ANNEXING A CERTAIN UNINCORPORATED TRACT
OF LAND THAT IS CONTIGUOUS TO THE CITY
LIMITS WITHIN PALM BEACH COUNTY AND THAT
WILL, UPON ITS ANNEXATION. CONSTITUTE A

ANNEXATION PURSUANT TO ARTICLE I,

PROVIDING THE PROPER LAND USE

ORDINANCES TO BE PASSED SIMULTANEOUSLY
HEREWITH; REPEALING ALL ORDINANCES AND
PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR ADVERTISING; PROVIDING AN
EFFECTIVE DATE; PROVIDING AUTHORITY TO
CODIFY; PROVIDING THAT THIS ORDINANCE
SHALL BE FILED WITH THE CLERK OF THE
CIRCUIT COURT OF PALM BEACH COUNTY,

Beach, Florida, directed to the City of Boynton Beach,

I, Section 7 ( 32) of the Charter of the City and Section
171.044, Florida Statutes; and

Pursuant to Article I, Section 7(32) of
the Charter of the City of Boynton Beach, Florida and

the right-af-way for L.W.D.D. Canal L20,
being the north 50.00 feet of said
section, and less the right-of-way for
Lawrence Road, (an 80.00 feet
right-of-way) ;
Excepting therefrom, the west 140 feet

of the City of Boynton Beach, Florida, is hereby amended to
reflect the annexation of

particularly described in section 1 of this Ordinance.
Section 3:
That by Ordinance adopted simultaneously
herewith, the proper zoning designation and Land Use
category is being determined.
Section 4:
All ordinances or parts of ordinances in
conflict herewith are hereby repealed.

Should any section or provision of this
Ordinance or any portion thereof 'be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 6:
This Ordinance shall not be passed until
the same has been advertised for four (4) consecutive weeks
in a newspaper of general circulation in the City of Boynton
Beach, Florida, as required by the City Charter and Section
171.044, Florida Statutes.
Section 7:
This Ordinance shall become effective
immediately upon its final passage.
Section 8:
Specific authority is hereby given to
codify this Ordinance.
Section 9:
This Ordinance, after adoption, shall be
filed with the Clerk of the Circuit Court of Palm Beach

WHEREAS, the City Commission of the City of Boynton

in which a Revised Zoning Map was adopted for said City; and
WHEREAS, the City Commission of the City of Boynton
Beach, Florida, is simultaneously herewith adopting an
Ordinance annexing a parcel of land more particularly
described herein into the City limits of said City; and
WHEREAS, the owners and agents of the property have
requested the above mentioned zoning classification; and
WHEREAS, the Planning and Zoning Board of the City of
Boynton Beach, Florida, has heretofore held pUblic hearings
regarding said development; and
WHEREAS, the City Commission deems it in the best
interest of the inhabitants of said City to amend the
aforesaid Revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION

Accompanying this memorandum you will find copies of applications
and documents related to the requests for annexation, amendment
to the future land use element of the Comprehensive Plan and
rezoning submitted by Michael D. Gordon and Rick Rossi, agents
for Intracoastal Development, Inc. and GNM Associates,
applicants. The application fees submitted to the Planning
Department for these requests have been forwarded to the Finance
Department for processing.
It is anticipated that public hearings for these requests will be
held during the second and third weeks of June 1987. The date of
the public hearing before the Planning and Zoning Board will be
determined by the Board at the April meeting. The Planning
Department will then prepare legal advertisements (including a
map) which will be forwarded to your office upon completion.

II. MATERIALS TO BE SUBMITTED WITH APPLICATION.
g. (Page 4) - The property is unsuitable for develop-
ment under the existing zoning because said property
is presently zoned AR (Agricultural) by Palm Beach
County. The property is more suitable for develop-
ment under the proposed zoning since it will be
developed in accordance with the land use densities
established by the City of Boynton Beach. In
addition, the property will be serviced with
utilities provided by the City of Boynton Beach.
h. (Page 4) - The property can be deveioped under the
existing AR (Palm Beach County) zoning at a
density of 1 unit per 5 acres.
h(l), (Page 4) - It is not economically feasi~le to
develop the property under the existing zoning.
The proposed zoning or development shall provide
for a density not to exceed 4.82 dwelling units
per acre with the following type of dwelling
· units:
1 - Zero lot line units - 132
2 - Duplex units - 118
The type of dwelling units is based upon a market
feasibility' analysis and product recommendation prepared
by Robert Charles Lessor & Co., Real Estate Marketing
Consultants.

(Page 4) - The uses that would be allowed in the
proposed development include residential dwelling
1 units and accessory recreational facilities (i.e.,
pool, tennis courts, and clubhouse), associated
with said residential units. Any other use would
be excluded.

It is anticipated that the project will be developed
in two (2) separate phases with two (2) distinct
types of residential dwelling units as follows:
1 - Zero lot line units
2 - Single family attached (duplex) units
Initial platting and development of the project
will include a section of both types of dwelling

Dear Mr. Clark:
I have discussed with you the obligation of the developer of
Chalet IV to construct Miner Road westward from its present
terminus to east property line of the reference Citrus Glen.
You have indicated that there is no firm commitment as to when
this 1,200 L.F. segment of roadway would be built, however, the
City holds a bond in excess of $50,000.00 for the proposed
construction. The bond does not appear to be sufficient to
complete the required work.
The developer of Citrus Glen plans to proceed expeditiously
the platting process and has asked for reassurance that
missing link will be completed by May of 1988.

SUBJECT: CITRUS GLEN PHASE II/ADDITION ELEMENTARY SCHOOL "P"/LAWRENCE LAKE
Dear Mr. Annunziato:
As requested, the Palm Beach County Traffic Division staff has reviewed the
plans and traffic impact analyses for the above mentioned developments. The
following comments are provided for your consideration:
1. If Citrus Glen Phase II and Lawrence Lake were being reviewed under
the County's new Traffic Performance Standards (County Ordinance 87-18),
the 4-lane wideni~g of Hypoluxo Road between Congress Avenue and 1-95
would be required to be under construction before ~ building permits
could be pulled. Also, the amount of background traffic growth to be
considered during the "5-7 year buildout" of these projects would be
far greater in most cases under the new Ordinance.
2. The County anticipates adopting in the near future a 110' cross-section
to replace the old 108' cross-section included in its Thoroughfare
Right-Of-Way Protection Map. The plat for Citrus Glen should, there-
fore, show a lID' right-of-way corridor for Miner Ruad.
3. There appears to be an under-assignment of peak hour trips to the
southern access to Citrus Gl en Phase II from Lawrence Road. Gi ven the
50%/50% distribution of trips to north/south Lawrence Road, and the
1 ocat ions of the two Lawrence Road accesses with respect to the 106
units in Citrus Glen Phase II, it is likely that sufficient traffic
would use the south access in the peak hours to warrant separate
westbound 1 eft and ri ght turn egress 1 anes onto Lawrence Road without
school traffic included. It is also possible that sufficient southbound
left turn traffic on Lawrence Road would exist during the PM peak hour
at the southern access to Citrus Gl en Phase II to warrant a separate
turn lane.

At the request of Intracoastal Developers Inc. of Delray Beach,
Florida, we are submitting to the consideration of the City of Boynton
Beach a revised Master Development Plan for the previously approved
Citrus Glen P.U.D. located east of Lawrence Road and south of Miner
Road extension.
This revision is submitted to expand and integrate the approved development
to the abutting 28.82 Acres located south of it.
The purpose of the changes proposed are only to connect and integrate the
circulation of both projects (Phase I, the previously approved and Phase II,
the additional 28.82 acre simultaneously submitted).
The changes can be enumerated as follows:
1) Conversion of the local access road that intersects the
collector road west of the recreation area in a 60 feet
R/W public road to extend it through Phase II up to
Lawrence Road to facilitate access to the public park
and the proposed Elementary School and as a secondary
access to Lawrence Road.
2) The above change results in the loss of one lot in the north
side of the collector road and two lots in the south side
of such collector.
3) Extend the local access road immediately east
of the recreation area through Phase II.
4) The above extension results in the loss of old Lot 129.

In the past, there have been occasions upon which developers have successfully
solicited government's participation in offsite development related roadway
construction. This has specifically been done in cases where developments,
which as a part of their zoning approval have been conditioned to perform the
construct i on of thoroughfare pl an roadways of a magnitude whose cost waul d
substantially exceed the impact fee.
Al so di scussed was the matter of impact fee credit for offsite thoroughfare
plan roadway construction as allowed for in the County Fair Share Ordinance.

Palm Beach County Traffic Division staff has reviewed traffic impact
analyses which you sent to us for the subject developments. The following
comments are submitted for your consideration:
1) Dedication of right-of-way should be required in accordance with the
County's Thoroughfare Right-of-Way Protection Map. Lawrence Road
requires an 80' right-of-way and Miner Road a 108' right-of-way.
2) Turn lanes on the internal collecter roadways and all main development
accesses should be required in accordance with the traffic studies you
sent us.
3) Since Miner Road is required for site access and traffic distribution,
the segment of Miner Road adjacent to the site should be constructed
by the developer as a two lane cross section in accordance with County
standards and over an alignment that will connect with the segment
committed to the east.
4) Payment of traffic impact fees should be requirpd in accordance with
Palm Beach County Ordinance #85-10.

Pursuant to our recent telephone discussions and prior
working session in your office, we have prepared this letter
to summarize our product recommendations for Intracoastal
Development, Inc. regarding citrus Grove.
Based upon our research and analysis regarding the above
subject, we recommend that the development of citrus Grove
include approximately 132 zero lot line units on 5,000 square
foot lots priced from $75,900 to $85,900 and approximately
118 single family attached (duplex) units priced from $69,900
to $77,900.
We will have our final written report with the financial
analyses which will summarize the findings, conclusions and
recommendations of this study to you within the next three
weeks.
