Introduction
Pursuant to the provisions of the Local Government
Comprehensi ve Planning and Land Development Regulation Act,
Chapter 163, Florida Statutes, the Council must be provided an
opportunity to review and comment on comprehensive plan
amendments prior to their adoption. The city of Boynton Beach
has submitted proposed amendments to the State Department of
Communi ty Affairs, which in turn is seeking Council's
comments.
Council's review of the information forwarded by the
Department of community Affairs is in the context of the
relationship of the proposed amendments to the regional policy
plan developed pursuant to Section 186.507, Florida Statutes.
If a conflict with adopted plans or policies is identified,
the regional planning agency is to specify any objections and
may make recommendations for modifications. Council also
provides informal comments to the local government through a
spirit of cooperation, and technical assistance on matters
related to the proposed amendments. These advisory comments
are aimed at providing coordination between the local and
regional comprehensive plans.
Backqround
The City of Boynton Beach is considering three amendments to
the Future Land Use Element. The locations of the properties
under consideration are shown on the accompanying map, and the
number of acres and proposed changes in land use designations
are summarized in the following list:

The proposed amendments are for contiguous parcels
immediately east of Lawrence Road north and south of
LWDD Canal 21. The parcels were recently annexed
from Palm Beach County. Even prior to annexation,
they were included on the City's Future Land Use
Plan.
When the Site Plan for the Elementary School is
prepared, it should include the preservation of many
of the trees and other vegetation types which occur
on this parcel. The materials submitted with this
amendment indicate that the City fully intends to
recommend preservation and incorporation of trees in
the park areas which are to be developed on this and
the Citrus Glen parcel.
Based on the information provided, the proposed
amendments do not appear to be in conflict or
inconsistent with the policies contained in the
Regional Comprehensive Policy Plan.
Recommendation
Council should adopt the comments outlined above and
their transmittal to the State Department of Community
in fulfillment of the requirements of Chapter 163,
statutes.

Dear Mr. Hook:
The Palm Beach County Planning Division has reviewed the above
referenced amendment requests and has the fOllowing comments.
1. The three sites are located within the Medium - Medium High
Land Use Category and are zoned Agricultural Residential
(AR). Generally, the maximum density which may be permitted
in this land use category in 12 dwellings per acre.
2. The proposed density of the Citrus Glen Phase II (3.68
dwellings per acre) and Lawrence Lake (2.44 dwellings per
acre) projects are well within the maximum permitted density
of 12 dwellings per acre in the Medium - Medium High Land
Use Category.
3. There is some concern that the configuration of the annexa-
tions may not meet the requirements for .compactness" as
defined in Chapter 171.031.(12). This paragraph precludes
any annexation which created "enclaves, pockets, or finger
areas in serpentine patterns."
4. The three proposed developments have been reviewed for
consistency with the County's traffic policies and goals, no
significant problems were identified. The County's comments
have been forwarded to the City of Boynton Beach for their
consideration.

RE:
Delf in F. Menendez, agent for Citrus Glen Limited Partnership,
has requested a modification to the previously approved master
plan for the Citrus Glen P.U.D., as outlined in the attached
letter of submittal. The modification requested is for a change
in the street layout and design in the southern portion of the
P.U.D. to eliminate the local (public) street connection to
Citrus Park. This road, as shown on the approved master plan
(see Exhibit "A"), was to provide public access to the public
park in Citrus Park, recently approved by the City Commission for
deletion from the Citrus Park master plan (see Exhibit "B").
This road was also to provide an alternate means of access to
Elementary School "P" and Lawrence Road. However, with the
recently approved Citrus Park rezoning, the master plan for
Citrus Park was revised in the area adjacent to the southern
portion of the Citrus Glen. P.U.D. to include replacement of the
street connection to Citrus Glen with additional lots and a 20
foot right-of-way (see Exhibit "B"). Therefore, the local street
connection is no longer needed to serve either purpose.
The agent's objective in this request and the accompanying
abandonment applications for the two public roads (Citrus Avenue
and Citrus Glen Drive) is to isolate and restrict public access
to the planned unit development and be able to seek approval of a
site plan modification to construct a private security system for
the entire P.U.D. (see Exhibit "C" for a copy of the proposed
site plan). The right-of-way abandonment and site plan
modification requests are tentatively scheduled for simultaneous
City Commission review with this master plan modification subject
to the Planning and Zoning Board's review and recommendation of
the abandonments and site plan modification at their September
12, 1989 meeting.
The procedure for approving master plan modifications in planned
unit developments is twofold. First, the City Commission must
make a determination as to whether or not the changes requested
are substantial in nature. A determination of substantial change
on the part of the City Commission, which has sole discretion in
this matter, would require a new application for P.U.D. On the

other hand, a determination of no substantial change allows the
forwarding of the request to the Planning and Zoning Board. The
Planning and Zoning Board then may approve the request. This
procedure appears in Appendix B, Section 12 of the Code of
Ordinances.
with respect to the change requested by Mr. Menendez, the
Technical Review Board (TRB) met on Tuesday, September 5, 1989 to
review the plans and documents submitted, and they offer for your
consideration, a recommendation that the City Commission make a
finding of no substantial change for the requested modification,
and that the Planning and Zoning Board approve this request as
submitted.

Dear Mr. Annunziato:
At the request of Felix Granados Jr., General Partner, Citrus
Glen Limited Partnership, Boynton Beach, Florida, we are submitting
to the consideration of the city of Boynton Beach revisions to the
Master Development Plan of the Communities of Citrus Glen P.U.D.,
(Executive Estates and Citrus Trail), under construction.
These revisions are submitted to extend the security system
previously approved for Executive Estates to the entire development.
It was recognized by the City Staff, the Developer and ourselves
during such approval process that the existing public road system,
especially the 601 RjW road that connects Citrus Glen with the
abutting property to the south, makes inefficient, incomplete and
impractical a security system for Citrus Trail.
As the City may recognize, Florida is the first State in the Nation
in criminal activities. This makes the security issue a very im-
portant fact to consider when people are deciding where to buy,
especially when it reaches the level of investment necessary to
purchase the products offered by this development.
Unfortunately, the connection through Citrus Avenue to the proposed
community park and to the school in the property to the south, a
product of a larger development plan, agreed by the city and the
former Developer, is seen and perceived negatively and could affect
even more the marketing of Citrus Trail.

Therefore, we are requesting the following changes:
1) Loop Citrus Avenue with Orange Drive to eliminate access
to the south. The number of lots are not affected. Water
and sewer mains are not affected either.
2) The construction of a guard house at Citrus Glen Drive at
the entrance from Lawrence Road with security barriers and
additional security barriers at the entrance from Miner Road.
Details of the revised security system are indicated in the
Site Plan Approval Application submitted with this Master Plan
modification request.
3) Make all roads within the communities of Citrus Glen private.
A petition requesting the abandonment of Citrus Glen Drive
and Citrus Avenue has been previously submitted.
