Dear Mr. Moore:
We have reviewed the letter that you forwarded to the City
regarding the permits for two story homes at Citrus Glen.
Appendix B Planned Unit Developments, Section 1, Intent and
Purpose states that intent of the district is to
promote...appropriate and harmonious variety in physical
development.
When the master plan for Citrus Glen was approved it was with a
plan for a single story structure. In addition, all the
construction that has taken place to date has been single story
homes.
In our eyes the change that has been requested by the developers
of Citrus Glen would affect the harmonious physical development
of the site; and therefore, we consider this to be a minor
change. Per the code this change would require City Commission
concurrence and Planning and Development Board approval which
will take 35 to 45 days to process.
We have turned your letter over to the City Attorney for his
review and opinion. As soon as he responds we will inform you of
our final determination on this matter.

The purpose of this meeting was to give one final opportunity for the
School Board and the property owners to the north of Site "P," (the
Sturrocks) to come to an understanding and agreement on a joint aceess
road to be located on the N.E. corner of Site "P."
As a starting ,point; Engineer Doug O'Laughlin presented his cost take offs
on the north access drive to the school site, as shown on the construction
drawings and then the proposed joint use road cost estimates. The joint
use road take offs were based on a design and cross section provided by
Mr. Rossi. Mr. O'Laughlin reported that the school driveway construction
is estimated to cost $12,000. The joint use road construction, of a length
sufficient to initially serve the school, is estimated to cost $28,000.
It was stated that the School Board felt that the County Traffic
Engineering Department was willing to work with the School Board and
allow the skewing of Lawrence Road to the east. The School Board's
primary reason for considering this position was to minimize off-site
expenditures. It was also stated that when properties on the west side of
Lawrence Road begin zoning and development activities, the county would
request the petitioner and the School Board to reconstruct Lawrence Road
to its original alignment.
The School Board informed the attendants that in all probability we would
not recover 100% of the estimated cost for the north access drive as shown
on the construction plans. However, the School Board would be willing to
commit the funds recovered from this access drive and appropriate them to
the cost of the joint access drive.
After a lengthy discussion on the merits and minuses gained and lost by
each party, a conclusion was reached where the Joint use road would be
constructed in place of the north access drive of Site "P."
The following points of agreement were reached and agreed upon by those
in attendance. The entire agreement is contingent upon the approval of the
School Board. The following is a packaged deal of multiple conveyances
and related cost. ,..

1. The Sturrocks will provide a survey and legal description of the 60
foot wide joint use road as shown on the attached Exhibit 1, to be
dedicated to the City of Boynton Beach as public road right-of-way.
2. The School Board will provide a legal description and survey of a 20
foot wide strip of land, adjacent and parallel to the 60 feet provided
by the Sturrocks. This strip of land will also be dedicated by the
School Board to City of Boynton Beach as public road right-of-way.
3. School Board will provide a 12 foot wide easement for drainage
purposes to the Sturrocks as shown on Exhibit 2, located in the
eastern area of Site "P" in a north-south direction.
4. The Sturrocks are to provide an additional 7 feet on the west right-
of-way of Lawrence Road, (to provide for the ultimate road cross
section 40 feet from centerline) for a distance as required by
traffic roadway improvement plans Exhibit 3 (tapers and by-pass
lanes, etc.). This 7 foot wide dedication will be from the
Sturrocks to Palm Beach County for public road right-of-way.
5. The Sturrocks will dedicate a 20 foot wide utilities easement, to be
located west of the west right-of way line of Lawrence Road. This
20 foot dedication will be for utilities and will be from the
Sturrocks to the City of Boynton Beach for a length sufficient to
provide sewer service to School Site "P." (See Exhibit 3)
6. The Sturrocks will contribute $20,000 to the School Board, towards
the difference of the north access drive and the joint use road
construction.
7. The target completion date for these conveyances to occur is within
30 days of this meeting date.
The above cited agreement statements are conditioned upon the School
Board Legal Department and the Sturrocks' attorneys working cooperatively
on an agreement specifying the above.

Council staff has completed its review of the proposed
amendments to the Future Land Use Element of the city
Comprehensive Plan in accordance with the requirements of the
Local Government Comprehensive Planning and Land Development
Regulation Act, Section 163.3184(1) (c) and (2), Florida
Statutes, and has prepared comments for Council consideration.
These comments will be presented to Council at its next regular
meeting on September 16, 1988. You are invited to attend the
meeting and address the Council if you wish. Enclosed are
staff's recommended comments and the agenda for the meeting.
Following the meeting, the comments as finally approved by
Council will be forwarded to the State Department of Community
Affairs for transmittal to your governing body for
consideration before final adoption of the documents.

related to Comprehensive Plan Amendments for the City of Boynton
Beach. These plan amendments were considered by the Planning and
Zoning Board, sitting as the Local Planning Agency, and also by
the City Commission, at public hearings which were held after due
public notice. The City Commission of Boynton Beach has approved
the transmittal of these plan amendments to the Department of
Community Affairs. The three (3) plan amendments enclosed are

the respective staff reports. Also included is a location
map within each agenda packet. The Notice of Public Hearing
for each application also includes a location map and
provides a description of each request, including the total
acreage of the property.
3. A description of the surrounding land uses for each request
can be found in the section of the staff report entitled
"Current Land Use and Zoning" and in the correspondence from
the Palm Beach County Planning Department which can be found
within the exhibits for each staff report.
4. A description of the availability of pUblic facilities is
shown on the plans and comments concerning utility service
are contained within the staff comments.
5. A discussion of the compatibility of the proposed land use
amendment with the land use element objective and policies,
and with those of other affected elements is contained within
the staff report. In addition, you will find one blueprint
copy and ten (10) photocopies of the Future Land Use Element.

within the exhibits of each staff report and is also shown on
the Notice of Public Hearing for each project.

soil tests, as may be in Purchaser's possession, relating to
development of the subject Property upon termination of this
Agreement due to the failure of satisfying conditions
precedent to Purchaser's obligation for closing of title."

In furtherance of our recent meeting with the directors of the Planning,
and Recreation and Park Departments concerning the above referenced
matter, I have been instructed to provide you a proposal setting forth
the conditions under which the applicants would transfer to the City a
five + or - acre parcel adjoining the proposed school and park complex
to be constructed adjacent to the Citrus Park development.
1. There currently exists an approval for the Citrus Glen P.U.D.,
issued by the Ci ty of Boynton Beach, for 229 uni ts (or iginally
approved'or 233 units prior to modification). The approvals under
consideration for modification of the current master plan for the
Citrus Glen P.U.D., calling for reduction from 229 units to 197 units
would be conditioned upon the owner/developer agreeing to pay all
park and recreational fees due for the units represented in the
plat, at the time of its filing.
2. The applicants, Intracoastal Development, Inc., under petitions
for annexation, amendment to the Comprehensive Land Use Plan, and
rezoning to a P.U.D. referenced as "Citrus Park" would enter into
such agreements as are required by the City, requiring the applicant
to place, in escrow, a deed to the City of Boynton Beach, conveying
a five-acre parcel designated within the proposed Citrus Park
Master Plan, all at the time of the applicant's closing of title
to the entire parcel comprising the Citrus Park P.U.D. The terms

City's approvals of applicant's petition for Citrus Park in
sUbstantially the form requested by the applicants. At the time
of the deed's release from escrow, the appropriate credits
(representing the equivalent dollar value established for the
five-acre parcel conveyed) would be applied to those fees assessed
to the Citrus Glen and Citrus Park units approved under each
respective P.U.D. All sums pre-collected upon the filing of the
first plat in Citrus Glen would be refunded to Intracoastal
Development, Inc., or at their direction.

SUBJECT: CITRUS GLEN PHASE II/ADDITION ELEMENTARY SCHOOL "P"/LAWRENCE LAKE
Dear Mr. Annunziato:
As requested, the Palm Beach County Traffic Division staff has reviewed the
plans and traffic impact analyses for the above mentioned developments. The
following comments are provided for your consideration:
1. If Citrus Glen Phase II and Lawrence Lake were being reviewed under
the County's new Traffic Performance Standards (County Ordinance 87-18),
the 4-lane widening of Hypoluxo Road between Congress Avenue and 1-95
would be required to be under construction before ~ building permits
could be pulled. Also, the amount of background traffic growth to be
considered during the "5-7 year buildout" of these projects would be
far greater in most cases under the new Ordinance.
2. The County anticipates adopting in the near future a lID' cross-section
to replace the old 108' cross-section included in its Thoroughfare
Right-Of-Way Protection Map. The plat for Citrus Glen should, there-
fore, show a lID' right-of-way corridor for Miner Road.
3. There appears to be an under-assignment of peak hour trips to the
southern access to Ci trus Gl en Phase II from Lawrence Road. Gi ven the
50%/50% distribution of trips to north/south Lawrence Road, and the
locations of the two Lawrence Road accesses with respect to the 106
units in Citrus Glen Phase II, it is likely that sufficient traffic
would use the south access in the peak hours to warrant separate
westbound 1 eft and ri ght turn egress 1 anes onto Lawrence Road without
schdbl traffic included. It is also possible that sufficient southbound
left turn traffic on Lawrence Road would exist during the PM peak hour
at the southern access to Citrus Gl en Phase II to warrant a separate
turn lane.

Lake Annexations.
Mr. Annunziato,
The County Planning Staff has reviewed the City of Boynton
Beaches' land use plan and zoning proposals for the 3 parcels
currently being considered for annexation into the City. Our
Staff research indicates that the current County land use plan
category for all 3 parcels is Medium to Medium High (M-MH) with a
zoning designation of Agricultural Residential (AR).
The existing AR zoning designation is designed to encourage the
development of agricultural uses. It will allow residential
development at a maximum of 1 dwelling (d.u.) unit per 5 acres,
as well as various low-intensity utility and institutional uses.
Please note, however, that the maximum allowable zoning under the
M-MH land use plan category is Residential Medium (RM). The RM
zoning designation will permit residential development at
densities up to 16 d.u.'s per acre in a Planned Unit Development
utilizing Transfer of Development Rights. In order to utilize
the higher densities in the County the project must meet the
requirements of the County Performance Standards for Major
Thoroughfares, Traffic, Water, Sewer, Environmental, Flood,
Drainage, Schools, Recreation, Fire Protection, Market Analysis,
and Aircraft Noise where applicable.
The proposed densities of the Citrus Glen (Phase II) and the
Lawrence Lake projects are 3.68 and 2.44 d.u.'s per acre
respectively. These densities are significantly lower than the
county's maximum density of 16 d.u.'s per acre for this area,
thus the proposed projects are consistent with the County's
Comprehensive Plan M-MH density allowance.
Staff also finds that the proposed annexation projects are
generally compatible with surrounding development, which is
composed of the following:

plan consistency the Planning Staxx has no objection to the
proposed annexations.
Please be aware that all annexations must meet the requirements
outlined in Chapters 171 and 163 F.S.
There is some concern that the conxiguration ox this annexation
may not meet the requirements xor "compactness" as dexined in
Chapter 171.031. (12). This paragraph precludes any annexation
which creates "enclaves, pockets, or xinger areas in serpentine
patterns. "
As a xurther point ox inxormation, I have attached a letter xrom
Thomas Pelham, Department ox Community Axxairs, outlining his
interpretation ox sections oX Chapter 163, Part II, F.S. As you
recall xrom our conversation oX November 11, we concur with Mr.
Pelham's opinion (page 3, paragraph 2) that a city may not rezone
or amend the comprehensive plan designation for an annexed parcel
until such time as the annexation is xinal. Because there is a
30 day appeal period xollowing the adoption ox an annexation
ordinance the annexation is not considered xinal until the appeal
period has passed without the institution ox an appeal. Thus a
City may not begin the rezoning or plan amendment process until
30 days after the xinal adoption hearing.
Also note that the County land use and zoning regulations remain
in exfect during the 30 day appeal period, and until such time as
the subsequent City rezoning and land use plan changes are
complete.

the above referenced projects. Citrus Glen phase II addition
represents an expansion of a previous annexation/land use
amendment request which was reviewed by your office in April,
1987 (see copy of previous correspondence).
The School Board property abuts Citrus Glen phase II on the south
side. Please note that the developer of Citrus Glen and the
School Board are proposing to share a common access road along
their common property boundaries, based on recommendations from
our Department. Lawrence Lake is a proposed PUD which lies south
of the School Board property across the L.W.D.D. L-21 canal. The
traffic impact for Lawrence Lake is included in the traffic
report for Citrus Glen Phase II, as this project did not exceed
the threshold for an independent traffic study.

RE: Three Proposed Land Use Amendments - City of Boynton Beach
In accordance with the provisions of Chapter 163 F.S, and Chapter
9J-l1 FAC Interim Review Requirements, the comments of the FDOT to the
proposed c~ty of Boynton Beach Land Use Amendments are as follows.
1. The streets directly affected, Lawrence Road and Miner
Road, are not on the state system though they are
functionally classified as County Urban Collectors.
2. There is an indication, based upon the amount and pace of
development in this area of Palm Beach County, that Lawrence
Road located midway between Congress Avenue (SR-807) and
Military Trail (SR-809) between the east-west arterials of
Boynton Beach Boulevard (SR-804) and Lantana Road (SR-812)
will become much more than a residential collector street.
The Department questions the adequacy of an 80 foot
right-of-way on Lawrence as indicated on the Palm Beach
County Thoroughfare Right-of-Way Protection Map. However,
as indicated, these proposed developments' fair share of the
rights-of-way for Lawrence and Miner Roads as shown on the
Palm Beach County "Thoroughfare Rights-of-way Protection
Plan" should be acquired prior to or upon review of any
subsequent applications for development approval beyond land
use amendment.
3. We share the concern of the Palm Beach County Traffic
Division about safe access to these sites from Lawrence
Road. This access in relation to the proposed Elementary
School may warrant signalization. We recommend this be
discussed with the Palm Beach County Traffic Division prior
to the review of any subsequent applications for development
permit.
4. The Department recommends consideration by the City of
phasing of developments generating substantial volumes of
traffic in accordance with the capacity of adjoining streets
and thoroughfares which would be a requirement subsequent to
adoption of comprehensive plans under the 1985/86 Growth
Management Legislation.
