The Planning and Development Board, with a 4-3 vote, recommended approval of the request below, subject to all staff comments in Exhibit "D" - Conditions of Approval. Since the Planning and Development Board meeting, staff contacted the Utilities Department about the conflict between their comments (5 and 6), with respect to when the reservation fee shall be due. The Utility Department has deleted comment 5 and amended comment 6. Comment 6, however conflicts with comment 9. Comment 6 requires the fee payment prior to forwarding the request to the City Commission, which staff cannot do since we don't have the authority to hold up applications once submitted. Utilities Department is concerned that if the applicant doesn't get their extension, the applicant will not pay last year's delinquent fees. Therefore, the Planning and Zoning Department has added a new comment (11) in an attempt to address this issue, which if acceptable to the City Commission could replace comment 6. For further details pertaining to this request, see attached Planning and Zoning Department Memo No. 97-149. Planning and Zoning Director DATE: April 25, 1997 SUBJECT: Tara Oaks- site plan time extension File No. SPTE 97-001 NATURE OF REQUEST Susan Prillaman of Pulte Home Corporation. agent for Tara Oaks Development Corporation - owner of the Tara Oaks property, is requesting a twelve (12) month time extension of the previously granted site plan approval (see Exhibit "A" - letter of request). The location of the property, zoned PUD (Planned Unit Development), is the east side of Knuth Road, approximately 570 feet north of Woolbright Road, as shown on the attached location map - Exhibit "B". If approved, the request would extend the expiration date of the site plan to February 18, 1998. BACKGROUND On June 21, 1988, the City Commission approved a master plan and rezoning of the Tara Oaks PUD property from R1AAA (Single-family residential) to PUD with a land use intensity (LUI) of 4.00 for 78 single-family, detached units. On December 18, 1990, after review by the Department of Community of Affairs (DCA) and with objections, the City Commission approved ordinances for a land use element amendment that changed the land use classification of the property from Low Density Residential to Medium Density Residential and rezoning of the property from PUD (LUI:4) to PUD (LUI:5) with a master plan for 192 multi-family units. private recreation and a 20,000 square foot church (see Exhibit "C" - current master plan). The adopted comprehensive plan amendment was transmitted to DCA on December 19, 1990, along with responses to DCA's objections. In February 1991, the DCA issued a notice of intent to find the comprehensive plan amendment in compliance. The 1990 applications were submitted under Palm Beach County's current traffic performance standards ordinance, however prior to the effective date of the City's concurrency management ordinance. Therefore, concurrency certification for traffic and concurrency exemption for drainage and neighborhood parks were granted with the 1990 approval. On June 2. 1992, the City Commission approved a request to allow construction of the south portion (adjacent to the church parcel) of Knuth Road, prior to preliminary plat approval of the property. The reason for submitting the request was to ensure the Church of Jesus Christ of Latter Day Saints' purchase of the church parcel within the PUD. which took place on June 26, 1992. On June 16, 1992, the City Commission granted a one (1) year time extension that extended the project's June 18, 1992 expiration date to June 17, 1993. No application for extensions was made since the June 1993 expiration, until a retroactive extension which was filed in November 1994; a period of one year and five months. On April 8, 1993, the City Commission approved a master plan modification for the Tara-'f: Oaks PUD to amend the condition of approval which required the construction of Knuth Road to be tied entirely to the Tara Oaks PUD. The approval of the master plan modification allowed the construction responsibility for Knuth Road to be shared by the Knuth Road PCD. / Page 2 Memorandum No. 97-149 Tara Oaks SPTE 97-001 On April 18, 1995 the City Commission approved the retroactive time extension submitted November 1994. The approval granted nine months to file a plat application. The approval was also conditioned upon the applicant evaluating reducing density at time of the applicant's next submittal. On December 19, 1995 the City Commission approved a master modification to revise direct access points, alter the location and type of private recreation, change unit type from apartments to town houses, establish perimeter buffer easements and certain setbacks, enlarge size of residential Pod 1 and church parcel and reduce open space and retention area of Pod 2. Density was not changed with this approval. On February 20, 1996, the City Commission approved the site plan for Tara Oaks (file no. NWSP 95-011), subject to staff comments. The site plan proposal included construction of 192 townhouse units in 22 residential buildings totaling 630,312 square feet of gross floor area and private recreational amenities, on 14.5 acres (see attached Exhibit "C" - approved site plan). The recreational facilities are to include: a meeting room, pool, sand volleyball court, basketball court, and jogging trail with arbor. To meet the city's parking regulations of 409 parking spaces for this development, the total of 414 parking spaces will be provided. The project will be secured with an unmanned gate. Chapter 4. Section 5 of the City's Land Development Regulations indicates that the City Commission, at its discretion, may extend the approval of a site plan for a one year period, provided a request for extension is filed prior to the expiration of the one year period. In granting such extensions, the City Commission may impose additional conditions to conform the site plan to current development standards. ANALYSIS. The request was filed on February 3, 1997, before the expiration of the one (1) year approval of the site plan, as the approval was valid through February 19, 1997. The application was incomplete and was held until receipt of all necessary authorizations. Once authorization from the property owner, Mr. Winchester, was received, processing of the application resumed. With respect to this particular request, there have been changes in codes since the site plan was approved. However, compliance with them would not significantly alter the approved site plan. enabling the site plan to be modified as part of the permitting process. RECOMMENDA TION On March 11. 1997, the Technical Review Committee met to discuss the request and the consensus of the Board was to grant a one (1) year extension of the site plan approval. Since that time, several tasks needed to be accomplished before Pulte Home Corporation could proceed with its permitting and development of the project, including: 1. The road impact fee credit was negotiated with Palm Beach County and was approved by the Board of County Commissioners in November. Receiving this credit was critical to the feasibility of the project. 2. The site was redesigned to generate fill for another Boynton Beach project owned by the Seller. The redesign created a lake spanning the southern property, requiring the adjacent property owner's approval. We would like to appear before the City Council to request a twelve month extension to the site plan approval in order to complete the permitting and platting process. Provide proposed water and sanitary sewer plans for review and comment (Sec. 26.16(a)). 2. City water will not be supplied for irrigation. Show source and location on the plans (City Camp. Plan, Policy 3C3.4). 3. No trees are permitted within utility easements (Sec. 7.5-18.1). 4. Palm Beach County Health Department permits will be required for proposed water and sanitary sewer systems (Sec. 26.12). 5. A capacity reservation fee will be required within thirty (30) days of City Commission approval, or upon request for Utility Department signature on the HRS/DEP permit applications. The fee amount will be determined based upon meter size or expected demand (Sec. 26-34[E]). 6. The applicant never paid the required capacity reservation fee, which was due within thirty (30) days of the February 20, 1996 site plan approval. Based upon one meter for each of the 192 units, the reservation fee per year is $26.611.20. It is recommended that the applicant pay for the year which is past due, plus the next year in advance (total = $53,222.40) before the City Commission considers granting a one-year extension. Based upon this item, it is recommended that this request not proceed to the City Commission until the entire reservation fee is paid in full. Any waiver of this fee is also not recommended, which is consistently applied to all new developments. 7. The Utilities Department has not yet received or approved final construction drawings for the water and sewer systems serving this project.
