Please accept and process the attached four (4) Rectified Master Plans. The comments approved by
the City Commission on December 19, 1995 have been incorporated into the revisions of this plan.
Weare submitting the Rectified Master Plan on behalf of Pulte Homes, South Florida Division.
The Minor Master Plan Modification approved by the City Commission on December 19, 1995
reflects a total of 192 fee simple townhomes, a church parcel, and an open space/preservation pod.
The entire property is 20.16 acres in size. I have included four sets of plans in the hopes that two
sets with the appropriate signatures may be returned to us so that we have an original copy for our
files and one original for Pulte Homes, South Florida Division.

RESPONSE: Attached Exhibit A represents an expansion of
the original Tree Inventory subaitted With the
applicant's original application. This inventory
indicates a distinct difference between the North
and South part of the site. In tact.. the North part
or the property had previously been cleared and used
fi)"f" many years to graze cattle lan existing dairy
barn reaains on the slte). The priaary scrub habitat
is located on the South portlon of the property and,
in fact, was incorporated in a preservation
requirement by the City Council 1n approving the
Land Use A.end.ent.
The environaental assess.ants referenced in
Recreation and Park Hemoranda 190-278 and '90-321
are not required until prior to Site Plan kevlew.
Exhibit B contains the exact Environ.enlal
kegulation language which was recently adopted in
consistency with the require.ents of the adopted
Co.prehensive Plan <Section 7.5-59). The reference
to scrub oaks contained in Planning Depart.ent
Memorandu. No. 90-177 and noted In the ORC report
reads as follows:
WOn-site vegetation consists priaarily of
exotics and clusters of oaks and scrub oaks
scattered throughout the south halt ot the
site. Based on available intor.ation, there
should be no tmpedi.ents to the develop.ent ot
the site owing to environ.ental constraints.
However, care should be taken to preserve the

oaks and scrub oak. a. noted 1n the
correspondence in the Forester/Horticulturist's
aeaorandua in Exhibit "E"."
It is the applicant's contention that the Tree
Inventory <now further expanded>, the Topography,
Soils and Vecetation report in Meaorandua '90-177
and the referenced Parks and Recreation Me.oranda,
provide the analysis of natural resources required
under Rule 9J-5.006 (2) (~)4.
However, additional history of the site is of use
here tor the benefit of DCA staff. There is an
existing approval of a zero lot line develop.ent for
the property under its current ~ow Density
Residential designation. Exhibit C, attached her~in,
illustrates that the approved plan for seventy-eight
lots incorporates 100S of the property in either
individually owned lots or streets. The proposed
Plan (Exhibit 0> and amend.ent language clusters all
of the units on the North half (environ.entally
insignificant property) and restricts the use of the
South half to preservation or less intensive land
uses. The net effect of the proposed densities is
the preservation of environmentally significant land as
the new units represent clustered multifa.ily
development utilizing much less of the property than
the approved single family development. Therefore,
Exhibit 0 demonstrates the alternative suggestion of
the DCA staff to "increase the a.ount of open space
on the site to protect natural resour~s."
Finally, the proposed amendment contains specific
language and conditions which will beco.e part of
the Plan. Condition (3) of the new language reads:
"(3) The portion of this area which lies to the
south ot S.W. Congress Boulevard extended
shall be li.ited to recreation facilities,
open space, and water .anage.ent tracts to
serve the project as well as places of
worship. Also, since this area contains
habitat for gopher tortoises (Gopherus
polyphemus), which are protected by State
law, any gopher tortoises which are found in
Area 8.k. shall be relocated to this open
space, to the maxi.ua extent permissible by
State laws and regulations."
Finally, an environmental assessment wil I be
required prior to any site plan approv~1 as
previously noted.

RESPONSE: The proposed a.end.ents represent one
chan~e froa Lower Density Residential to Higher
Density Residential, one chanRe tro. High Density
Residential to Com.ercial, and one change fro.
Co..ercial, in part, and Hedlu. Denslty, in part,
entirely to Co..erclal. The cu.ulative effect of
these changes are as follows:
Residential: The residential potential of the three
sites including the exlstln~ approval ot 78 units on
the Tara Oaks property, the existing plan of 77
units on the south part of the Knuth Road site, and
the existing plan ot 159 units tor the Boynton Beach
Boulevard Site total 31~ units. The cu.ulative
effect of the amend.ents is the reduction of 122
units with 192 units being now located at Tara Oaks
PUD. The proposed unit reduction IS consistent with
the analysis of the adopted Plan which states that
there will be a surplus ot 539 units at buildout.

Co..ercial: Knuth Road PCD is an annexation of
property froa the County into the City. The' current
County Land Use plan for this property Is
Co..ercial. The County's adopted Co.prehenslve Plan
designates the north ~50 teet High Intensive
Co..ercial and the re.alnder of the site as
Co..ercial Recreation. There is an existing
approval for a co..ercial recreation use of the
entire property. The proposed Land Use in the City
is consistent with the adopted land use in the
County.
The Boynton Beach future Land Use Hap showed the
site, which is a single parcel of property, with two
land use designations, Local Retail Co..erelal and
Mediu. Density Residential. The Discussion ot
Supply and Demand tor Co..erelal Land in the
Comprehensive Plan Future Land Use Ele.ent Support
Docu.ents <Voluee No.1, Page 40) specifIcally allows
additional co..ercial designations "for .inor
Boundary adjust.ents" or "s.all intill parcels.ft
The proposed change of the Hediu. Density
Residential portion of the site to Local Retail
Co..ereial allows the entire site to be developed in

. unified land use and plan. Therefore, the proposed
Local Retail Co..ercial desi,nation within the City
of Boynton Beach Is consistent.
The location of the site at the periphery of the
City indicates that County residents as well a8 City
residents can use the site. The Econo.ic Ele.ent of
the County Plan indicates that there is a general
shortfall of co..erctally desienated land in the
unincorporated area both now and In the future and
that additional sites .ust be designated. This
finding is based upon a study of the County's
consultants. CH2H Hill. and has been accepted by DCA
in reviewing the County Plan. Attached herein. as
Exhibit E. are Co.mercial Needs Charts fro. the
Econoaic Ele.ent of the County Plan. Knuth Road PCD
is located in Sub-Area SB. Based upon these facls,
Knuth Ro.d pcn is consistent with both Plans.
Boynton Beach PCD represents the deletion ot
approxiaately thirteen acres of High Density
Residential designated land fro. the Plan and the
addition of approxiaately thirteen acres to the
City's inventory of Com.ercial Property. At the tiae
of the applicant's sub.ittal a Market Analysis was
sub.itted indicating the need for both ot the
Planned Co..ercial Develop.ents. These analyses are
attached herein as Exhibits F and G. Additionally,
the applicant's consultant has written an addendua
to address the issues raised in the DCA report and
it is attached as Exhibit H. This addendu. again
reflects the tact that the .arket crosses the
boundary between the City and the unincorp~;ated
area. The County's Subarea S8 indicates an existing
shortfall of 80 acres while the City Plan's support
docu.ents list a surplus of 30 acres. Utilizing both
Plans. because of the location of this project at
the City's edge, a titty acre deficit exists which
can easily absorb this 13 acre site.

RESPONSE: Applicant believes that Knuth Road PCD and
Boynton Beach PCD are consistent with
Objectives 1.3 and 2.1 and Policies 1.3.3 and
2.1.3 of the Comprehensive Plan. The DCA Objection does
not specify on which roads the amend.ents will exceed
the traffic levels of serVlce. Therefore, we are unable
to respond at this tiae. However, "r. K.S. Rogers,
Tr~~fic Consultant for the applicant, will contact the
DCA staffperson to try to clarity this issue.
In the interim Hr. Rogers lists the following road
improveaents which have been confiraed since the
writing of the original traffic analysis:
1. Widening ot Hilitary Trail fro. 2 to 6 lanes north
of Boynton Beach Boulevard.
2. Wideninl ot Congress Avenue froa 4 to 6 lanes fro.
Boynton Beach Boulevard to Hiner Road
3. Extension of Woolbright Road as a 4 lane facility
froa Congress Avenue to Military Trail
4. Announceaent of construction of the interchange at
N.W. 22nd Avenue and 1-95.
Specifically, Ilems 3. and 4. will drastically eftect
Boynton Beach Boulevard's capacity as these two roads
will provide two new east-west arterials with 1-95
access. Based upon all of these improvements, all of
the roads should meet the Levels of Service listed in
Objective 2.1.

adjacent property owners to assure that appropriate
butfering was placed between each of these three
projects and adjacent land uses. Access has been
designed and routed to avoid any iapact on adjacent
properties and the adjacent property owners'
association supported the requested aaendaents.
In effect, the applicant has removed existing conflicts
by virtue of these changes.
Objective 1.19 - Applicant believes that these
amendaents turther the objective by providing
appropriate land uses in appropriate locations while

to which the applicant has agreed. Knuth Road PCD
fronts Boynton Beach Boulevard as well as Knuth Road,
a north-south col lector which the appllcant has agreed
to fund its future constructlon. Adjacent land uses

1995 for the Tara Oaks PUD, The project is located at the northeast corner
of Woolbright Road and Knuth Road extended. The proposed project will
consist of: 192 single-family platted lot townhouse units and a 20,000 square
foot church with 650 seats. The church parcel is located adjacent to
Woolbright Road. Please review the document to determine whether the
conclusion regarding, development of the project and proposed improvements
identified in the analysis, is correct based on S. W. Congress Avenue not
connecting to Knuth Road extended.
Also find attached City Engineer Memorandum No. 95-349. Please contact Ms.
Ziel or myself, if additional information is needed. If additional
information is provided to you directly from Ms. Ziel, please return a copy
of same with your evaluation of the document to me. We would ask that you

as prepared in the 1990 traflic study, which reflected SW Consr-.. Boulevard (lODnecting
with Knuth Road. Since this connection i. incorrect, the tmftic IStudy WBS revised to reflect
the correct roadway network. Due to our time constraint, the analysis was limited to the
necessary tables and trip generation data.
The traffic analysis used the same distribution as the 1990 traffic study and relocated the
SW Congress Boulevard project trips to Woolbright Road. Please find enclosed tables 1
through 6 which provide the existini conditions. trip .s:eneration, iI'Owth rate analysis and
fut\U9 conditions with the rediatribution of traffic. The project trips addressed where those
over the 1988 approval (77 single family units). As you can IilBB from Tabla 5, all of the
rQadways within the impact area Dleet the level of service (LOS) standards.
In addition to the LOB analysis, I prepared 8 driveway analYliB to reflect a change in the
driveways. FiJUl'e 1 provides the daily, AM and PM peak driveway volumes and the project
volumes at Knuth Road and Woolbright Road H Knuth Road is not extended to the north,
based on the projected driveway volumes, a right turn lane would be needed at the driveway
to the residential site. Ifhowever. Knuth Road is exended to the north, this right turn lane
would not be l1eeded. Tha projectad Tara Oaks volumes at the intersection of Kuth Road and
Woolbright ;roed are not sisnifioant, but do indicate the need for an &Xclusive southbound to

TARA OAKS - TRAFFIC IXPACT ANALYSIS
We have today first seen the September 12 traffic study for Tara
Oaks. The two significant requirements contained therein are a
right turn lane in at the project entrance and a southbound to
eastbound left turn lane at the Knuth Road/Woolbright Road
intersection.
Normally additional conditions would not be placed on an
application this la~e, but clearly it was the applicant's
delinquent submission of the traffic study which made it impossible
to respond earlier.

Dear Ms. Heyden:
In following the newspaper articles in regards to the Tara Oaks project and furthermore to a
telephone conversation that you and I have had in April on the subject, we the residents of Tara
Lakes are pleased that the "City of Boynton Beach" has "approved" the extension of Knuth Road
through to Woolbright Rd.
In addition, we are pleased to learn that there are no longer plans to access the new community
from Southwest Congress Blvd. With this in mind, the community of Tara Lakes wishes to ask
that the City of Boynton Beach "temporarily" annex the small extension of road that goes beyond
Tara Lakes Drive West to the Tara Lakes HOA. In addition, a dead end barricade and caution
sign would need to be placed in that position where the road presently ends by the City of
Boynton Beach to prohibit illegal vehicle traffic and dumping if this annex is allowed.
In regards to this matter, Tara Lakes HOA would like to place a basketball hoop in the "pro-
posed" area for the residents of our community to enjoy. As the paved extension of road exists,
there would be minimum cost to both Tara Lakes and City of Boynton Beach to allow for such
structure. In addition, the "temporary" annex could be removed at a later date if the decision
was made to connect Southwest Congress to Knuth Rd or other extension.
As the surfacing is already prepared it would be a shame to see this property torn up when it
could be used for real community activity. Our plan would make the extension a small park.
Possibly a small ficus hedge would be added to give the area some needed aesthetic look also.
Please consider our request and advise if you think this is possible. I can be contacted at my

737-9173. We are prepared to contact the "City Commission" or other official if necessary.

Minor Master Plan Modification

Dear Ms. Heyden,
Please accept and process the attached revised information for a Minor Master Plan Modification
to the previously approved Tara Oaks PUD, located north of Woolbright Road and east of the
future Knuth Road. We are submitting this revised Minor Master Plan Modification application
on behalf of Pulte Homes Corporation South Florida Division contract purchasers of the property
and Bill Winchester, owner of the property, and incorporating comments received at the August
15, 1995 TRC Meeting.
The latest Master Plan approved on June 8, 1990 reflected a total of 192 multi-family units on the
northern portion of the site, an open space/preservation area centrally located, and a church
parcel on the southern portion of this site. The proposed Master Plan retains the 192 previously
approved units which will now be developed as fee simple townhomes. The open
space/preservation tract remains centrally located, and the church parcel remains unchanged on
the southern portion of the site. Attached with this application is a revised Master Site Plan for
the project reflecting proposed building locations and corresponding lot lines, access points, the
recreation area and parking configurations. The Conceptual Landscape Plan specifies proposed
landscape buffers and plant material requirements. A previously approved cross section is also
included with the submittal set. This cross section has been revised to reflect an agreement
made between the Stonehaven Home Owners Association and the property owner The
conceptual engineering plans, as well as a boundary and tree survey, are also attached.
The perimeter landscape buffer and the building setbacks proposed are consistent with those
previously approved. Minor adjustments have been made to the main access for the PUD. The
church parcel, which is under separate ownership, will retain the two previously approved access
points. The previously approved plan reflected two main access points to the residential parcel.
This has been reduced to one main access point which will be controlled with a security gate.
Three emergency access locations are proposed elsewhere along Knuth Road. These access

points will be stabilized to support the weight of emergency vehicles. They also will be gated
and locked pursuant to the City of Boynton Beach Fire Rescue requirements. The developer of
Tara Oaks will be constructing Knuth Road from just north of the L-25 Canal south to Woolbright
Road including the required crossings over both the L-25 and L-26 Canals. Concurrent with this
roadway construction, an eight foot wide bike path will also be constructed on the east side of
Knuth Road adjacent to Tara Oaks PUD.
A private recreation site of 1.75 acres is provided for Tara Oaks PUD. The active portion of the
recreation area is provided adjacent to the main entry. This recreation area has been relocated
from the site shown on the previously approved Master Plan to address conditions imposed on
the original approval. A passive recreation component consistent with that previously approved
is shown in the open space tract and will consist of a jogging trail through the
preservation/relocation area and a gazebo or garden amenity at its terminus. A total of five (5)
recreational amenities are proposed to receive one half credit for the public recreation land
dedication. Consistent with the past approval and the comments again included in Parks and
Recreation Memorandum #90-229, the developer will pay a fee in lieu of land dedication for the
public park commitment.
The attached plans have been revised addressing those issues raised at the TRC meeting of
August 15, 1995, and subsequent items included in the TRC comment memorandums issued by
each reviewing department. The following is a recap of the comments included in the
memorandums and subsequent responses by the project team.
POLICE DEPARTMENT MEMORANDUM NO. 0158
1. The final approved Master Plan depicted Southwest Congress Boulevard to be terminated
into a cul-de-sac per the request of adjacent residents. The proposed plan shows the
western right-of-way stub of Southwest Congress Boulevard to be removed.
2. The developer is investigating the feasibility of providing 24 hour access through the
automatic gate entrance system. A telephone access system or a similar feature will be
provided.
RECREATION AND PARK MEMORANDUM NO. 95-371
1. Attached is a statement from our environmental consultant stating that the permit from the
Florida Game and Fresh Water Fish Commission will not change the Master Plan as
shown in order to comply with the requirements of the permit.
2. A Tree Management Plan and an Environmental Assessment are forthcoming. In the
attached statement from the environmental consultant, there is reference to the Tree
Management Plan and the Flora and Fauna Survey.
UTILITIES DEPARTMENT MEMORANDUM NO. 95-255
1. The revised Conceptual Engineering Plan shows water and sanitary sewer being provided
to Pod 3.

2. The project engineer is aware of the comments and will incorporate them in their final
plans.

BUILDING DIVISION MEMORANDUM NO. 95-299
1. It is the intent of the developer to plat this project.
2. There is an adequate number of parking spaces for each town house. These parking
tracts will be dedicated as either easements or common parking and access tracts.
3. The recreation building will be constructed along with the construction of the first town
house building.
4. The final Site Plan will comply with parking signs and handicap code. A complete Site
Plan application will be processed following Minor Master Plan approval.
5. The final Site Plan will show the established easements and setbacks as they relate to the
town houses. A complete Site Plan application will be processed following Minor Master
Plan approval.
FIRE PREVENTION MEMORANDUM NO. 95-325
1. The approved Master Plan depicts Southwest Congress Boulevard terminating into a cul-
de-sac per the request of the adjacent residents. It is the intent of the developer to have
the western right-of-way stub removed.
2. The attached Master Site Plan has been revised to allow for turn-around areas with a
radius large enough to accomodate a fire truck.
ENGINEERING DEPARTMENT MEMORANDUM NO. 95-304
A. The U.S. Postal service will be contacted to verify which roads will require naming, these
names will be incorporated into the Site Plan application following approval of the Minor
Master Plan application.
B. The traffic impact statement will be revised to reflect the redistribution of traffic pursuant
to the removal of the Southwest Congress Boulevard connection to Knuth Road.
C. The Master Site Plan has been revised to show sidewalks on both sides of the internal
roadways. The sidewalks will be in compliance with Chapter VI, Article III, Section 11 A,
Page 3 through 6 of the Boynton Beach Code of Ordinances.
D. Deed restrictions will be established to provide for a property owners association to pay
for the operation of a street light system within the development at the time of plat
approval.

E. The engineer for this project has certified that the drainage plan will comply with all City
codes and standards and a copy of this letter has been attached for your review.
F - H. The engineer is aware of the comments and will incorporate them into the final
engineering plans.
I. The eastern 25' of the 80' right-of-way has been dedicated. This dedication has been
recorded in O.A.B. 7324, Page 1162.
J. Acceptance from South Florida Water Management District and Lake Worth Drain'age
District will be required prior to final engineering approval.
K. A permit will be obtained prior to working within the right-of-way per Chapter 22, Article
2, Section 7 (A), Page 22-3.
L. In lieu of providing sidewalks on both sides of Knuth Road, the developer has agreed to
install an 8' wide bicycle 1 pedestrian path along the east side of the road.
PUBLIC WORKS DEPARTMENT MEMORANDUM NO. 95-145
1. The Site Plan has been revised to accomodate sanitation vehicles. As per our meeting
with Mr. Robert Eichorst, the garbage collection areas will be located at the time of final
site plan approval.
RECREATION AND PARKS DEPARTMENT MEMORANDUM NO. 95-379
1. The recreation dedication requirement calculation has been shown on the Master Plan
(page 10f 4).
2. The five recreational elements consisting of a swimming pool, a sand volleyball court,
jogging trail, gazebo 1 garden amenity, and cabana have been shown on the Master Site
Plan and Master Plan. The appropriate parking spaces have also been shown along with
the required handicap spaces. It is the intent of the developer to utilize the cabana as
one of the five amenities, but no meeting area is proposed. An alternative amenity will
be provided if this is not acceptable.
3. It is the intent of the developer to provide a cabana as one of the five amenities, but no
meeting area is proposed. If this is not acceptable an alternative will be provided.
4. The developer agrees to construct the jogging trail with asphalt or another permanent
surface to minimize maintenance. The revised Master Site Plan shows the jogging trail
(1320 linear feet (1/4 mile) in length).

Process.
6. Parking spaces will be provided for the two recreational elements in the southern portion
of the P.U.D. These spaces will be noted on the final site plan.

space pod in its natural state thus maintaining its natural characteristics. If a lake was

on the Tara Oaks parcel. This estimated figure was determined using the burrow survey data
and data resulting from burrow investigation with an infrared video camera. The site has
been significantly impacted by prior land usage and clearing activities. These activities have
significantly degraded the available gopher tortoise habitat on the parcel.
The Tara Oaks parcel comprises +24 acres. Florida Game and Fresh Water Fish
Commission (FGFWFC) studies indicate that one gopher tortoise requires one-half (0.5) acre
of suitable habitat for long term survival. Approximately 30 acres of optimal habitat would
be required to support the predicted Tara Oaks gopher tortoise population, Currently. the
parcel supports a population density in excess of this recommended density and, as such,
on-site preservation is not a viable option due to the presence of insufficient, low qual ity
habitat on the Tara Oaks parcel.
C&N recommends off-site relocation of the entire population to a large, regional
gopher tortoise re-stocking area. Mr. Tom Stice (FGFWFC) concurs with the survey
findings and the need to accommodate the tortoises through off-site relocation (telephone
conversation August 21, 1995).
An off-site relocation plan is being prepared for submittal to the FGFWFC. Upon
authorization of the off-site relocation permit, the tortoises will be captured and relocated to
the designated recipient site.
The listed flora and fauna survey also identified three scrub mint (Conradina
grandiflora) plants which are slated to be relocated to the proposed on-site preservation area.
No other state or federally listed floral or faunal species were observed on the Tara Oaks
parcel.

dated April 2, 1990. The analysis addressed a mixed-use planned
unit development consisting of 192 multi-family attached dwelling
units and a 20,000 S.F. church generally located in the northeast
quadrant of the intersection of Woolbright Road and Knuth Road.
The current scheme of development to be considered in this review
has remain unchanged. Please refer to the'master plan on file
prepared by Kilday & Associates.
Site access to the parcel also remains unchanged and consists of
four unrestricted dri veways to Knuth Road. The master plan
reflects the extension of S.W. Congress Blvd. from its present
terminus westerly to Knuth Road. Two of the proposed four driveway
connections will be located north of S.W. Congress Blvd. to serve
the residential portion of the site. The remaining two driveways
will be located to the south of S.W. Congress Blvd. to serve the
church portion of the project. The above is reflected on the
master plan.
The original analysis assumed a build-out or completion date of
1993. The review presented herein will assume a build-out date of
1997. The purpose of this review is to demonstrate that the
project will continue to meet the Traffic Performance Standards
addressed in the previous Traffic Impact Analysis under current
roadway volumes and growth rates.

Due to the opening of the interchange at I-95 and N.W. 22nd Avenue
(Gateway Blvd.) as well as the construction of Woolbright Road from
Military Trail to Congress Avenue, all of the above-referenced
links except Woolbright Road between Congress Avenue and I-95 are
anticipated to have adequate capacity at project build-out in 1997
for the trips to be generated by the project. The following Table
identifies the previous traffic assignment, the total 1997 volume
and the Level of Service Standard. All of the following links are
shown to meet the Level of Service Standard at project build-out in
1997 except for Woolbright Road between Congress Avenue and I-95:

Although Woolbright Road from I-95 to Congress Avenue currently has
capacity to support the proposed development, it is projected to
exceed capacity in 1997 due to a 3-year calculated growth rate of
8.36 percent. This growth rate has been calculated based on the
preceding three year's increase in average annual daily traffic in
accordance with standard engineering practice. However,
engineering judgement must be applied in this special circumstance
due to the opening of Woolbright Road from Military Trail to
Congress Avenue. The opening of this link in 1991 has distorted
the growth trend. The average annual daily traffic counts on
Woolbright Road from 1991 to 1994 in 6 month increments may be
summarized as follows:

a. Separate left turn and right turn lane, north approach,
on Knuth Road at the intersection of Woolbright Road.
b. Separate left turn and right turn lanes, east approach,
on S.W. Congress Boulevard at the intersection of Knuth
Road.
c. Left turn lane north approach on Knuth Road at the
intersection of S.W. Congress Boulevard.
d. Left turn lane, north approach on Knuth Road, at the
intersection with future Woolbright Road.
e. Construct S. W. Congress Boulevard as a two lane collector
road from its present terminus, westerly to Knuth Road.
f. Construct Knuth Road as a two lane collector road from
future Woolbright Road to the site' 8 north property line.

Based on a review of the above and the anticipated peak hour
turning movements, the above recommendations continue to appear
applicable.
CONCLUSION
This proposed development was addressed with regard to traffic
performance by K. S . Rogers, Consul ting Engineer, Inc. in the
Traffic Impact Analysis dated April 2, 1990. The analysis
addressed 728 trips per day with an anticipated development build-
out date of 1993.
The analysis presented in this letter has demonstrated that the
project will continue to me.t the Tratfio Performance Standards
addressed in the previous analysis under current roadway volumes
and adjusted growth rates through 1997. In short, all of the
addressed links will meet the applicable Traffic Performance
Standards in 1997.

Dear Mr. Rossi:
Please be advised that this office has no objection to your proposed
revisions on the water and sewer Master Plan. However, based upon our
recent conversations regarding this project, we see the possibility of
condemnation proceedings being necessary in order to obtain the off-site
easements for the proposed water and sewer I ines to the church parcel.
OUr experience tells us that such condemnation proceedings are rarely
successful if an al temate access route is readily available. We therefore
recarmend that you and your client exhaust all other means toward obtaining
said easements before any attempt at condemnation is made. Of course, all
costs related to condemnation proceedings on this issue would be borne by
your client.

Dear Mr. Mazzella:
My client, Bill Winchester, is presently pursuing an agreement
with the Tara Lakes Homeowners Association to obtain a utility
easement for a water and sewer connection for the proposed church.
You indicated at our earlier meetings that the 16" water main
along Knuth Road would no longer be needed since the City's
Master Plan does not provide for a feeder along Knuth Road.
In view of this change, I am submitting a revised Master Plan
showing a new distribution system encompasssing these changes.
You will note that we suggest connecting the 12" main at the end
of SW Congress Blvd. to the existing 16" main on Knuth Road north
of the L-25 canal which will accommodate the muli-family portion
of the P.U.D.
