot. Ten (10)
feet is the minimum side yard setback req~lred for lots located in the
R-2 zoning district,
3. Sixty (60) feet is the minimum lot frontage required for lots in the R-2
zoning d1strict, Fifteen (15) percent of sixty (60) feet 1S nine (9)
feet.
4. The west side yard setback of the existing residence is six point one
(6.1) teet. The six point one [6,1) feet setback is nonconforming with
respect to current regulations, Six (6) feet was the minimum side yard
setback at the time the building was constructed and ten (10) feet is
the current min1mum side yard setback allowed,
5. The portion of tIle house where the addition is proposed is setback
eighteen (18) plus feet from the west property line,
6. The wldth of the proposed addition is twelve (12) feet.
7. The variance request will allow the proposed addition to align with the
west side of the eX1sting building,
8. city records indicate the building was completed in November 1963 and
was constructed in compliance with the building and site regulations in
effect at that time, Six (6) feet was the minimum side yard setback and
fifty (50) feet was the minimum lot width required at the time the
building was constructed.
9. The proposed request is to reduce the west side yard setback from 9.0
feet to 6.1 feet in connection with construction of a 285 square foot
addition to an existing residential building located on a nonconforming
lot.
