PLANNING AND ZONING DEPARTMENT
MEMORANDUM NO. 96-531
TO: Tambri J. Heyden, AICP
Planning and Zoning Director
FROM: Jerzy Lewicki-=' L--
DATE: November 14, 1996
SUBJECT: Master Plan Modification - 2nd Review
Project: Citrus Glen
Location: South-east corner of Miner Road and Lawrence Road
Agent: Executive Estates of Boynton Beach Homeowners
Association
File No.: MPMD 94-008
The following is a list of 2nd review comments regarding the Master Plan Modification
review of the plans for the above-referenced project.
COMMENTS:
1. The chart listing amended setbacks indicates different requirements for
pools/spas/jacuzzis and screen enclosures. Illustrate these different
setback requirements on separate drawings for the following categories:
a. building
b. pool/spa/and jacuzzi, and
c. screen enclosure
2. Provide a statement on the master plan that within the 10 feet, non-zero lot
line setback area trees, decorative elements and other access obstructions
do not exist or, if they do, will be removed or relocated prior to receiving a
building permit for a pool, spa, jacuzzi, or screen enclosure.
3. To maintain an unobstructed access to the lot it is recommended that a 10
feet wide access easement be established and dedicated along the non-zero
lot line at time of permit.
4. Provide a statement by a registered engineer that the drainage can be
handled by the existing drainage system when amenities on all lots are
constructed.
5. It is recommended that modified setback requirements, as proposed by
petitioner will apply only to the following courtyard houses, as these are the
only courtyard houses that currently have no existing utility easements in the
sideyard and pose no Fire Department access problems: 2, 11, 12, 14, 16,
18,19,21,53,63,99,126,131-138,143,145-147, 149-152, 154, 156, 157,

ONING DEPT.
TO: Tambri Heyden.
Planning & Zoning Director
FROM: John A. Guidry,
Director of Utilities
Date: November 14, 1996
SUBJECT: Citrus Glen, Master Plan Modification
Staff has reviewed the above referenced project and offer the following comments:
1. Due to existing easements the following lots may not be allowed to have the
requested reduction in sideyard set back: Lot # 1,5, 7,13,23,28,31,37,43,
46,48,50,54,61,68,75,82,89,93,97,100,141,144,148, 153, 159, 163,
172, 176, 181, 191, and 194. As this proposal was submitted for the entire
P.U.D., the request cannot be approved due to the presence of utilities in the
side yards of these lots.
2. Utilities is concerned that the residents within Citrus Glen and the surrounding
subdivisions will not receive as clear a notice of proposed change should this
go through as a master plan modification as it would if a variance request for
each lot, as requested, were submitted.
It is our recommendation that the plan not proceed through the review process.
If you have any questions regarding this subject, please contact Skip Milor at 375-6407 or

RE:
Citrus Glen
M.P. Modifications D94-008
We have re-evaluated our position on side yard set backs. Many of the side yards at Citrus Glen
have extra foliage, fences, etc. that may intrude on the fire department's access.
All models with the exception of the "Courtyard" models seem to have completed their desired
improvements. Noting the situation with the courtyard models we have no further objections to
the request for a ten (10') foot side yard (specifically lots - 1,2, 11-14, 16, 18, 19,21, 53, 63, 93,
99, 126, 131-138, 143, 145-154, 156, 157, 190-196).

We feel the request for side set back reduction is a major change to this development. We can not
condone a change to the master plan at this time and recommend this request not go forward.
Previously, we have studied site changes on an individual basis through variance requests. In this
case this is probably the best solution.

RE:
CITRUS GLEN - MASTER PLAN MODIFICATION
The Development Department has no record documents identified as Master Plans for subject
project, so we have no way of comparing the current request to existing documents. The fact that
you are calling this a second review is also puzzling because we have no record of a first review.
As a general statement, we do not support modifications to PUD Master Plans where the original
rules are established by an applicant so as to obtain PUD zoning. Such appears to be the case
with this application, and we therefore recommend disapproval.

CITRUS GLEN MASTER DEVELOPMENT PLAN MODIFICATION
The Building Division's comments on the above subject are as
follows:
1. The project request should be resubmitted addressing only
code related items for our approval and not homeowners
association's requirements which the city does not enforce.
2. Setbacks should be from property lines and should include
setbacks for odd shaped lots and for double frontage lots.
3. Common ground should be clearly defined or setbacks should
be addressed from lot lines only.
4. Identify the lots that are affected by this modification and
also show how this relates to the minimum easement for
maintenance on the 0 lot line lots.
5. The application should be made by the homeowners
association.

Citrus Glen PUD Master Plan Modification
File No. MPMD 94-008. Reduce the non-zero side setback
for screen enclosure from 15 feet to 5 feet.
Please be advised of the following comments relative to the review
of the above referenced request for master plan modification:
1. Submit an adjusted letter from the Homeowners Association
Board of Directors stating specifically; what is requested
regarding setbacks and what lots are involved. Include a statement
regarding the reason for the request. The letter shall reference
drawings and/or exhibits that illustrate the request. It is
recommended that the letter and plans indicate an overall height
for the proposed screen enclosures. Remove the notes from the
detail drawings and omit the Homeowners Association conditions from
the letter and detail drawings.
2. If the request is for courtyard home lots only, specify same
in the letter and provide plot plan drawings showing the location
of the footprint of the requested screen enclosure with pool/deck
for each different type of lot configuration/location in the
development that have a courtyard home. The requested location of
the screen enclosure, including pool and deck, shall be identified
