R95-/~~ 'i !I ,/ II ,i j : WHEREAS, on May 17, 1994, the City Commission approved by :; Resolution No. R94-87, the execution of a Contract with Rossi ': and Malavasi, Engineers, Inc., for engineering services for i Miner Road; and II WHEREAS, on November 15, 1994, the City Commission approved I Resolution No. R94-196, which provided for the expansion of the , scope of engineering services; and WHEREAS, Palm Beach County has requested that additional engineering services be provided for the design of Miner Road from Lawrence Road east to Congress Avenue, at an additional negotiated cost of $10,550.00; and WHEREAS, it has been determined by the city Commission to i be in the best interests of the City to expand the scope of i services for that project; I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF Ii THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida does hereby amend Resolution No. R94-87, and R94- 196 to encompass the expanded scope of services, attached hereto as Exhibit "A". Section 2. A RESOLUTION OF THE CITY COMMISSION O.p.L , '-, / ~-"'/)--"-~: THE CITY OF BOYNTON BEACH, FLORIDA, REQUESTING THA T LAWRENCE ROAD BETWEEN GATEWAY BOULEVARD AND HYPOLUXO ROAD BE ADDED TO THE PALM BEACH COUNTY FIVE YEAR ROAD IMPROVEMENT PROGRAM. WHEREAS, Lawrence Road is a designated public road belonging to Palm Beach County; and 'I " WHEREAS, over 1,680 units have been approved ,1 for development by both the City of Boynton Beach and Palm : i Beach County; and WHEREAS, these developments when constructed, will I considerably exceed the threshold level of trips for Level of ; Service "D" on Lawrence Road; and i: I WHEREAS, these developments will pay to Palm Beach County I traffic impact fees in excess of 2.5 million dollars; and WHEREAS, if this road is not constructed concurrent with development, the City of Boynton Beach residents will suffer for the estimated 2 to 4 year design and construction time table with a severely overcrowded, unsafe roadway. NOW, THEREPORE, BE IT RESOLVED BY THE CITY COMMISSION OP THE CITY OP BOYNTON BEACH, PLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida, requests inclusion of Lawrence Road on the County l:a Five Year Road Program to begin the planning and design process for the road widening. ,r - - - i ! That the County agrees that the 'lmpac"t~......:_.:--: fees currently being collected from the developments impacting.__., i Lawrence Road be utilized to partially fund the road improvements required by these developments. R94-87 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ACCEPT AND EXECUTE A PROPOSAL FROM ROSSI AND MALAVASI ENGINEERS, INC., FOR ENGINEERING SERVICES FOR MINER ROAD; AND PROVIDING AN EFFECTIVE DATE. WHEREAS. the City Commission of the City of Boynton Beach, Florida deems it to be in the best interests of the citizens and residents of the City to accept and execute a proposal from Rossi and Malavasi Engineers, Inc., for engineering services for Miner Road. NOW. THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH. FLORIDA. THAT: Section 1. The City Commission of the City of Boynton Beach, Florida hereby authorizes and directs the Mayor and City Clerk to accept and execute a Proposal from Rossi and Malavasi Engineers, Inc., for engineering services for Miner Road, which proposal is attached hereto as exhibit "A". R94~~ , I I I " A rtESOLUTION OF THE CITY cm,:_,'JT:6SION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND PALM BEACH COUNTY, FOR CONSTRUCTION OF MINOR ROAD; AND PROVIDING AN EFFECTIVE DATE. :1 " !i !i , WHEREAS, Section 163.01, Florida Statutes, known as the ,i "Florida Interlocal Cooperation Act of 1969" authorizes local !! governments to make the most efficient use of their powers by i enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities that will harmonize geographic, economic, population and other factors influencing the needs and development of local communities; and I II ;: WHEREAS, Part I of Chapter 163, Florida Statutes, permits Ii public agencies as defined therein to enter into interlocal II agreements with each other to jointly exercise any power, 'privilege, or authority which such agencies share in common and which each might exercise separately; and WHEREAS, it is in the best interests of the citizens of I Boynton Beach to complete construction of Miner Road as soon as Ii possible since it is the most direct access from Boynton Beach ,! Fire Station #3 to certain development projects; and 'I " il WHEREAS, the City has collected $297,840 in impact fees ! from developers in the vicinity and Fire Station #3 and is willing to contribute that sum towards the design, planning and construction of the missing link of Miner Road; and WHEREAS, the County recognizes it is in the best interest of the citizens of the county who reside in the area of Boynton Beach Fire Station *3 to complete Miner Road, and therefore, is willing to undertake construction of the missing link of Miner Road with the City's participation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach, Florida, does hereby authorize and direct the Mayor and I City Clerk to execute an Interlocal Agreement between the City I of Boynton Beach and Palm Beach County for the construction of !
