Guidry, Utilities Director ~ LIJ< July 3, 1997 TO: DATE: SUBJECT: Tara Oaks P.U.D. - Water and Sewer Concurrency Reservation On May 20, 1997 the City Commission approved a one year site plan extension for this project, subject to staff comments. Comment no. 10 states in part ". . . if the extension is approved, is shall become null and void within 30 days if this year's and last year's reservation fees ($53,222.40) are not paid within 30 days of approval." To date, no portion of this fee has been received by this Department. Yesterday, Susan Prillaman, the agent for this project by Pulte Home Corp., advised my office by telephone that the fee would not be forthcoming, and that Pulte Home Corp. no longer intended to construct the project. Based upon the non-payment of any capacity reservation fee, I am formally notifying both of you that any capacity reservation which this project may have had is hereby canceled. The site, therefore, does not have our certification of concurrency for potable water and sanitary sewer. (Chap. 1.5, Art. VI, Sec. 9C [d.1]) Based upon comment no. 10, it would also appear that the site plan is no longer valid. Please refer any questions on this matter to Peter Mazzella of this office. Project: Agent: Owner: Location: Tara Oaks Susan Prillaman, Pulte Home Corporation Tara Oaks Development Corporation, Bill Winchester, President Northeast corner of Woolbright Road and Knuth Road extended Time Extension - Request for a one year site plan time extension to expire February 18, 1998. <} Description: Mayor Taylor advised that staff recommended approval of this time extension, and by a 4 to 3 vote, the Planning and Development Board also recommended approval. Kieran Kilday represented the contract purchaser. He had no problems with the comments in Exhibit D. Ms. Heyden recommended that the City Commission delete comments 5 and 6 and approve comment 11, which best protects the City to ensure that the back fees and this year's fees are paid. Mr. Kilday had no problem with this. He intended to pay both fees. Motion Commissioner Jaskiewicz moved to approve a one year site plan time extension to expire February 18, 1998 taking into consideration all staff comments, substituting comment 11 as stated by Ms. Heyden to replace comments 5 and 6. Guidry, Utilities Director \ - FROM: DATE: February 26, 1997 SUBJECT: Tara Oaks - Request for one year extension We offer the following comments on this extension request: 1) The applicant never paid the required capacity reservation fee, which was due within thirty (30) days of the site plan approval. Based upon one meter for each of the 192 units, the reservation fee per year is $26,611.20. We recommend that the applicant pay for the year which is past due, plus the next year in advance (total = $53,222.40) before the City Commission considers granting a one-year extension. 2) This Department has not yet received or approved final construction drawings for the water and sewer systems serving this project. All of our previous comments, therefore, shall remain in effect. Based upon item no. 1, we recommend this request not proceed to the City Commission until the entire reservation fee is paid in full. We would also not recommend any waiver of this fee, which is consistently applied to all new developments. Please refer any questions on this matter to Peter Mazzella of this office. Since this development was originally approved, the City of Boynton Beach has made amendments to the Land Development Regulations and adopted the 1994 edition of the Standard Building Code with local amendments. 2. A condition of this extension should provide that the current Land Development Regulations be applicable.
