We currently use either N.W. 22nd
Avenue or Hypoluxo Road which
causes some delay in response time.
The Personnel and Purchasing staff-
ing would be directly impacted by
this annexation contingent upon
how many additional employees,
supplies, and equipment is needed
by the rest of the City. If we are
told the total numbers, we can pro-
vide a definite response.
The Utility Department is strictly
revenue supported. As such, anti-
cipated revenues will offset in-
creased outlay for salaries and
operation and maintenance
personnel. The developer will have
to pay all appropriate capital
facility charges and his fair share
of existing off-site utilities.

revision of approved documents which requires resubmittal for

The following comments pertain to the Master Landscape
Plan for the above projects:
1. The developer should provide a more accurate tree
survey in conjunction with the aerial photograph
which addresses:
a. All species and quantities of existing tree.
b. Which trees will remain, be transplanted,
removed and replaced.
c. Which trees will be availabie to the City of
Boynton Beach and/or the School Board of Palm
Beach County.
d. A comprehensive Tree Management Plan for the
tract.
2. The littoral zone pl~ntings around the lakes
should also address the following:
a. A littoral zone Management Plan document
detailing how to correctly manage this area.
b. A detail sketch of the littoral zone
plantings, showing how the materials will be
installed (species, locations, quantities).
This' should be for field inspection when lake
plantings are completed.
c. This document should be referenced in the
Homeowner Association documents and comments
made to this effect on the approved plat.
d. All TREES so designated in the landscape plan
must be 8' in height at time of planting.
e. The installation of the littoral zone
plantings should be completed as the
particular lakes in' question are complete and
graded.

After discussion with the City Attorney and Utility Director, the
conditions of approval requested in Mr. Gordon's letter were
modified as follows:
1. The project can go forward regardless of the ability of
the applicant or City to acquire the right-of-way
between this project and the Meadows PUD.
2. Only cash is acceptable for surity purposes regarding
the acquisition of the proposed right-of-way.
3. No credits against capital facilities fees are
recommended for costs associated with the proposed
acquisition of the right-of-way.
4. The project should be connected to the water system to
the east within 60 days of availability.
This information was discussed with Mr. Gordon on 7/15/87.

Clarification of Staff Comments
Dear Mr. Annunziato:
In accordance of our meeting on June 26, held in preparation of the
public hearing held before the City Commission on June 21, 1987, I
respectfully submit proposed language clarifying the comments issued
by Staff which have been imposed as conditions for any approval of the
applications pending on the projects referred to above.
With reference to the Lawrence Grove application, I wish to confirm
that modif ications to the proposed site plan establish a three-foot
landscape buffer along the collector road where double-frontage lots
exist, and that this modification was found acceptable to the Planning
Department and otherwise adequately responded to Mr. Jaeger's comment
in his memorandum dated June 16, 1987.
Comments issued in furtherance of the Lawrence Grove application by
John A. Guidry, Director of Utilities, called for approval of the
project being conditioned upon the developer providing the funds to
pay all expenses associated with acquisition of a future right-of-way
between Meadows Tract and Lawrence Groves. It also "recommended" that
construction of the project not commence until acquisition of the
right-of-way has been finalized.
During our meeting on June 26, I attempted to clarify the intent of
your Department and the developer with regard to such conditions, and
propose the following language incorporated into the Staff's comments
for the purpose of clarification:

nApproval should be conditioned upon developer providing
funding for the acquisition of right-of-way between the
"Meadows Tract- and -Lawrence Groves. by the City of Boynton
Beach. Developer may satisfy this condition of approval by
posting cash bond, letter of credit, or equivalent, in an
amount equal to funding for acquisition and miscellaneous
related costs. The amount of funds required shall be based
on the appraised value of property which is subject to the
right-of-way taking.n
"Developer may commence construction of the project,
notwithstanding acquisition by the City of the right-of-way
has not been finalized, providing the developer complete
utilities connections in accordance with the present site
plan and engineering plans submitted in furtherance of his
original application. Developer shall be obligated to
reconnect utility hook-ups to water lines established along
the subject right-of-way, upon notice by the City within
three (3) years from the date of the City's approval of
developer's application. The developer shall be entitled to
credits for the costs relative to acquisition and installation
of water lines to be constructed in such right-of-way.-
The final comment pertains to Staff's memo indicating that tree
management plans (for both projects) have not been submitted. I wish
to confirm that such plans have been revised and resubmitted (prior to
the Planning Commission hearing) in response to Mr. Hallahan's comments.
I respectfully request that, upon your review of the proposed
modifications set forth above, you contact the undersigned to provide
you rcomments and permit their finalization and incorporation into
Staff comments for further action.

1. City Code discourages double frontage lots. If these lots are
approved, there must be an adequate buffer provided, meeting all
Code requirements, between the lots and the collector road.
2. The recreation area will require a separate site plan review.
Consult Appendix A-Zoning, Section 11, H-16 e.12 of the Boynton
Beach Code of Ordinances for parking requirements.
3. Landscaping for all common areas must be reviewed and approved by
the Community Appearance Board. All common landscaped areas and
landscaped areas in the right-of-way must be fully sprinkled.
4. There is a small parcel of land at the northeast section of the
property, just north of the L-19 Canal, which is not contiguous to
the development. Indicate how the parcel will be treated when the
project is developed.
Notes:
1. Street names and building numbers must be reviewed by the Building,
Fire, and Police Departments as well as the Post Office.
2. Entry wall signs must be submitted for staff and City Commission

In reviewing the plans for the above listed developments, there is a concern that no
plans were made for sidewalks or bicycle paths. Since this type of construction will
likely draw a "young family" purchaser and a high density population, there is no
place for pedestrian and bicycle travel other than in the roadways. Since there is a
planned recreation area, I would recommend sidewalks in front of the units built or
bicycle paths leading to the recreation area in order to assure safe travel of
children.

l) Re-route the water main interconnects to the Miner Road and Lawrence
Road water mains to foll~w the entrance roads. Loop the mains in
the cul-de-sacs with appropriate valving.
2) Realign the sewer main leading to the lift station so as to avoid
a platted lot.
3) Extend various sewer mains to eliminate overly long services.
4) Provide a 6" sanitary service, with an easement, to the City's
ground storage tank.
5) Gravity sewers must be constructed in paved areas or roadway ease-
ments with an adequate set-back from platted lots.

The applicant for the above project should be aware of the following:
1. Must provide a tree management plan for all the existing citrus trees
on the property.
2. The citrus trees shown on the plan to be preserved appear not to meet
the intent of the new Boynton Beach Comprehensive Plan.
3. The applicant can meet with me to discuss these two issues at their
convenience.

RE: Annexation Requests; Lawrence Groves & Citrus Glen
Upon review of the subject properties consideration should be given
to providing a neighborhood park which will service/these developments
as well as other residential areas currently developed or to be developed
in the immediate vicinity.
As the School Board is considering purchase of an 18 acre site
between these developments and a 26 acre undeveloped parcel is adjacent
to the school site, an opportunity exists to acquire a portion of the 26
acre site, and with the cooperation of the School Board, develop a
school/park complex.
Acquisition and development funding for such a project would come
from the Land Dedication Trust Fund. The subject developments will be
required to provide fees in lieu of land per our subdivision regulations
which would be applied to these costs. Operation and maintenance costs
for the new park site would be funded from the general fund and would
add to the Park Divisiorrs budget requirements. Exact annual costs will
depend upon final size and design and use of the site.
The development of school/park sites is consistent with our
comprehensive plan recommendations and goals.
