Parking lot variances for lighting and drainage
Section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
To that end, this memorandum is forwarded, consistent with
5-145(c) (4).
Efram Pesyna, agent for Abita Springs Water Co., Inc., is
requesting a variance to Sections 5-142(a) "Lighting" and
5-142(f) "Drainage". Abita Springs Water Co., Inc., a
manufacturer of bottled water, recently received administrative
site plan approval to modify an existing industrial bUilding
located at 3030 S.W. 13th Place, which required the parking lot
and landscaping to meet current standards.
Section 5-142(a) requires that parking lot lighting shall be
designed to meet the levels of illumination and luminaire types
as specified in the City standards, (adopted by resolution by the
City Commission) to provide a safe environment. Specifically,
the applicant is requesting relief from having to install
pole-mounted lighting necessary to supplement existing
building-mounted fixtures which do not meet the minimum, average
illumination level required of one footcandle per square foot of
paved area. The applicant is requesting to retain the
building-mounted fixtures by replacing the existing lamps with
higher intensity ones.
Section 5-142(f) requires that storm water be contained on-site
and that drainage structures have a storage capacity of a minimum
of 2.5 inches of rainfall in one hour and comply with City
standards. city standards require that catch basins be located
in grassy swales to prOVide for pretreatment of storm water. The
applicant is requesting to retain the existing drainage system
which has catch basins located in paved areas, providing minimal
pretreatment. For an explanation of the code requirements, the
nature of the variances requested and the variance justification,
please refer to the attached Notice of Public Hearing and
application.
On Thursday, December 20, 1990, the Technical Review Board (TRB)
met to review the plans and documents submitted and to formulate
a recommendation with regard to the variances requested. After
review and discussion, the TRB recommended that the request for a
lighting variance be denied until additional information was
submitted regarding the type of fixture and lamp type and size,
which has not yet been received. However, after visiting the
site, the Police Department prepared the attached memorandum
which reports that they find the existing building-mounted system
unacceptable. This is due to the nature of the fixtures which
shine out from the building making it difficult for officers to
patrol and see into the site from the street. Intensifying the
lamp size would exacerbate this condition.
With respect to the drainage variance, the TRB recommended
approval of the existing system subject to the applicant

installing gutters to discharge roof drainage into the pervious
area to the rear (south) of the building and constructing swales
from all other pervious, grassed areas, including the public
right-of-way. These measures will aid in partial pretreatment
and help to improve storm water quality.

The Engineering Department herein submits this memorandum as a replacement for
Engineering Department memorandum 90-302CC, dated December 14, 1990, relative
to the above referenced parking lot variance requests.
1. During our most recent Technical Review Board meeting, the applicant, in
conjunction with the Technical Review Board has agreed to provide a suitable
amount of roof drains which shall discharge to a fully sodded and irrigated
storm water retention area to be constructed immediately south of the structure.
The storm water retention area shall be designed by an Engineer, registered
within the State of Florida and shall include measures to swale all on-site
grassed areas, including the development of fully sodded and irrigated swales
within the roadway rights-of-way.
2. The applicant shall modify the existing site lighting which is mounted on the
face of the building to an activation system comprised of a photo-metric cell.
The Engineering Department in conjunction with the Police Department agreed
during our most recent Technical Review Board meeting to visit the site with
the Engineering Department's calibrated light level indicator in order to
determine illumination levels within the above referenced parking facility.
The applicant during the meeting has agreed to modify the lighting system in
accordance with our findings. Should the light level readings fall below that
which is required by the Code of Ordinances, the applicant agrees to place a
sufficient amount of perimeter post mounted lights to insure compliance with
our codes.
As this agreement would be in conflict with the intent of a variance request,
the applicant should be contacted by your office to determine whether or not
they which to withdraw the variance request for Section 5-l42(a), "Required
Lighting".
Note: The applicant has not yet complied with all staff comments provided within
Engineering Department TRB memorandum, dated October 26. 1990.

Please be advised that the Engineering Department for the City of Boynton
Beach, Florida objects to the above referenced request for relief from the
Boynton Beach Parking Lot Regulations, specifically Chapter 5, Article X,
Section 5-142 (a), "Required Lighting" and Section 5-142 (f), "Required
Drainage".
A. REQUIRED SITE LIGHTING - VARIANCE REQUEST
The applicant states within the application that the lighting is "working
sufficiently". The Engineering Department has not received an illumination
plan (photometries) depicting the actual levels of illumination within this
facility. An Engineer registered within the State of Florida shall be re-
tained to measure existing lighting levels and be responsible to submit to
this office, a certification that states the lighting system is photo-cell
activated and that all parking facility areas, including pedestrian sidewalks
are in a state of compliance with our City's codes relative to lighting levels.
Currently, lighing fixtures are mounted upon the face of the existing structure
potentially resulting in glare along adjacent streets, including a decrease in
safety for our Police Patrols who will be exposed to lighting directed toward
their line of sight instead of toward the building as specified within our City's
Engineering Department Standards and Specifications (adopted by resolution).
ENGINEERING DEPARTMENT RECOMMENDATION
The Engineering Department recommends that the owners be required to provide
post mounted perimeter lighting which is energy efficient (i.e. sodium vapor).
Additionally, the subject lighting system shall be photo-cell activated and
provide a minimum of one (1) footcandle of illumination throughout the entire
parking facility and associated pedestrian walkways. (Section 5-142 (a) and
Section 5-142 (g) Lighting Standards inclusive).
NOTE: THE APPLICANT HAS NOT YET COMPLIED WITH ALL STAFF COMMENTS PROVIDED WITHIN

B. REQUIRED STORMWATER DRAINAGE - VARIANCE REQUEST
The applicant states within the application that there exists a stormwater system
that is in "good working order" and that the system is located within paved areas
and swales as "currently requested by the City Engineer's Office". The function
of the existing system has no relationship to the City's Code of Ordinance which
requires pre-treatment of stormwater prior to discharge into a formal stormwater
drainage system. Currently, the system does not comply with this ordinance, as
the stormwater grates and structures are located solely within paved areas in
violation of standard environmental practices. Although the application states
that a system is situated within grassed swales, an on-site inspection of this site
revealed that there is not a stormwater drainage system within the adjacent swales.

B. REQUIRED STORMWATER DRAINAGE - VARIANCE REQUEST
Additionally, the application states that the existing stormwater drainage
system is in paved and grassed areas as "currently requested by the City
Engineer's Office". This system has been in-place for over five (5) years
and this office has no responsibility relative to the existing design and/or
placement of stormwater systems. The in-place system does not properly pre-
treat stormwater as inlet grates are located within paved areas which results
in and promotes the direct discharge of contaminates into the existing drain-
age system (toxic spills, petroleum products etc.).
ENGINEERING DEPARTMENT RECOMMENDATION
The Engineering Department recommends that the owners be required to provide a
stormwater system that complies with City codes specifically, Appendix "C", Sub-
divisions (site located within Lawson Industrial subdivision), Article X, Section
5A "Drainage and Stormwater Treatment", Section 5B "Stormwater Treatment", includ-
ing but not limited to Chapter 5, Article X, Section 5-142 (f) "Drainage" requiring
submission of technical drainage data that the applicant has not yet provided this
office (reference attached Eng. Memo No. 90-267 item #2f). The burden of proof
that the system formally pretreats and contains stormwater within the facility
must become the responsibilty of the owners Engineer who shall submit drainage
data that supports the "opinion" of the applicant who is not a registered engineer.
The variances requested by the applicant should be denied for the following reasons:
1. No supportive technical data has been provided by the applicant who has render-
ed an opinion as to the suitability of on-site conditions relative to lighting and
stormwater management.
2. The enforcement of these prov1s10ns would be in the best interest' of, the public
and does not constitute a hardship, as other property owners have complied with
the requirement to upgrade their site (Pep's Seagrill, Motorola etc.) There is
no hardship as the applicant has chosen to expand the site of his/her own free
will. The applicant states that this business will be inconvenienced by the up-
grade of the facility. All owners who improve there sites are inconvenienced
and therefore it is my opinion that a hardship does not exist.
3. Granting of these variances would confer on the applicant a special privilege
not granted to other lands or structures within the City. (ref. item #2)
4. The granting of the variance is detrimental to the public welfare and is not
in harmony with the intent and purpose of the City's Code of Ordinances and the
1989 edition of our Comprehensive Plan including policies contained within the
associated Evaluation and Appraisal Report relative to stormwater pre-treatment
and environmental concerns (Na,tural Recharging of Aqui,fers).

In accordance with the City of Boynton Beach, Florida, Code of Ordinances,
Chapter 19, Article II. "Site Plan Review and Approval", Section 19-17, "Plan
Required" including Chapter 5, Article X, Boynton Beach Parking Lot Regulations,
Section 5-142 "Required Improvements" inclusive, the applicant for the above
referenced project shall provide the following information, technical data and
plan revisions as follows:

1. Provide a current survey which is a submittal requirement of the site plan
approval (application) process. The Engineering Departmen~ reserves th~
right to generate additional comments based upon technical information
depicted within said survey when received by this Department. Chapter 19.
Section 19-17(k) "Engineering & Technical Data".

2. In accordance with Section 5-l3B(a),(d) and (g) of Chapter 5, Article X
provide the following:
a) A parking lot site lighting plan which meets the requirements of Secfion
5-142(a) "Required Lighting". The lighting system shall comply with
Section 5-l42(g) "Lighting Standards" as defined within the City bf Boynton
Beach Engineering Department specifications (Page #1).
b) Provide internal directional arrows at ingress/egress apprGach areas ,and
provide standard F.D.O.T. stop signs at all exits in accordance with
Section 5-l42(c) "Traffic Control" and Section 5-l42(g) "Traffic Control
Standard".
c) Provide a parkiyg lot layout which complies with the design criteria set
forth in Section 5-142 (h),(4) as the N.E. parking stall depicted on the
architectural plan violates this section. The applicant has the right to
seek relief through proper variance procedures or relocate the singular
stall in conflict with this code.
d) Provide a parking lot striping plan which complies with Section 5-142(1)
"Parking Lot Striping" and Section 5-l42(g) "Striping Standards".
(Standard stalls double striped in white per Engineering Department standards)
Handicap parking stalls must comply with the requirements set forth within
D.C.A. Accessibitity Requirements Manual. Secion 5-142(k) "Handicap
Requirements".
e) Provide car:stops at each standard and handicap stall'1 Provide raised
continuous concrete curb where parking stalls abut landscaped areas.
Raised continuous curbing shall comply with Section 5-l42(g) "Curbing,
Standards", Engineering Department Standards (Page #2).
f) Provide a stormwater drainage system including drainage calculations and
percolation test data, Section 5-l42(f) "Required Drain*ge". Grassed
swales within the public rights-of-way shall be developed in accordance
with Engineering Department Standard Drawing-IA-B0033. Grassed swales
shall be sodded and fully irrigated.
3. Provide parking lot dimensions, elevations including geotechnical test data
relative to the thickness of the in-place asphaltic concrete surface.
Chapter 19, Section 19-17(k) "Engineering and Technical Data", Section
5-l42(g) "Parking Lot Construction"
4. In accordance with Section 5-142(g) "Sidewalk Standards" place a note on
the site plan indicating, "All broken and avulsed sidewalks shall be removed
and replaced as directed by Engineering Department inspectors". Chapter 22,

impervious areas exceeding twenty-five
thousand (25,000) square feet, the
design of the parking lot and facilities
shall be done by an engineer registered
in the State of Florida, and the plans
submitted shall be sealed. Maximum
storage capacity of soil shall be
considered at the rate of one (1) inch
of water for each- six (6) inches of soil
above the water table. Drainage
calculations are required in all
instances. The hydraulic conductivity
of soil shall be determined with tests
made at the site usin~ test procedures
recommended by the South Florida Water
Management District or other procedures
which have been approved by the City
Engineer.
Section of City Standards, Drainage-
Storm drainage catch basins shall be
located in grassy swale locations.
(2) ARTICLE X - PARKING LOTS,
Section 5-142 Required Improvements, (a)
LIGHTING. Each parking lot shall be lit
in such a manner as to provide a safe
environment. Levels of illumination and
luminaire types shall comply with City
standards.
