Comprehensive Plan
Introduction
Pursuant to the provisions of the Local Government
Comprehensive Planning and Land Development Regulation Act,
Chapter 163, Florida statutes (FS), the Council must be
provided an opportunity to review and comment on comprehensive
plan amendments prior to their adoption. The City of Boynton
Beach has submitted, proposed amendments to the state
Department of Community Affairs (DCA), which in turn is
seeking Council's comments.
Council's review of the information provided by the DCA is to
focus on the consistency of the proposed amendments with the
regional policy plan developed pursuant to section 186.507,
FS. A written report, containing any objections,
recommendations for modification, and comments (as defined in
Chapter 9J-ll, Florida Administrative Code) is to be provided
to the DCA within 45 calendar days of receipt of the plan,
elements or amendments.
Backaround
On January 10, 1990, the DCA issued a Notice of Intent to find
the comprehensive plan for the city of Boynton Beach not in
compliance, pursuant to Section 163.3184, FS. As part of this
finding, the ADOPTED plan was found to be Inconsistent with
the Regional Plan.
The City of Boynton Beach is considering draft amendments to
the text and policies pursuant to a stipulated settlement
agreement with the DCA. In addtion, the City is considering
five draft amendments to the Future Land Use Map,' not related
. to a stipulated settlement agreement. The locations of the
properties under consideration are shown on the accompanying
map, and the number of acres and proposed changes in land use
designations are summarized in the following list:

Evaluation
Amendment No. 494 is located on the southwest corner of
Boynton Beach Boulevard and Knuth Road. This property has
been proposed for annexation into the City. The current
County designations for the property are Commercial High/3 for
the northern third and Commercial-Recreation for the southern
two-thirds, while the proposed City designation is Local
Retail Commercial.
Amendment No. 493 is located on the south side of Boynton
Beach Boulevard, between the Post Office and the Stonehaven
PUD. This property is a county enclave which has been
proposed for annexation into the city. The current County
design,ation is Residential/8 units per acre. The proposed

Ci ty designation is Local Retail Commercial. Both of the
proposed changes in land use designation (amendments #493 and
#494) would allow additional retail commercial in the area.
The City of Boynton Beach adopted comprehensive plan indicates
that there may be up to 198 acres of excess commercial land at
buildout. However, this figure may be reduced to a surplus of
only 30 acres when certain adjustments are taken into
consideration. The plan concludes that the supply of
commercial land in the Boynton Beach market area will be
sufficient to meet the demand. Since the southern two-thirds
of the property represented by Amendment No. 494 has been
designated as residential by the city in their plan for the
reserve annexation area and the County's Commercial-Recreation
designation would not allow office and retail commercial uses,
a change to Local Retail Commercial would increase the supply
of commercial land.
Amendment No. 473 is located between the Lake Worth Drainage
District Canals L-25 and L-26 and west of the Lakes of Tara
PUD. The proposed land use change would allow an increase in
residential density from 4.84 dwelling units per acre to 9.68
dwelling units per acre.

Amendment No. 471 is located within the Woolright Place PUD.
The proposed land use change is the result of a settlement
agreement between the developer and the city. The parcel was
originally dedicated to the City as a public park site:
however, the park will be relocated to a 3.5-acre recreational
. parcel outside the PUD which will be dedicated to the City.
The Mall Corner Restaurant amendment is located at the
southwest corner of Old Boynton Road and Winchester Park
Boulevard. This property is being proposed for annexation
into the City: therefore, the proposed land use change is to
incorporate the property into the City's Future Land Use plan.
The change would not allow additional commercial within the
City. In addition, water and sewer services are available to
the property.

to a policy change in the Traffic Circulation Element.
Obiections. Recommendations for Modification. and Comments
Amendments No. 494 and No. 493
A. obj action
1. Regional Goal 16.1.2 is to provide for a balanced, well-
planned, compatible mix of land uses which are
appropriately located, and Regional Policy 16.1.2.2
calls for Future Land Use Maps of government
comprehensive plans to be based upon surveys, studies,
and data regarding the amount of land required to
accommodate anticipated growth, the proj ected
population, the character of undeveloped land, the
availability of public services, the ability fo
government to provide adequate levels of service, and
the need for redevelopment. The need .for additional
commercial land at these locations has not been
demonstrated by the city. The City's comprehensive plan
documents an existing over-allocation of commercial land
use.
Recommendation for MOdification
1. Provide an analysis which demonstrates the need for
additional commercial land at these locations within in
the City of Boynton Beach. If such a need can be
documented, additional changes to the City plan may be
warranted.
Traffic Circulation Element
A. Objection
1. Modified Objective 2.1 allows for a lower level of
service to be maintained on several regional roadway
facilities than called for in Regional POlicy 19.2.1.3.
Policy 19.2.1.3 states that the regional roadway network
shall be maintained at Level of Service (LOS) C or
better during annual average daily conditions and LOS D
during peak season, peak hour conditions. The City
proposes a "maintain" level of service on four specific
regional roadways within the city's jurisdiction. They
are: I-95 from Boynton Beach Boulevard to Woolbright
Road; Boynton Beach Boulevard from Old Boynton Road to
Congress Avenue; Congress Avenue from Boynton Beach
Boulevard to the south City limits: and Hypoluxo Road,
east of 1-95. The City standard allows for LOS E to be
maintained on these facilities which is not consistent
with Regional Policy 19.2.1.3. If the City has

determined that lower levels of service are appropriate
in order to successfully implement other City goals
(i.e., redevelopment), then the City would need to
provide a complete rationale for the lower levels of
service, perhaps in conjunction with the submission of a
Downtown Development of Regional Impact.
Recommendation for Modification
1. The City should adopt a level ot service tor all
regional roadways in its jurisdiction that is equal to
or better than Council's LOS C/O Policy 19.2.1.3. LOS C
shall be maintained during average annual daily traffic
conditions, and LOS D shall be maintained during peak
season, peak hour conditions.
Recommendation
Council should adopt the comments outlined above and
their transmittal to the state Department of Community
in fulfillment of the requirements of Chapter 163,
Statutes.

Dear Mr. Clark:
The Traffic Division has received our copy of the correspondence, regarding the
subject intersection you sent to Mr. Michael F. Matchus of Coral Gables Federal.
In his letter, you requested the total cost of installation of the traffic signal
at the subject intersection. Please find attached a copy of Contract No. 87-
16, which list the equipment needed and a total cost for the proposed traffic
signal installation.
We are requesting that your office inform each of the three Developments of their
fair share cost for the traffic signal. In addition, we are requesting that the
Landing Apartments, Lakes of Tara, and Tara Oakes establ ish a joint escrow
account in the amount of $28,398.50, to be released dir.ectly to our signal
contractor upon completion of the installation. As soon as the County has been
notified that the escrow account exists, the signal inst~llation contract will
be released with a 90 day completion schedule.

Dear Comm1ssioner Marchese,
1 am writing to you regarding the proposed Tara Oaks P.U.D. In
th18, I am representing the homeowners of Banyan Creek.
After review1ng this proposed P.U.D., the homeowners have no
obJection to it and wish the developer the "best of luck" in his
endeavor. However, the homec,wners do obJect to the construction
of Knuth Hoad ~hat will accompany this development.
The homeowners obJect to the construction of this road for two
pr1mary reasons. First, we think that it would very detrimental
to our community. Also. we do not think that there is a real
need for th1S road. The homeowners of Banyan Creek were not
aware that the City intended that Knuth Road should be
constructed as far south as the right-oi-way for Woolbright
Hoad{We had thought that Knuth Rd. would only be built as far
south as Stonehaven Drive-the entrance to Banyan Creek). We only
became aware of this when signs began appear1ng ~or Tara Oaks.
When we investigated further, we additionally found out to our
surpr1se that the construct,ion of Knuth Road to connect with
Woolbr1ght Hoad had prev10usly been approved and included in the
Cityls "Master Plan". Although the construct1on of j{nuth Road
haa previously been approved, we hope that you will reconsider
this 1ssue.
As
I st,ated above,
the homeowners donlt think that there is a

reol need for Knuth Rood to be built. As plonned, Knuth will
extend southward to connect with Woolbright Road when it is
constructed. There are two roads that run parallel to Knuth Rd.
and are located within one-half mile of it, t~~t ~!~~~g~ ~~!~t
that could serve north-south traffic. The first of these is
Congress Ave. which is one-hal~ mile east of Knuth Rd. Second,
there is Lawrence Rd. which is located one-hal% mile west oi
Knuth. Lawrence Rd. has already been completed to the Woolbright
Hd. right-o~-way. The only construction needed ~o connect
Lawrence Rd. w~th Woolbr~ght Rd. ~s a bridge across the L.W.b.D.
canal at that point. Accord~ng to the engineering staf% for the
County, th~s bridge w~ll be constructed when Woolbright Rd. is
built. Between these two roads, we feel that they are sufficient
%or the north-south traf~~c flow in this area. Add~tionslly,
Knuth Rd. would not serve to connect trs%fic with other roads in
this area as well as Congress and Lawrence. Knuth Rd., at the
most, could run from Woolbr1ght Rd. to the canal that borders
the northern end 0% the Boynton Beach Mall. It would only
connect Woolbr1ght Rd., Boynton Beach Blvd., and Old Boynton Rd.
Meanwhile, Congress Ave., connects all roads between Yamato Rd.
in Boca Raton and 45th S~reet in West Palm Beach. Also, Lawrence
Rd. w~ll connect all roads between Woolbright Rd. and Lantana Rd.
Knuth Rd. will not be 0% much additional help with trsf%ic %low
when compared with these roads.
The fact that the construction of Knuth Road will have an adverse
impact on ~anyan Creek is easily seen. The right-of-way through
Banyan Creek is only sixty feet wide<lt is eighty feet wide 1n
Tara Oaks). Included in this right-of-way will be both a two-
lane road<it has the potential to go to four lanes) and an eight
foct w1de bicycle path. As this right-oi-way runs next to Banyan
Creek, 1t comes with1n 25 ieet of homes that already
exiet(within approximately 15 feet of the1r pat10SJ.
Additionally, thie r~ght-of-way parallels Edgewater Dr. ~or a
distance o~ approximately 1000 %eet. The pavement for Edgewater
Dr. is only ten ~eet ~rom this r~ght-of-way. Because Knuth w~ll
be constructed close to Edgewater Dr. and to the houses ~n Banyan
Creek that back onto it., there ~s not even enough room to
prov1cle a buffer large enough to help lessen the 1mpact of Knuth
Rd. and the tra~f~c ~t w1ll carry. We think that there 1S go~ng
to be a problem with traffic crossing over between Edgewater and
rlnuth where they parallel each other. Southbound tra~f~c on
Knuth could crose over on to Edgewater Dr. and proceed to
Stonehaven Or. and use this a short-cut to Congress Ave. Aleo,
the bicycle path that would be constructed close to and between
these two parallel roads would be dangerous to use.
'fhe traffic on Knuth Road. will also aggravate some already
existing safety and crime problems for our community. From the
stand-point 0% crime prevention, it will greatly increase the
access to our development. to outsiders. We have had problems with

breek-ins in the pest ~nd do wont this problem to reoccur. From
the ssfety stand-point, i~ will greatly increase the traf~ic ~low
in and around Banyan Creek. We already have an existing problem
with motorists using Stonehaven Dr. as a shortcut between Boynton
~each Blvd. and Congress Ave. It ~s a dangerous situation, as
ours is a family community and we have many children whose safety
concerns us. Approximately eighteen months ago, there was a
child hit by a car using Stonehaven Dr. as a shortcut. This is
the type of prOblem we wish to avoid. We think that ~he tra~~ic
on Knuth Rd. will lead to increased traffic on Stonehaven Dr.
which would make an unsa~e situation worse.
The amount of traffic that Knuth Rd. will carry and at what speed
1S another reason for our concern. Knuth Hd..as planned. w~ll
be 1nteresected by only two streets<Stonehaven Dr. and S.W.
Congress Blvd. at Tara Uaks) between Boynton Heach 8lvd. and
Woolbr1ght Rd., a distance of approx1mately two-thirds of a mile.
It will be a very stra1ght road, probably w1th no etop s~gne or
tra~fic lights between Woolbr1ght and Boynton Beach Blvd.
As a result, Knuth Rd. will become a high-speed, non-stop, Short-
cut between the two largest east-west roads in the City of
Boynton Beach.
The lest problem that will be associated with Knuth Rd. may at
first glance appear to be minor. But when you consider the
problem ofeone who has to live day a~ter day w1th the noise and dirt
that will be generated by a road that is going as close as Knuth
is to the homes in Banyan Creek, and the amount 0% stress it will
cause in individuala~ you realize that it can be harmful~ both
mentally and physically.
Once aga~n, we ask that you reconsider the question o~ Knuth
koad. Let me restate that the homeowners in Banyan Creek think
that any additional extens~on is uneeded and would be qU1te a
detriment to our commun~ty. Along th1S line~ we would ask that
you might consider one 0% the ~oliow~ng proposalS:
1. That the City neither extend Knuth Rd. itself or require
the developer o~ Tara Oaks to do so either.
2. That the City not extend Knuth Rd. itself and only
require the developer 0% Tara Oaks to build Knuth Rd. south o~
S.W. congress Blvd. to Woolbright Rd.<This would provide access
to Woo~bright Hd. ~or ~uture homeowners 1n Tara Uaks).
~. That the City should reevaluate Knuth Road as to whether
it is needed and as to how it w1ll a*~ect the people who will
live along it.
Also~ that if the City should accept one o~ these proposals and
later decide that Knuth Rd. should be built, that the City would

discuss this with the homeowners in Yanyan Creek and give the
homeowners an oppurtunity to comment on it bexore the Commission.
My last commen~s regarding this come ~rom me as an individual,
but 1 ~eel that are very relevant. In this particular case, I
think that to ~ully understand the impact the constr~ction o~
Knuth Rd. would have on our community, that you need to actually
go and see where it is going to be built. It is one thing to
read maps and plans or to read other peopleJs reports and letters
or to listen to other people speak on a subJect, but to truly
understand our concerns, you need to v1sualize how it will look.
Go to Edgewater Dr. and stop. Get out o~ your car and try to
1mag1ne how Knuth Rd. will look and its impact on Banyan Creek.
Then as you leave on Knuth Rd. back to Boynton Beach Blvd., see
how close some o~ our homes are to Knuth Rd. This is the only
way you can truly understand our concerns.

Dear Mr. Shalloway:
Reference is made to the letter of May 26, 1988 from Charles
cantrell, Signal Systems Engineer for the Palm Beach County Traffic
Div~sion, addressed to the writer with a copy to you. -
As stated in the said letter, I am hereby requesting for the City
of Boynton Beach, that your company jointly with the Developer of
Lakes of Tara and the Developer of The Landings Apartments'establish
an escrow account of $30,000.00 to be released directly to the
County sig.nal contractor upon completion of the installation for
a traffic signal at the subject intersection. The initial installa-
tion is currently planned to be a flashing traffic signal, but the
County rraffic Division has started a new traffic study to see if a
fully oper;ational traffic signal should be installed "up front".
I will advise concerning a time and date to meet concerning the
participation in the escrow account with the parties concerned as
soon as possible.
Please advise if you have any questions concerning the above.

SUBJECT: CONGRESS BOULEVARD AND CONGRESS AVENUE
Dear Mr. Clark:
In previous correspondence to your office, the Traffic Division indicated that
a flashing signal, which would be converted to a fully operational signal when
minimum vehicular volume warrants are met, was justi!fied at the subject
intersect ion. You had informed thi s offi ce that developer commitment exi sted
to cover the installation costs. At the present time we have received seperate
letters from all three developers indicating a willingness to participate in
the signal installation costs. However, only one party, Michael F. Matchus of
Coral Gables Federal {representin Lakes of Tara, has indicated that a
specific amount of money as been made available (see letter dated July 31,
1987). Mr. M.T. Register of the Lieberman Corporation (representing the
~~Apartments) i ndi cated in a 1 etter, dated April 3, 1986, that they
were willing to pay their fair share of the costs. In an April 27, 1988
letter, Mr. K. Dan Shalloway, P.E. (representing Tara Oqk~") indicated
that the Developer had met his requirement to p~~S--for signal
installation costs.
The Traffic Division is requesting that your office inform each of the three
Developments of our intent to construct the flashing traffic signal. In
addition, we are requesting that the Landings Apartments, Lakes of Tara, and
Tara Oakes establish a joint escrow account in the amount of $30,000.00, to be
released directly to our signal contractor upon completion of the
installation. We are suggesting that your office arrange a meeting with all
parties concerned (The City, Developers and County) to coordinate and resolve
each entity's level of participation.
It should also be noted that this office has initiated a new traffic study for
the subject intersection to determine if the initial installation should be
upgraded from a flashing signal to a fully operational traffic signal. We
will notify your office when the study has been completed and reviewed.
