Dear Mr. Lang:
Since there appears to be a missing link in the communication of problems with the above-
referenced application between the applicant and others concerned with developing this
property, this letter serves to reiterate Jerzy Lewicki's (my assistant planner) conversation with
your architect, Daniel Diamond on ..l!Jly 23, 1996...regarding your zoning variance application
submitted on July 15. 199B The submitted application was determined to be incomplete, as the
enclosed survey did not provide a legal description of every new lot and/or parcel of land for
which a zoning variance, if granted, would apply. Moreover, before such survey can be
accepted by the City, a subdivision master plan has to be filed with the Planning and Zoning
Department. Since the submitted variances apply to a subdivision master plan, variance
applications, as determined by the master plan review, must be filed with the Planning and
Zoning Department and approved by the Board of Zoning Appeals prior to forwarding of the
subdivision master plan to the Planning and Zoning Board and City Commission. During the
above mentioned meeting, Mr. Lewicki conveyed to Mr. Diamond the process your development
proposal should follow.
Your incomplete application was being held until a complete master plan application was
submitted. However, as this application has not been submitted to date, your variance
application is being returned herewith.

On September 11, 1996, the City's Planning Director,
Tambri Heyden and I telephoned you to discuss the details
of your September 11 th letter which you faxed to Carrie
Parker concerning the above referenced project. In our phone
conversation, which fortunately included Mr. Harvey Lang,
we were able to determine that Dan Diamond had not
submitted either the revised subdivision master plan, nor the
subsequent variance application. In fact, based upon our
records, there were no actions nor applications pending
before the City on this project.
You had indicated to us that you would be meeting with your
people to determine what type of revisions were to be
generated and then would submit them to the City for
review. My sense of the conversation was that we could
expect to see those resubmittals, most likely by the end of
last week.
.As of today, we have not seen any submittal from Mr. Lang,
Mr. Diamond or from Mark V Properties. Is there something
more that we should be doing?
