Cassell Saint Joseph's Episcopal Church and School To increase a fence height that is located within the front yard from the maximum allowable of 4.00 feet to 8.66 feet (Chapter 2 - Zoning, Section 4.J. of the land Development Regulations). The property owner is proposing an 8.66 foot tall fence along the Seacrest Boulevard frontage of the project. A portion of the fence, that portion located north of the driveway off of Seacrest Boulevard, is located within the 25 foot front yard. BACKGROUND The subject property, St. Joseph's Episcopal Church and School, is located at 3300 South Sea crest Boulevard (see enclosed Exhibit "A" - location Map and Exhibit "B" - Survey). The zoning designation of the property is R-1AAB (Single-family Residential). The existing church and school facility is operating under a conditional use approval which is required for this type of use in this zoning district. The most recent improvements (expansion of the classroom building #5) were granted conditional use approval in September 1996. The petitioner is proposing an 8.66 foot high fence, an increase of 4.66 feet along the entire property frontage adjacent to Seacrest Boulevard, (see Exhibit "0" the Applicant's Request for Variance). A part of this fence is to be located within the required front yard setback of the property. The fence consists of sections of metal pickets and rails set between stucco piers. The height of these sections varies from 7' 4" to 8' 8" (see Exhibit "C" - Site Plan and Fence Elevation). The petitioner's justification for this increase, as stated in Exhibit "E", Statement of Special Conditions, Hardships or Reasons Justifying the Requested Variance is: . security of the premises . control of access to recreational facilities The following is a description of the zoning districts and land uses of the properties that surround the subject property: North South East - single-family homes, zoned R-1AAB; - undeveloped land, zoned PUD (Hills at Lake Eden); - single family homes and farther northeast is the Seacrest Scrub preservation area, zoned R-1AA; and Page 2 Memorandum No. 96-547 St. Joseph's Episcopal Church and School Case No. 220 Staff Report - Board of Zoning Appeals West - single family homes, zoned R-1AAB. ANAL YSIS The City of Boynton Beach Land Development Regulations, Chapter 2 - Zoning, Section 4.J states that: "... The following structures shall be permitted in front, rear, or side setbacks as provided in this ordinance, in any zone, except where so noted; taking into considerations existing easements: 1. Fences, hedges and walls shall not exceed six (6) feet in height, above finished grade, in residential zones, except that from the building line to the front line the maximum height shall be four (4) feet... ". The summary of facts is as follows: 1. The property is located in the R-1AAB, residential zoning district and is surrounded by single family homes. This zone allows only single family homes, churches, city owned and operated facilities, and private golf course and recreational clubs as permitted uses. Schools require conditional use approval to ensure compatibility with the surrounding neighborhood. 2. The code allows fences not higher than four feet in the front yard of residential districts. The front yard setback requirement is 25 feet. Behind the 25 foot front setback and along the rear and side property lines, a fence as high as six feet is allowed. 3. The proposed height of the fence exceeds the height permitted by 4.66 feet or more than double what is allowed. 4. The fence location meanders in and out of the front yard setback. The portion of the fence closest to Seacrest Boulevard is approximately 15 feet from the Seacrest Boulevard right-of-way line. 5. Fences in non-residential zones are allowed up to six feet in height along all sides of the property line with no setback (the subject request is 2' 8" higher than this). Only in the industrial zones are fences in excess of six feet allowed, with no setback and on all sides of the property. In these zones, the maximum height is eight feet (8" less than the subject request).
