Owner: Steve Lovrekovic Variance Request: Relief from City of Boynton Beach Land Development Regulations, Chapter 21 - Zoning, Article 1111 Section 5 to install a 6 feet 8 inches by 5 feet freestanding, double-faced sign with a sign setback from property line of 1.5 feet (measured from the leading edge of the sign - setback to the center of the sign pole is 4.75 feet) . BACKGROUND The subject property is located on the west side of South Federal Highway, approximately 690 feet south of Golf Road (see Exhibit "A" - Location Map), and is zoned C-31 Community Commercial. The motel building was built as a conforming structure with appropriate setbacks, however, when Federal Highway was widened, the front yard setback was reduced to 8.9 feet, making this building nonconforming. For the same reason, the setback of a row of trees that is planted in the front yard, but north of the referenced structure, was reduced to ten (10) feet - see Exhibit "C" - Site Plan) . There is a nonconforming pole sign located in the front yard of the property that encroaches into the Federal Highway right-of- way by approximately 2.7 feet (See Exhibit "B" - Survey) that the property owner is intending to remove and replace with another pole sign located entirely on his property (See Exhibit "C" - Site Plan) . The following is a description of the zoning districts and land uses of the properties that surround the subject request: North Single family residence, zoned C-3 (Community Commercial) East South Federal Highway right-of-way and farther east is a condominium development, zoned R-3 (Multi-family Residential) South Restaurant I zoned C-3 (Community Commercial) West Los Mangos residential development, zoned R-3 (Multi-family Residential) . ANALYSIS The petitionerls intent is to install a freestandingl double faced sign having a pole center located at the distance of (4.75) feet from the front property line. The sign size would be 6 feet 8 inches by 5 feet (see Exhibit "0" - Sign Proposal). Therefore I the leading edge of the sign would be approximately 1.5 feet away from the property line. City's Land Development Regulations, Chapter 21 - Zoning, Article III, Section 5 requires that: Page 2 Memorandum No. 96-278 Steve Lovrekovic, Case No. 218 Staff Report - Board of Zoning Appeals "All signs must meet a minimum ten (10) foot setback measured from the property line to the closest surface of the sign. Where a building is closer than ten (10) feet from a property line, a freestanding sign can have its leading edge one-half way between the property line and the building" . Since the building setback is 8.9 feet, the second part of the above code provision applies. This condition would allow the petitioner to place the leading edge of the new sign at the distance of 4.45 feet from the east property line abutting Federal Highway. However, the ten (10) foot distance between the existing row of trees and the east property line would limit the width of the sign to a maximum of five (5) feet. Visibility of the sign from Federal Highway would be reduced by the projection of this row of trees if the applicant complied with this limitation. In order to avoid the reduction in visibility, additional setback from the row of trees would be needed, howeverl this would further limit the width of the sign. Therefore, the property owner has decided to apply for the variance to allow reduction in the distance between the leading edge of the sign and the front property line from the 4.45 feet allowed by code, to 1.5 feet. The applicant believes granting of this variance would provide adequate sign visibility from Federal Highway. Find attached, Exhibit "E", the Applicantls Request for Variance and Exhibit "F" the Applicant's Reasons for Requesting the Variance. The summary of facts is as follows: 1. The current sign is nonconforming in that it does not meet the required setback andl in fact, encroaches into the right-of-way of Federal Highway. 2. The motel building became nonconforming upon the widening of Federal Highway and associated condemnation of a portion of the front yard setback of the property. 3. Pursuant to the sign code criterion, the nonconforming front setback of the property sets the required distance between the leading edge of the proposed sign and the property line as 4.45 feet. 4. The petitioner is requesting a zoning variance to erect a pole for the proposed sign at a distance of 4.75 feet and the leading edge of the sign at a distance of 1.5 feet from the property line. NOTE: As stated in Chapter 2 - Zoning, Section 10.B.2.b: "The board of zoning appeals may prescribe appropriate conditions and safeguards in conformity with this chapter". In the event the Board grants the variance, it is recommended that the variance become null and void if either of the following takes place: a) the row of trees is removed or b) the ourrentl nonconforming motel ~tructure is demolished or demolished and replaced with a conforming building.
