ISLES AT HUNTERS RUN PUD VARIANCE REQUEST
TO REDUCE REQUIRED REAR YARD SETBACK
A. That special conditions and circumstances exist which are peculiar to the land,
structure or building involved and which are not applicable to other lands,
structures or buildings in the same zoning district;
RESPONSE: The Isles of Hunters Run is a peculiar piece of property that is now
being developed residentially after having been set aside for commercial use
many years ago and therefore, excluded from the boundaries of Hunters Run
PUD. Had this property been .included in Hunters Run PUD, the variance being
requested would not be necessary, as the west side of the Isles of Hunters Run
would not be considered a perimeter, but only an interior portion of a
development pod abutting an existing lake and golf course. However, because
the project was developed later than the original Hunters Run PUD, the Isles at
Hunters Run is being treated as a separate Planned Unit Development, and while
the residents enjoy many of the aesthetic amenities of the Hunters Run Planned
Unit Development, the perimeter of this development pod is considered an exterior
perimeter in its entirety. Therefore, the application for the perimeter standards
contained in Chapter 2.5, Section 98 apply requiring an excessive rear setback
from the existing lake and golf course area of 40 feet. The Petitioner is requesting
a rear setback of 20 feet minimum.
B. That the special conditions and circumstances do not result from the actions of
the applicant;
RESPONSE: The speci~1 conditions do not result from the actions of the
applicant. The configuration of the property was set by the original developer of
Hunters Run who is not the applicant. Because of time constraints resulting from
the contract between the applicant and the original owner, the applicant needed
to layout a project meeting all code standards, whether they were reasonable or
not. For that reason, the applicant laid out the site showing the perimeter setback
and oversizing the westerly lots as possible to offset its affect ( see attached

Exhibit IIBII ). However, because of the quality and style of the housing being
proposed, it soon became apparent that the setback which serves no purpose
was impinging upon the ability of the owner to provide appropriate units and with
an appropriate rear setback.
C. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, buildings, or structures
in the same zoning district;
RESPONSE: Granting of this variance will not provide any special privilege to the
property owner. This variance only applies to the west property line of the site
which abuts an existing lake and golf course area. While this side of the property
is technically considered an exterior perimeter, it is in fact an interior side of the
property abutting this recreational amenity and should be subject to normal
setbacks.
D. That literal interpretation of the provisions of this chapter would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning
district under the terms of the Ordinance and would work unnecessary and undue
hardship on the applicant;
RESPONSE: Literal interpretation of the provision of this code would require
twice the setback required of other development pods located within Hunters Run.
Because these development pods are considered interior, they are not subject to
the same perimeter setback requirements, except where the Hunters Run PUD
abuts Congress Avenue. This applicant also meets the minimum perimeter
requirements where the property abuts Congress Avenue.
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure;
RESPONSE: The proposed 20' setback is the minimum setback which will allow
for a reasonable and appropriate layout of the units on the lots. The setback still
meets or exceeds setbacks of other units located within Hunters Run PUD which
abut the existing golf course.
F. That the granting of the variance will be in harmony with the general intent and
purpose of this chapter and that such variance will not be injurious to the area
involved or otherwise detrimental to the public welfare.
RESPONSE: The granting of the variance is in harmony with the code. The

perimeter setback provision was designed to provide compatibility between edges
of different communities. In this particular case, the Isles at Hunters Run is being
treated much as an extension of the existing Hunters Run PUD. Additionally, the
perimeter under discussion contains a lake and a golf course and is located at its
closest point, 470' from the nearest residential pod on the opposite side of the
fairway area. (See attached Exhibit IIAII)
