This application requests variances to internal building setbacks for the proposed Food Court and Discount Auto buildings currently being reviewed for Site Plan approval. These buildings will be constructed within Tract C of the Shoppes of Woolbright PCD project. Provided below is a table outlining the PCD setbacks being applied to these buildings, the proposed setbacks and the requested variance dimension. These setbacks areas will be adj acent to either a common driveway between the two parcels, the entrance driveway, parking area for Home Depot which have been established by a recorded agreement to be common areas for parking and access for use by all of the tenants of the PCD project. The setback areas for variance 1 and 3 will contain landscaping that when added to the existing landscape areas will provide significant buffering along the parcel boundaries. In the case of the Food Court building, the requested variance is required in response to staff comments received during review of the proposed site plan to reconfigure the building for loading and dumpster access. Strict interpretation of the PCD setbacks for these internal sides of the building would constrict the buildable area in Tract C to a point of infeasibility. This project can develop uses permitted by the C-3 zoning district. The proposed setbacks are consistent with the setbacks are consistent with the C-3 zoning district requirements. In addition, this application complies with the criteria of the City's code for variance as indicated below. A. The special conditions that exist consist of this Tract being platted based on lesser building setbacks than those currently required by the Master Plan. The proposed variance would not be intrusive to the abutting parking or access for the Home Depot. Strict interpretation of these setbacks would constrict feasible development of these parcels, 4722 N.W. Tract C was originally configured and platted based on lesser interior setbacks. N ow that site plan applications have been filed, PCD setbacks are being applied to the parcels which significantly impact the developable area. More specifically, the Food Court building has been configured in response to staff comments during review of the site plan application. C. The requested variances only applies to the lots legally described by the attached survey and will not confer any special privilege that is denied to other lands. D. Strict interpretation would deprive the applicant development of the building square footage allowed by the approved Master Plan. The reduction of building area would cause unnecessary and undue hardship on the applicant and his reliance on building areas approved by the Master Plan. E. The requested variances are the minimum required to allow the proposed development of these lots as currently designed. F. The granting of these variance would be in harmony with other development in the City and would continue to comply with the overall intent of the PCD zoning district. This variance would not be injurious or detrimental to the public welfare. LAND DEVELOPMENT CONSULTANTS PLANNING I ZONING I PERMITTING Boca Raton I (561) 994-6411 Fax 1(561) 994-0447 Shoppes of Woolbright pcn Tract C - Lots 1 and 2 Variance Justification Statement December 6, 1996 This application requests a variance to the 30 foot rear yard setback for Lots 1 and 2 of Tract C of the Shoppes of Woolbright, PCD. This PCD Master Plan inappropriately reflects the perimeter PCD setbacks on the internal outparcellots. The variance requested would reduce the setback from 30 feet to a minimum of 23 feet along the east parcel line of the lots described by the attached legal descriptions and survey. The east/west dimensions of Tract C was based on a rear setback of 20 feet. Subsequent to the Shoppes of Woolbright PCD plat being approved, the perimeter PCD setbacks were inappropriately applied to the interior parcels of Tract C. Strict interpretation of the PCD setbacks on these internal outparcels would constrict the buildable area to a point of development infeasibility. The site plans that accompany this application reflect compliance with the 40 foot front setback adjacent to the public SW 8th Street. The plans also show compliance with the intent of the PCD district in that both lots provide over 24 % open space and the required landscape buffers. The rear setback area faces the parking lot of Home Depot. When combined with the existing landscape buffer of the Home Depot parking, there will be over 30 feet between the proposed buildings on Lots 1 and 2 and the Home Depot parking, These parcels are allowed to be developed with any use permitted by the C- 3 zoning district. If the C-3 zoning district setbacks were applied, the rear yard setback could be zero with a 2 1/2 foot wide landscape buffer. Even with the proposed variance, the buildings will be constructed with a minimum rear yard setback of 23 feet and over 30 feet of landscaped area between the buildings and Home Depot parking. The proposed variance is a reasonable request considering the internal location of the parcels, that they abut parking for other commercial uses (Le. Home Depot) and the open space/landscaping required for the PCD is still maintained. In addition, this application complies with the criteria of the City's code for variance as indicated below. A. The special conditions that exist consist of this Tract being platted based on lesser building setbacks than those currently required by the Master Plan. The proposed variance would not be intrusive to the existing parking for the Home Depot which will abut the area proposed for the reduced setback. Strict interpretation of these setbacks would constrict feasible development of these lots, 4722 N.W. Boca Raton Boulevard I Suite C106 I Boca Raton. Florida 33431 B. These circumstances result in the multiple changes made to the Master Plan throughout the years. These circumstances are not the result of intended actions by the applicant. C. This variance request only applies to the lots legally described by the attached survey and will not confer any special privilege that is denied to other lands. D. As indicated previously, strict interpretation would deprive the applicant development of the building square footage allowed by the approved Master Plan. The reduction of building area would cause unnecessary and undue hardship on the applicant and his reliance on the building areas approved by the Master Plan. E. The variance requested is the minimum required to allow the proposed development of these lots. F. As indicated previously, the granting of this variance would be in harmony with other development in the City and would continue to comply with the overall intent of the peD zoning district. This variance would not be injurious or detrimental to the public welfare. Even with the variance, there will be over 30 feet between the nearest parking area and the proposed buildings.
