Cassell Project Name: Saint Joseph's Episcopal Church and School Variance Request: Relief from the Land Development Regulations, Chapter 21 - Signs, Article IV, Section 1.B which limits freestanding signs to 32 square feet in area and 6 feet in height to allow a size of 106 square feet and a height of 14 feet 6 inches. BACKGROUND The subject property, St. Joseph's Episcopal Church and School, is located at 3300 South Seacrest Boulevard (see enclosed Exhibit "A" - Location Map and Exhibit "B" - Survey). The zoning designation of the property is R-1AAB (Single-family Residential). The existing church and school facility is operating under a conditional use approval which is required for this type of use in this zoning district. The most recent improvements (expansion of the classroom building #5) were granted conditional use approval in September 1996. The petitioner proposes to erect a 14 feet 6 inch high freestanding sign in the front yard of the property (see Exhibit "E"). The size of the sign would be 106 square feet (See Exhibit "C" - Sign). The sign would be located north of the main access driveway from Seacrest Avenue (see Exhibit "0" - Site Plan). According to the petitioner's statements in Exhibit "F", the purpose of this sign is: . to emphasize the significance of this property in the neighborhood . to make the sign compatible with the architectural features and improvements on the property The following is a description of the zoning districts and land uses of the properties that surround the subject property: North - single-family homes, zoned R-1AAB; South - undeveloped land, zoned PUO (Hills at Lake Eden); East - single family homes and farther northeast is the Seacrest Scrub preservation area, zoned R-1AA; and West - single family homes, zoned R-1AAB. Page 2 Memorandum No. 96-548 St. Joseph's Episcopal Church and School Case No. 224 Staff Report - Board of Zoning Appeals ANAL YSIS The City of Boynton Beach land Development Regulations, Chapter 21 - Signs, Article IV, Section 1.B states that: "On plots containing permitted nonresidential structures or uses, a flat or freestanding sign, not exceeding thirty-two (32) square feet in area will be permitted. A flat wall sign must not be higher than ten (10) feet, nor a freestanding higher than (six) 6 feet... ". Article II, Section 1.B of Chapter 21 states that the Board of Zoning Appeals may grant sign variances to: "Allow the area and/or height of a sign to be increased by up to twenty-five (25) percent of the maximum allowable height or area. . ." The proposed increase of the sign area is 74 feet which is 231 percent of the maximum allowable area. Similarly, the proposed increase in the height of the sign is 8 feet 6 inches which is 142 percent of the maximum allowable area. The summary of facts is as follows: 1. The property is located in the R-1AAB, residential zoning district and is surrounded by single family homes. This zone allows only single family homes, churches, city owned and operated facilities and private golf course and recreational clubs as permitted uses. Schools require conditional use approval to ensure compatibility with the surrounding neighborhood. 2. If the Board finds that there is a height hardship, the maximum sign height the Board can approve is_I.Steet (seven feet lower than requested). 3. maximum sign area the Board er than requested). 4. The proposed sign has a setback of 15 feet. The code requires a minimum of ten feet from the Seacrest Boulevard right-of-way line. As a point of information, the sign requested is freestanding and not a wall sign even though a wall. for which a height variance is also simultaneously requested, is to be erected behind the sign. Since the maximum sign height the Board can approve by b-1 variance is 7.5 feet and since the wall height requested ranges from 7' 4" to 8' 8", which is higher than the allowable sign height, it is advised that the Board consider the combined visual impact of these two types of structures and their relation to one another, due to their proximity.
