LEGAL APPROVAL ORDINANCE NO.~90-7~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, _REGARDING TARA OAKS P. U. D. (SOUTH OF L. W. D. D. CANAL L-25 AND NORTH OF L.W.D.D. CANAL L-26 AND STARTING OAT THE NORTH SOUTH 1/4 SECTION LINE OF SECTION 30 CONTINUING FOR A DEPTH OF 347.30' EAST), AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREINAFTER; SAID LAND DESIGNATION IS BEING CHANGED FROM LOW DENSITY RESIDENTIAL (LDR) TO MEDIUM DENSITY RESIDENTIAL (MeDR); PROVIDING A SAVINGS CLAUSE; PROVIDING REPEALING PROVISIONS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted a Comprehensive Land Use Plan and as part of said Plan a Land Use Element by Ordinance No. 89-38 in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, Kieran J. Kilday/Kilday & Associates, Inc., agent for John Lambert Van Hezewyk and Anita Louise Van Hezewyk the owners of the following property, has heretofore requested the above mentioned Land Use Element Amendment; and WHEREAS, the procedure for amendment of a Land Use Element of a Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and WHEREAS, after public hearing and study, the City Commission deems it in the best interest of the inhabitants of said City to amend the aforesaid Land Use Element of the Comprehensive Plan as adopted by the City herein. This area is adjacent to two multi-family projects which lie to the east, as well as single-family detached projects which lie to the southeast, to the west, and to the north. Due to its size, shape, and location, this area is arguably suitable for multiple-family dwellings, and should therefore be placed in the Medium Density Residential land use category.
