SUBJECT: Planning & Zoning Board Meeting - September 10, 1991
Please be advised that the Planning and Zoning Board met on
Tuesday, September 10, 1991, and took the following action:
1. Deleted the SeaMist Centre and Marina conditional use
request from the agenda. Further processing of this request
cannot occur until the applicant resubmits plans to the
Technical Review Board. Although advertised as such, a
public hearing before the Planning and Zoning Board is not
required by code. (PM91-221)
2. After conducting a public hearing, unanimously approved the
request for a parking lot variance to Section 5-142(h)(7)
"Driveway" of Article X, Parking Lots, for Abita Springs
Water Co. Inc., located at 3030 S.W. 13th Place, subject to
proviso. The motion was made by Mr. Collins and seconded by
Mr. Cwynar.
3. The Board accepted the property owner's agent's request to
withdraw, from the agenda, the site plan approval for Best
Homes at Boynton Lakes, Plat 5, for the construction of 41
townhouse units. After the issue regarding the requirement
to construct various improvements on common areas is
resolved, this request will be placed on a future Planning
and Zoning Board agenda.
4. Unanimously recommended approval of the request submitted by
Leon O. Surles for site plan approval to construct a 4,000
square foot carpet wholesale distribution facility on .77
acres, subject to proviso. Motion was made by Mrs. Huckle
and seconded by Mr. Collins. (PM91-222)
5. Unanimously recommended approval of the request submitted by
Mega Mini for Space Plus for approval of an amended site
plan to construct an outdoor rental storage lot, subject to
proviso. Motion'was made by Mrs. Huckle and seconded by Mr.
Collins. In addition, the Board requested the Planning
Department to notify the residential property owners
abutting the subject parcel to the north, prior to the
September 19, 1991 City Commission meeting. (PM91-223)
6. The Board removed from the table and unanimously made a
finding of consistency with the Comprehensive Plan for the
proposed amendment to Appendix A-Zoning, Section 11.1 of the
Code of Ordinances to allow for expansions of nonconforming
structures used for conforming uses, in the Central Business
District, subject to proviso. Motion was made by Mrs.
Huckle and seconded by Mrs. Greenhouse. (PM91-224)
7. Make a finding of consistency with the Comprehensive Plan
for the proposed amendment to Appendix B-Planned Unit
Developments of the Code of Ordinances, Section 6.F-Planned
Commercial District and Section 7-Planned Industrial
District of Appendix A-Zoning of the Code of Ordinances to
create time extensions for master plan approvals and specify
that a master plan modification shall not extend the
expiration of a master plan approval. Motion was made by
Mrs. Huckle and seconded by Mr. Cwynar. The vote was 4-2
with Mr. Rosenstock and Mrs. Greenhouse dissenting; Mr.
Collins had left the meeting. (PM91-225)

8. Deleted the consistency review determination of the proposed
Administrative Procedures Ordinance from the agenda since
this ordinance has not been completed by staff. This item
will be placed on a future Planning and Zoning Board agenda.
9. Made a finding of consistency with the Comprehensive Plan
for the proposed amendment to the zoning code to allow
towing companies in the M-1, Light Industrial, zoning
district. Motion was made by Mrs. Huckle and seconded by
Mr. Cwynar. The vote was 4-2 with Mr. Rosenstock and Mrs.
Greenhouse dissenting; Mr. Collins had left the meeting.

This memorandum is being forwarded pursuant to section
5-145(c)(4) of the Code of Ordinances, which requires that when a
variance to Section 5, Article X, "Parking Lots" is requested,
the Technical Review Board (TRB) must forward a recommendation to
the Planning and Zoning Board and the recommendation is to be
made part of the public hearing proceedings.
Efram pesynam agent for Abita Springs Water company Inc., a
manufacturer and distributor of bottled water, is requesting a
variance to Section 5-142(h)(7), "Driveway," which prohibits more
than two (2) driveways from any property. Where properties abut
more than one (1) public or private right-of-way, additional
driveways may be permitted, but in no instance shall the number
of driveways exceed two (2) on each street. The applicant is
seeking relief in order to add a third driveway onto S.W. 13th
Place. TWo (2) driveways currently exist onto S.W. 34th Avenue.
Thus, if this variance is granted, the subject property will have
a total of five (5) driveways.
It should be pointed out that three (3) parking spaces will be
eliminated if a third driveway onto S.W. 13th Place is added.
This reduction in the number of parking spaces requires a
variance from the Board of Adjustment. A hearing is scheduled
for October 14, 1991. Thus, the request to add a third driveway
onto S.W. 13th Place is subject to the approval of a variance by
the Board of Adjustment for the elimination of three (3) parking
spaces.
On Tuesday, August 27, 1991, the TRB met to review the plans and
documents submitted and to formulate a recommendation with regard
to the variance requested. After review and discussion, the TRB
recommended that the request for a variance to add a third
driveway onto S.W. 13th Place be denied. The TRB felt that the
need for an additional driveway has not been sufficiently
demonstrated and that no special circumstances exist to warrant
the granting of a variance.

(7) No more than two (2) driveways shall be pennitted
from any property. Where properties abut more than

(i) . Parking lot layout
(1) Parking lots shall be designed to meet or exceed the
dimensional requirements for stalls, drive~aY8, and
access aisles as provided for in city standards.
(2) Each parking'lot or parking stall shall have sufficient
access from a street, alley, or other public or private
way. Maneuvering and access areas shall be of suffi-
cient size to permit vehicles to enter and exit the
parking lot and parking stalls in a safe and efficient
manner. In no instance shall parking lots be designed
to allow vehicles to back out into any public alley or
road rights-of-way, or segments of private streets which
function as local or collector streets.
(3) Within parking lots, a minimum design radius of ten
(10) feet shall be provided. If truck traffic is antici.
pated, this minimum design radius shall be increased
accordingly. '
(j) Parking garages. Parking garages, whether public or pri-
vate, shall comply with this article where applicable, and
with the Standard Building Code and the county-wide
amendments thereto. Where appropriate, security systems
~ay be required.
(k) Handicap requirements. All parking lots shall provide park.
ing stalls with proper signage consistent with the State
Handicap Code requirements, and with the Standard Build-
ing Code and the county-wide amendments thereto.
(1) Parking lot striping, Parking stalls shall be delineated by
double-line, painted stripes where parking stalls abut each
other, which shall comply with city standards.
(m) Fire lanes. All shopping centers, retail-office complexes,
and retail establishments in which the gross floor area of
