NATURE OF REQUEST
Jean-Philippe Gaudree, agent for Ronnard, Inc and Marc Perron, is requesting
abandonment of a special purpose easement in conjunction with an expansion of the
Benvenuto Restaurant. The attached Exhibit "A" shows the location of property. The
attached Exhibit "B" contains a sketch of the proposed abandonment area.
BACKGROUND
On March 10, 1998, the Planning and Development Board and on April 7,1998, the
City Commission approved a major site plan modification for Benvenuto Restaurant.
The site is currently developed as a 9,600 square feet restaurant with related parking
facilities and scattered, mature tropical vegetation in a garden setting. As a part of the
planned expansion of the existing restaurant, an unused special purpose easement
was identified that ran under the proposed addition. To ensure that there would be no
claim to this easement in the future, a request for abandonment is required.
ANAL YSIS
The city departments involved in the review of all requests for abandonment and the
utility companies notified of the request are identified below. Public notice was given to
the property owner that abuts the alley and has been advertised in the newspaper. The
utility companies (see "Exhibit "C") and the city departments' responses to the
abandonment request are as follows:

Lake Street right-of-way, and farther north is a strip shopping
center, zoned C-3.

Vacant lot, zoned C-3.
East
Via Lago town homes, zoned R-3.
West
US 1 (Federal Highway) right-of-way, and farther west is a
marine craft retail and maintenance facility, zoned R-3.
RECOMMENDATION
Staff recommends approval of this abandonment request as submitted (see Exhibit "0"
- Conditions of Approval).

under the corporate name. The second is under a personal name. A new survey brought in by

UTILITY EASEMENT
Engineering has no objection to the subject abandonment, however there are several conditions
that should be addressed:
1. The 1973 recorded easement grant does not accurately locate the subject easement
because of its' reference to a 1921 plat (W.S. Shepard's Subdivision), a reference to a lot
16 (but no block), nor which lot 16 (there are two) etc. Furthermore, the recorded
easement is 526' in length and runs through property outside the subject site.
2. While it can be assumed the 10' easement in question is the one closest to the proposed
addition, there is another parallel easement shown on the permit plans 35' east of the
subject easement, which clouds the issue further.
The applicant should be required to provide a new accurate survey depicting the correct
easement for recordation purposes. Finally, if the applicant does not yet own the additional land
(lot 19) for development, the other parcel owner should be included in the request.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning and Development Board and City Commission
of the CITY OF BOYNTON BEACH, FLORIDA, will conduct PUBLIC HEARINGS at CITY
HALL COMMISSION CHAMBERS, 100 E. Boynton Beach Boulevard, Boynton Beach, Florida,
on Tuesday, April 28, 1998 and on Tuesday, May 5, 1998, respectively, at 7:00 p.m. to consider
a special purpose easement abandonment application submitted by Jean Philippe Gaudree,
agent for Benvenuto Restaurant, located at 1730 North Federal Highway, in connection with an
expansion of the restaurant. Said easement is more particularly described as follows:

A 10 foot strip of land whose center line is commencing at a\ point on the North
property line of Lot 16,at a distance of 160.90 feet east of the U.S. Highway No.
1 east right-of-way line. Said point also being 481.59 feet west of the southerly
extended center line of Palm Way, originally a publicly dedicrted roadway
established on the plat of.W. S. SHEPARD'S SUBDIVISION of Lots 13-14-15 of
SAM BROWN Jr.'s SUBDIVISION, Book 8, Page 8 relocated to present location
as described in Deed Record Book 875, Page 535. Said Plat and Deed thereof
on file in the office of the Clerk of the Circuit coua'n for Palm Beach
County, Florida. Said 10 foot strip of land extends i an s JffierfyC!tre"Ction a
distance of 525.76 feet to a point on the south prope . f Lot 18 a distance
of 230.90 feet east of U.S. Highway NO.1 east right-of-way line.

Accompanying this memorandum you will find one (1) copy of the application and related
documents for the above-referenced abandonment application. The $500.00 application fee for
staff processing and review has been forwarded to the Finance Department.
A legal advertisement for same has been prepared for the April 28, 1998 Planning and
Development Board meeting and the May 5, 1998 Commission meeting and will be forwarded
to your office after review by the City Attorney. In order for our department to meet the
deadline for preparing Planning and Development Board agenda materials for this request,
comments from staff and the various concerned parties must be received by our office by April
17, 1998.
Please inform staff of this time frame when distributing copies of this request for comment. If

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning and Development Board and City Commission
of the CITY OF BOYNTON BEACH, FLORIDA, will conduct PUBLIC HEARINGS at CITY
HALL COMMISSION CHAMBERS, 100 E. Boynton Beach Boulevard, Boynton Beach, Florida,
on Tuesday, April 28, 1998 and on Tuesday, May 5, 1998, respectively, at 7:00 p.m. to consider
a special purpose easement abandonment application submitted by Jean Philippe Gaudree,
agent for Benvenuto Restaurant, located at 1730 North Federal Highway, in connection with an
expansion of the restaurant. Said easement is more particularly described as follows:
A 10 foot strip of land whose center line is commencing at a point on the North
property line of Lot 16 at a distance of 160.90 feet east of the U.S. Highway No.
1 east right-of-way line. Said point also being 481.59 feet west of the southerly
extended center line of Palm Way, originally a publicly dedicated roadway
established on the plat of W. S. SHEPARD'S SUBDIVISION of Lots 13-14-15 of
SAM BROWN Jr. 's SUBDIVISION, Book 8, Page 8 relocated to present location
as described in Deed Record Book 875, Page 535. Said Plat and Deed thereof
on file in the office of the Clerk of the Circuit Court in and for Palm Beach
County, Florida. Said 10 foot strip of land extends in an southerly direction a
distance of 525.76 feet to a point on the south property line of Lot 18 a distance
of 230.90 feet east of U.S. Highway NO.1 east right-of-way line.
All interested parties are notified to appear at said hearings in person or by attorney and be
heard. Any person who decides to appeal any decision of the Planning and Development
Board or City Commission with respect to any matter considered at these meetings will need a
record of the proceedings and for such purpose may need to ensure that a verbatim record of
the proceedings is made, which record includes the testimony and evidence upon which the
appeal is to be based.
