A. That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or buildings in the same zoning district. A separate loading area is not needed for this type of business due to the delivery times scheduled during off hours. B. That special conditions and circumstances do not result from the actions of the applicant. The deletion of the loading area is not a special condition to Papa Johns as a loading area is not needed and most stores do not have a separate loading area. C. That granting the variance will not confer on the application any special privilege that is denied by this Ordinance to other lands, buildings or structures in the same zoning district. Granting of this variance will not confer any special privileges denied to others operating a similar business where a loading area is not needed. D. That literal interpretation of the provisions of this chapter would deprive that applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the Ordinance and would work unnecessary and undue hardship on the applicant. The literal interpretation of the provision requires a loading zone which may be needed in most restaurant establishments, however due to the nature of the carry out/delivery business with a limited menu, a separate loading area is not needed. E. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building or structure. The variance of the deletion of the loading area will assist in making reasonable use of the parcel ofland as the site size constraints are of great concern in developing this land. F. That the granting of the variance will be in harmony with the general intent and purpose of this chapter and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. W. 7 Court in the City of Boynton Beach, Florida. See Figure 1, Site Location Map. The analysis in this report concludes that the proposed development does not represent an adverse traffic impact, as evidenced by the following conclusions: · The future roadway network will be adequate to provide acceptable levels of service on those links which are in the project's Radius of Development Influence (RDI). · The proposed development can demonstrate compliance with Test One of the Palm Beach County Traffic Performance Code. · The proposed development is also in compliance with Test Two of the Traffic Performance Code. The development operation provides pick-up and delivery only. No indoor seating for dining will be provided. Figure 2 illustrates the proposed development. Site Plan The proposed development will be located at the northeast quadrant of Boynton Beach Boulevard and N.W. 7 Court in Boynton Beach, Florida. The site will be comprised of 0.22 acres of which 1,142 square feet will be dedicated to the building area. Site Access One access point is proposed for the site. This access point will be located on N.W. 7 Court approximately 200 feet north of the northerly edge of pavement of Boynton Beach Boulevard. There will be no direct access to and from Boynton Beach Boulevard. Scheduled Buildout The anticipated buildout for the proposed site is expected to occur by the middle of 1996. Provisions of the Standard The Traffic Performance Standard consists of two tests, both of which must be satisfied in order for a site-specific Development Order to be issued: · Test One - Evaluation of the roadway network on a daily and peak- hour basis at the buildout of the proposed site, and · Test Two - Evaluation of the Year 2010 Interim Transportation System Plan. If both of the tests can be satisfied, the project can be given development approval. 5 ~-'--''''-----'---'-'_'_'"_ 'u.__"_.______',_,__ __ __ ,.. _~._~_.______.___,.~_...,~ .._ o. ..._ ____.__._______..._._________.__._._________.______..___.._ EXISTING ROADWAY CONDITIONS The foundation for the analysis of traffic impacts from the proposed site is the existing conditions on the roadway network. Existing Traffic Volumes Table 1 presents the 1994/1995 annual average daily traffic conditions while Table 2 presents the p.m. peak-hour traffic volumes from traffic count stations in the area. Only the p.m. peak hour was examined since the proposed development is not open during the a.m. peak hour activity of the adjacent roadway network. Counts were taken from the most current Palm Beach County Metropolitan Planning Organization (MPO) Traffic Volume Count Map. Peak-hour volumes were calculated by applying a "K" factor of 0.091 to the daily traffic volumes. This "K" factor is acceptable as indicated in the Traffic Performance Standard. Caoacity Analysis Generalized Daily Two-Way and Peak-Hour Service Volumes and Capacities are found in the Palm Beach County Traffic Performance Standard. They include Level of Service "0" thresholds: Lanage Daily Peak Hour Two-lane road Four-lane road Six-lane road 13,400 vehicles per day 29,400 vehicles per day 45,000 vehicles per day 1,220 vehicles per hour 2,670 vehicles per hour 4,100 vehicles per hour The vlc ratios shown in Tables 1 and 2 are simply the volume divided by the capacity. These conditions are described by the future traffic volumes expected by the middle of 1996, the Papa John's development year of buildout. Programmed Roadway Improvements An examination of both the Palm Beach County and FOOT Five Year Work Program indicates that there are no scheduled improvements to the roadway network in the immediate area of the proposed site. Future Traffic Volumes In order to assess the availability of capacity at buildout of the site, future traffic volumes were formulated. Palm Beach County provides compounded growth rate data in their Traffic Performance Standard Reference Document, 1994. This document provided very flat or negative compounded growth rates along both Boynton Beach Boulevard and Old Boynton Road. As such, a one percent per annum growth rate was used to estimate future conditions on these roadway segments. Maior Developments Another component of the development of background growth data is approved committed development in the area. . According to the Palm Beach County Traffic Performance Ordinance, a major project is any project, including those within municipalities, which is: 10 -_._...---._."_._._---_..~._--~._~,-_._--_._. .._--_...--.--_._-_..~~.__._--_._._---_.,.__._----,--_..---~--,,_.- · A Development of Regional Impact (DRI); or · a project which generates more than seven thousand (7,000) net trips; or · any project of any type or size which is contractually or by condition of approval bound to financing or constructing any portion of a major thoroughfare which is not site related. The Ordinance further states..."Using the major project maps, all traffic from the unbuilt portion of major projects approved prior to the County Engineer's approval of the proposed project's traffic study which will add more trips than ten percent of the Level of Service "0" to any link within the proposed project's RDI during the buildout period of proposed project shall be specifically accounted for in projecting traffic. " As indicated by the Traffic Performance Standard... "only the traffic generated from the unbuilt portions of the major projects as set forth above which are projected to be built during the buildout period of the proposed project shall be considered." An examination of the County's list of major projects revealed two major DRI's in the area of the Papa John's development: . Motorola DRI - located at the southeast corner of Northwest 22nd Avenue and Congress Avenue. · Quantum Park DRI - also known as Boynton Beach Park of Commerce located at the southwest corner of 1-95 and Northwest 22nd Avenue. 11 The Motorola DRI is approximately fifty percent built with 2,704 daily trips yet to be generated over the remainder of its buildout. It can be concluded that traffic yet to be generated from the unbuilt portions of the Motorola DRI will not exceed ten percent of the Level of Service "0 "capacity on any of the Papa John's Pizza' RDI study links. The Quantum Park DRI also has unbuilt portions of the development with a somewhat lengthy buildout. Development yet to be built at Quantum Park concurrent with the buildout of the Papa John's Pizza development was estimated to equate to approximately 4,600 daily trips. Considering the employment nature of Quantum Park, distribution would be weighted to and from 1-95. As such, it is not anticipated that traffic associated with the unbuilt portions of Quantum Park would impact the Papa John's study links by more than ten percent of their Level of Service "0" capacity. As such, traffic from each of the unbuilt portions of the DRl's was not included in the analysis of background traffic. Future Capacity Analysis Tables 3 and 4 present the results of the future capacity analysis on a daily and peak-hour basis, respectively. The volumes shown in these tables represent the future average annual daily and peak-hour traffic volumes anticipated by the middle of 1996. The volumes do not include the anticipated traffic from the Papa John's Pizza development. Two standard sources are used to estimate traffic generation - Institute of Transportation Engineers (ITE), Trip Generation, 5th Edition and Palm Beach County Unified Land Development Code. However, there was no published date available that accurately depicts the trip generation activity for this type of pick-up, delivery only restaurant. As such, a review of studies of similar sites as well as data collected at a similar site were undertaken. Comparison of Similar Sites In order to develop an accurate trip generation rate for this development, two methods were employed: . Review of similar studies in the Central Florida area. . Data collection at an existing Papa John's Pizza development in Palm Beach County. Two studies were conducted in the Central Florida area of existing Papa John's Pizza sites. These studies were conducted to establish a trip generation rate for a proposed Papa John's Pizza development in Gainsville, Florida. The aggregated results of these studies provide for a daily trip rate of 80.6 trips per thousand square feet and a p.m. peak hour rate of 19.45 trips per thousand square feet. Data were also collected at an existing Papa John's Pizza restaurant in Palm Beach County. This site is located at 832 Military Trail in the City of West Palm Beach, Florida. 15 ~-_._..._._."-~---------~.,,..~--~-'----------_._- -- ...- A copy of this trip generation activity and a summation of the subsequent results can be found in Appendix A. The data and summations as found in Appendix A had been previously submitted to Palm Beach County staff for their review and approval. Verbal approval of the study and its results were granted by County staff on June 27, 1995. As a result of the recent data collection activity and a review of available data, a consensus was reached as to an applicable trip generation rate for a Papa John's development in Palm Beach County. As such, a rate of 226.38 trips per thousand square feet will be used on a daily basis. Additionally, a rate of 29.16 trips per thousand square feet will be used on a p.m. peak hour basis. Further, an in/out split during the peak hour of SO/50 will also be used to estimate peak hour activity. Proiect Traffic Table 5 summarizes the trip generation activity using the generation standards as established through the recent data collection activities. Trips- in out 17 17 DISTRIBUTION AND ASSIGNMENT The distribution and assignment phase of the analysis involves allocating traffic generated as a result of the Papa John's development to the roadway network. Distribution Traffic distribution is the pairing of trip ends from the subject site with other land uses in the area. In this case, the predominant pairing of trips attracted to the Papa John's development are those produced by the residential properties immediately around the site. Traffic distribution is based on a gravity model which considers the attractiveness and ease of travel to competing destinations. The attraction of trips to the Papa John's development is expected to be predominantly home-based and non-home- based work related. Figure 3 illustrates the percentage of traffic assigned to each of the roadways in the study area. AssiQnment The distribution of project traffic to surrounding zones is used as a basis for assigning traffic to specific roadway links and intersection turning movements. Figure 4 depicts project assignments on a peak-hour basis at each of the project access points. Radius of Development Influence fRDI) According to the Palm Beach County Traffic Performance Standard, since the Papa John's development generates 259 external daily trips, a maximum RDI of one-half mile was established. The Palm Beach County Traffic Performance Standard requires that an analysis of all links within a one-half mile radius of the project be examined. Impact on Roadway Links The impact of the project-related traffic from the Papa John's development is calculated in terms of the amount of the existing daily Level of Service "0" Service Volume, which is the criteria established by the Palm Beach County Ordinance. Interpreting Significance Table 6 shows all roadway links within the maximum RDI. Link Capacity Analysis The existing and future conditions on the roadway network in the area of the Papa John's development have been presented in an earlier section of this report. Tables 7 and 8 present total average daily and peak-hour traffic conditions at the middle of 1996, including the background growth component and the traffic expected from the proposed site. Compliance with the Standard - Test One The primary policy determination in the Palm Beach County Traffic Performance Ordinance is that all links within the ROI must operate within the appropriate level of service at buildout of the proposed project. As Tables 7 and 8 indicate, one link (Boynton Beach Boulevard between 1-95 and Seacrest Boulevard) within the ROI operates at an unacceptable level of service. Therefore, this roadway segment is not in compliance with Test One of the Standard. The Standard further identifies roadway segments which have a vlc ratio of greater than 1.00. The Standard allows these identified road segments to exceed capacity by up to a total of five percent of Level of Service "0" as computed on an AAOT basis. These roadway links eligible for the excess five percent will be presumed to pass the average peak-hour test. The excess five percent shall be allocated on a first-come-first-serve application-filed basis; provided that no project may use more than one-fifth (1/5) of the five percent available on any link. 23 Palm Beach County has identified the segment of Boynton Beach Boulevard between 1-95 and Seacrest Boulevard as over-capacity. Therefore, the use of the excess one-fifth of five percent of capacity is applicable. The over-capacity segment, as found on Table 7, has an existing level of Service "0" capacity of 29,400 trips per day. The Standard allows that one-fifth of five percent, or 294 daily trips, may be added to this link. Project traffic assigned to Boynton Beach Boulevard between 1-95 and Seacrest Boulevard total 52 daily trips, as noted from Table 6. This is well less than the 294 dai!y trips allowed by the Standard. Therefore, the Papa John's development is now in compliance with Test One of the Standard. Compliance with the Standard - Test Two Test Two of the Traffic Performance Standard involves an examination of the County 2010 Interim Transportation Plan. Appendix B identifies all roadway segments in Palm Beach County projected to operate at unacceptable levels of service in year 2010. The Test Two ROI is limited to the directly accessed links on the first access major thoroughfare (Boynton Beach Boulevard). Specifically, the conclusions are: . The project will generate 259 external daily trips of which 34 external trips will occur during the p.m. peak-hour, . the traffic impacts are in compliance with Test One of the Traffic Performance Standard, and . traffic associated with the proposed development is in compliance with Test Two of the Traffic Performance Standard. It can, therefore, be concluded that the development of the Papa John's site should occur, as all requirements of applicable Standards have been met. The purpose of the data collection activity was to increase the database with regard to trip generation activity for this type of pick-up and delivery only restaurant. EXISTING TRIP GENERATION DATA As you may recall, in our previous meeting, I presented you with data regarding the trip generation activity for two similar sites in Central Florida to establish rates for a site in the Gainesville area. The results of that study indicated that the average of the two sites would provide for a daily trip generation rate of 80.6 trip ends per day per thousand square feet of building area. Further, the study provided for a p.m. peak-hour generation of 19.45 trips in the p.m. peak-hour. WEST PALM BEACH DATA COLLECTION ACTIVITY As per our previous discussions, we had decided to undertake data collection at a free standing site within the City of West Palm Beach. This particular site is located at 832 Military Trail, in the City of West Palm Beach just north of Summit Boulevard. Data collection took place on Tuesday, June 6, 1995 during the nonnal business hours for this particular Papa John's Restaurant between 11 :00 a.m. and 12:30 a.m. Table 1, at the end of this correspondence, summarizes the data collection activity at the Military Trail site. As noted on Table 1, a total of 163 vehicles were recorded which provided for 326 daily trip ends. Considering the size of the Military Trail building (1,440 square feet) a trip generation rate of 226.38 per thousand square feet was established based on the data collection activity of June 6, 1995. Figure 1, attached, shows the peaking ch~racteristics at the Military Trail site. Table 2, at the end of this correspondence, shows the comparison of this data. The Central Florida stores provided for an average rate of 80.6 daily trip ends per thousand square feet while the West Palm Beach study provided for a daily rate of 226.38 trip ends per thousand square feet. As noted, the Central Florida sites provide for a very conservative trip generation rate on a daily basis when compared to the newly collected data at the West Palm Beach site. Therefore, I would like your input into this matter with regard to the Central Florida trip generation data versus that of the West Palm Beach data. While I am not quite comfortable utilizing the aggregated results of the two Central Florida studies, I certainly do not want to be overly aggressive by using the results of the West Palm Beach study verbatim. Therefore, I would like to discuss this matter further with you so that we can develop an acceptable trip generation rate to be used for the proposed site on Boynton Beach Boulevard west of Interstate 95 in the City of Boynton Beach.
