Further review of Federal Highway entrance features
At the March 17, 1998 Planning and Development Board meeting, the Board requested
that the applicant for Benvenuto Restaurant (see Exhibit "A" for location map) to come back
before the Board after he completed designing the Federal Highway gated entrances.
These elevations were not available when the site plan modification was presented at the
March 17th meeting. The applicant has now completed those drawings (see Exhibit "B").
There have been changes, however, to the original site plan (see Exhibit "C" for
comparison purposes). The changes are summarized as follows:
PREVIOUS PLAN
A. There is a separate existing driveway to the Federal Highway service area at the
southern end of the building.
B. The site plan shows pillars/gates at both Federal Highway entrances. The
landscape plan shows the entry sign to the north of the north entry drive. The
landscape plan and drainage plan show two 4' x 4' X 10' pillars and a 12'-14' entry
sign wall added to the north side of the proposed two-way entry at the north end of
the building at Federal Highway.
LATEST PROPOSED ENTRY PLAN AND SIGNAGE PLAN
A. To address a March 1998 condition of approval, the southern driveway is moved
100' south to an existing curb cut that lines up with the proposed one-way parking
lot drive aisle along the southern property line. The existing service drive is
removed and a right-of-way buffer and parking spaces replace it.

B. The proposed entry wall and sign to the north of the northern driveway is removed,
but the two 4' x 4' x 10' pillars remain as shown on the site plan. The existing wall
will be repainted to match the building and a hedge will replace the area that was
originally proposed for a wall and the existing service drive that is to be closed.
Gates are no longer proposed.
C. Two more 4' x 4' x 10' pillars are added to the southern entry drive to match the
northern drive and will also be painted the same color as the wall.
RECOMMENDA TION
Staff recommends approval of the new columned entrances, subject to the attached
comments in Exhibit "D".

District staff has g~ven a cursory review of the information
submitted on April 30, 1998 for the above referenced project.
Based on the information submitted, it appears that the proposed
expansion project would qualify as a "No Notice General Permit" if
the conditions of Rule 40E-400.316, Florida Administrative Code
(FAC) , are met. Any off-site impacts, changes in land use, or
future modifications to the activities may require review by the
District.
This does not relieve you of the responsibility of obtaining all
necessary Federal, State, Local or special District authorizations
prior to the start of any construction.

I have been advised that Benvenuto's Restaurant has asked about their
requirements for a fire alarm system. NFPA 101, Life Safety Code, is very clear
in the requirement for a full alarm system in a Class B assembly.
It is not the function of the Fire and Life Safety Office to make every comment on
every plan. I expect the architect/contractor to take responsibility for the
standard requirements.

We offer the following comments on this project:
GENERAL COMMENTS
1) In general, palm trees will be the only tree species allowed within utilities easements. Canopy trees
may be planted outside of the easement so that roots and branches will not impact those utilities
within the easement in the foreseeable future. LDR Sec. 7.5-18.1 gives public utilities the authority
to remove any trees that interfere with utility services, either in utility easements or public rights-
of-way. The revised site plan indicates Live Oak trees within existing and proposed easements.
This is not acceptable
2) Dept. of HRS permits will be required for the water system extension serving this project. (Sec.
26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal.
4) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements. Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in
Sec. 26-33(a) of the Code.
2) LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet
of an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants.
3) Appropriate backflow preventers will be required on the domestic water service to the building,
and the fire sprinkler line if there is one, in accordance with Sec. 26-207.
4) Part of the proposed building is shown to be encroaching into an existing easement. Although this
easement is not believed to contain water or sewer lines, this encroachment should be addressed by
either changing the building footprint, or abandoning the easement.

We have reviewed the subject plans and recommend that the request be forwarded for Board
review with the understanding that all remaining comments will be shown in compliance on the
permit drawings:

I. On the Site Plan and Drainage Plan label the location of the required accessible route that
leads to the accessible entrance of the building from the sidewalk shown along U.S. No. I
and the accessible parking spaces. Also identify the slope proposed for both routes. The
location, width, slope and surface finish shall comply with the regulations specified in the
accessibility code. [Florida Accessibility Code for Building Construction, Section 4.3,
Accessible Route]
2. Show and label on the floor plan drawing the accessible route that is shown on the site plan.

3. It is recommended that the sidewalk proposed for the accessible route between the accessible
parking spaces and the building entrance be extended in a southerly direction along the front
of the accessible spaces. The new sidewalk would connect to the west end ofthe southern

4. On the proposed site plan, landscape plan and drainage plans identify the location of the
proposed site sign. Also specify on the site plan no less than a ten (I 0) foot setback from the

5. It is recommended that the site sign shown on the site plan be reviewed and approved
administratively by staff through the permit process.

I. Stop signs and stop bars are needed at all onsite intersections. Also, "One Way" signs need

The following shall be addressed on the site plan:
1. Entrance and exit gate operations (see attached City standard).
2. Provide 45' to 50' turning radii (see attached specifications).
3. Porte-cochere shall have a minimum of 13'6" clearance from grade (D.O.T.).
4. Entrance throat shall be wide enough to accommodate a large turning vehicle.
5. The site shall accommodate the drive through of a large truck and/or a cul-de-sac
of 100' or a T turn around.
6. Strongly recommend that valet parking be connected through employee/service
parking area to an exit only egress to Federal Highway.
7. Fire hydrants to conform to development requirements (i.e., no portion of any
building shall be over 200' from a fire hydrant and/or provide automatic fire
sprinklers and apply for fire hydrant relief through the Fire Marshal).
8. Provide four (4) 20' X 50' locations not over 35' from the building for the purpose of
aerial operations.

The following is a list of 1 st review comments regarding the site plan review of the plans
for the above-referenced project. The applicant shall understand that all documents
and plans submitted for site plan review are subject to additional comments. I
recommend that the applicant/agent contact me regarding questions related to the
comments. If the applicant is not intending to correct code deficiencies, he should
contact me regarding the procedures, application forms, fees and submittal deadline
dates for seeking relief from the code requirement.
1. Any roof top equipment will have to be screened from view at a distance of 600 feet.
If such equipment is planned, indicate its location and the height of the equipment
above the roof level. Provide elevations of the structure showing the roof top
equipment and the required screening (all reduced to a small scale) and draw in on
these elevations the lines-of-sight connecting the highest point of the equipment
with the eye level from a distance of 600 hundred feet from the building (LDR,
Chapter 9, Section 11.E). If necessary, provide architectural details of screening
structures.
2. On both site plan and the master plan, indicate the location of the dumpster
enclosure. If a new or additional enclosure is being proposed, provide its detailed
drawings meeting the design standards as described in LDR, Chapter 9, Section
10.C.
3. Submit traffic study (or traffic statement) for the proposed use. The study shall be
evaluated by the Palm Beach County Traffic Division prior to the City Commission
meeting.

4. Show all existing and proposed easements on both site plan and landscape plan.
5. Provide a clause on the survey stating that the property was abstracted for right-of-
ways and easements.
6. Provide a unity of title for both lots and parcels comprising the site.
7. All native species shall be distinguished from non-native species with a
recognizable symbol. Note, that the native requirement is fifty percent of the
required landscape planting (Comprehensive Plan Policy 4.4.6).
8. Label all required landscape material with a botanical and common name.
9. On the elevation drawings depict color name, color code and manufacturer's name
of all exterior building materials or finishes.
10. With the second submittal, include a presentation board containing samples of all
exterior building materials to be used for construction and colored elevations of all
structures.
11. With the second submittal, include a presentation board containing color elevations
of the building
12. On the site plan depict all setbacks, and their distances from the property lines, as
required by Land Development Regulations, Chapter 4, Section 7.B.2.
13. On the elevations of all buildings and structures denote the height of structures
(ridge of the roof).
14. On the 2nd submittal site plan amend the tabular summary for the project to include
all project characteristics specified in Chapter 4, Section 7.E.
15. Provide dimensions of a typical parking stall for both perpendicular and parallel
configurations in compliance with the City's design standards.
16. Increase the parking lots back-up space at all locations to the minimum of 27 feet.
17. Land Development Regulations, Chapter 4, Section 7.8.2 requires that signage
information consistent with Chapter 9 - Community Design Plan, Section 10. I. and
Chapter 21 - Sign Code, Article IV, Section 7 is provided at the time of site plan

90013, i.e. back up distance for 900 parking is 27 ft.; parallel spaces shall be 9 ft. x 25 ft.
3. Remove all 900 parking spaces having a backup dimension ofless than 24 ft. or re-design
subject areas to conform to minimum requirements.
4. Correct the landscaping plan to agree with the handicap parking area shown on the site and
drainage plans.
5. Provide an acceptable site lighting for the entire parking lot. [LOR chapter 23, Article I,

6. Show 4 ft. sidewalk along Lake Strcet. [LDR Chapter 4, Section 7.B.2.]
7. Provide proof of ownership for lot # 18.
8. All plans submitted for specific permits shall meet the City's code requirements at time of
application. These permits include, but arc not limited to the following: site lighting, paving,
drainage, curbing, landscaping, irrigation and traffic control devices. Permits required from
agencies such as FDOT, PBC, SFWMD, DERM, LWDD, DEP and any other permitting
agency should be included with your permit request.
9. On the drainage plan, show proposed elevations and proposed drainage structures and

We offer the following comments on this project:
GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utilities easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Dept. of HRS permits may be required for the water system extension serving this project. (Sec.
26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal.
4) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may, therefore,
not be used for irrigation where other sources are readily available.
5) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements. Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in
Sec. 26-33(a) of the Code.
2) LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet
of an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrant.
3) Appropriate backflow preventers will be required on the domestic water service to the building,
and the fire sprinkler line if there is one, in accordance with Sec. 26-207.

7. Fire hydrants to conform to development requirements (i.e., no portion of any
building shall be over 200' from a fire hydrant and/or provide automatic fire
sprinklers and apply for fire hydrant relief through the Fire Marshal).
8. Provide four (4) 20' x 50' locations not over 35' from the building for the purpose of
aerial operations.

Find attached for your review the plans and exhibits for the above-referenced project. Please
review the plans and exhibits and transmit formal written comments to the Director of
Planning and Zoning no later than 5:00 P.M. on January 7. 1998. When preparing your
comments, please separate them into two categories; code deficiencies with code
sections referenced and recommendations that you believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable
the applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part IV, Land Development Regulations, Site Plan
Review and the applicable code sections of the Code of Ordinances to review and
formulate comments.
2. The documents submitted for the project were determined to be substantially complete,
however, if the data provided to meet the submittal requirements is insufficient to
properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be
requested by the reviewer by contacting Jerzy Lewicki.

3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4. Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements
may conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their review
comments with the name of the appropriate TRC Member that is responsible for the
review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within
the time frame stated above, to the Planning and Zoning Director. The memorandum shall
state that the plans are approved and that they do not have any comments on the plans
submitted for review and that they recommend the project be forwarded through the
approval process.
All comments shall be typed, addressed and transmitted to the Director of the Planning and
Zoning for distribution to the applicant. Please include the name and phone number of the
reviewer on this memorandum. Jerzy Lewicki will be the Planning and Zoning staff member
coordinating the review of the project.
Planning and Zoning staff will send the applicant a cover letter which includes the comment(s)
and directions to amend the plans to comply with the comments and the procedures for
resubmission. When Planning and Zoning staff receives the amended plans, we will distribute
the plans with a cover memorandum to all TRC Members for review and approval.
