Annunziato, Planning Director RE: Comprehensive Plan Amendments - Four-Fifths Vote A short while ago, the City Commission reviewed a proposed ordinance which, if approved by the City Commission, and if approved by referendum, would require that amendments to the Comprehensive Plan be approved by a four-fifths vote majority of the Commission. Under discussion, it was determined that this proposed ordinance might not accomplish what the Commission desired, in that the proposed ordinance related to all elements of the required Comprehensive Plan, and it did not exempt requests related to annexation, where the use of land has been previously determined, or requests which implement previous Commission policy. To that end, I offer for your consideration, the attached proposal, as it appeared to me that the Commission was most interested in requiring an extroadinary majority vote of approval where a proposal to change the use of land to a commercial category is involved. For impervious areas exceeding twenty-five thousand (25,000) square feet, the design of the parking lot and facilities shall be done by an engineer registered in the State of Florida, and the plans submitted shall be sealed. Maximum storage capa- city of soil shall be considered at the rate of one inch of water for each six (6) inches of soil above the water table. Drainage calculations are required in all instances. The hydraulic conduc- tivity of soil shall be determined with tests made at the site using test procedures recom- mended by the South Florida Water Management District or other procedures which have been approved by the City Engineer. (h) Driveway (2) Each parking lot driveway shall be constructed with a radius at the intersection of the vehicular traffic lane of twenty-five (25) feet or as otherwise approved by the City Engineer. (3) No parking lot driveway may be constructed closer than thirty (30) feet from the intersec- tion of the right-of-way lines along local streets and one hundred eight (180) feet along streets of a higher classification as shown on the City or County Thoroughfare plans. (4) There shall be provided a safe and unobstructed distance of eighteen (l8) feet in length between the side of a parking stall and each of the follow~ng: a. A public or private right-of-way; b. An access aisle; and c. An interior driveway. This requirement does not apply in the instances that follow: a. At the egress end of an access aisle; b. At a driveway where ninety-degree parking is provided; c. At an access aisle where ninety- degree. parking is provided; or, d. At a right-of-way where ninety-degree parking is provided. (i) Parking Lot Layout (2) Each parking lot or parking stall shall have sufficient access from a street, alley, or other public or private way. Maneuvering and access areas shall be of sufficient size to permit vehicles to enter and exit the parking lot and parking stalls in a safe and efficient manner. In no instance shall parking lots be designed to allow vehicles to back out into any public alley or road rights-of-way, or segments of private streets which function as local or collector streets. - All interested parties are notifed to appear at said hearing in person or by attorney and be heard. ANNUNZIATO, PLANNING DIRECTOR RE: DR. LOVE MEDICAL OFFICE BUILDING PARKING LOT VARIANCES Section 5-144(c)(4) of the Code of Ordinances requires that when a variance to section 5, Article X, Parking Lots is requested, the Technical Review Board must forward to the Planning and Zoning Board a recommendation, and that the recommendation forwarded is to be made part of the public hearing proceedings. To that end, this memo is forwarded consistent with 5-144(c)(4). Luther L. Eubanks, agent for Dr. Douglas J. Love, has requested variances to the following sections of the recently amended Parking Lot Regulations: 1) Section 5-142(f) "Drainage" 2) section 5-142(h)(2) "Driveway Radius" 3) Section 5-142(h)(3) "Driveways" 4) Section 5-142(h)(4) "Back-up Space" 5) Section 5-142(i)(2) "Manouv..:ring" Section 5-142(f) "Drainage," among other things, requires that sto~ water be retained on-site at a capacity of not less than 2.5 inches of rainfall in one hour. with respect to this requirement, the applicant is requesting that the existing sto~ water flow onto adjacent rights-of-way be allowed to continue. Section 5-142(h)(2) "Driveway Radius" requires that each parking lot diiveway shall be constructed with a radius at the intersection of the vehicular traffic lane of (25) feet or as otherwise approved by the City Enqineer. With respect to this requirement, a determination was made by the Technical Review Board that a variance to this ~ection of the Parking Lot . Regulations ~s not necessary, as the new Parking Lot Ordinance allows the city Engineer ,to apprOVe alternatives to the 25 foot radius requirement, and in this instance, he is recommending an alternative, as outlined in the attached memorandum. Section 5-142(h)(3) "Driveways," cunong other things, requires that no parkinq'lot driveway may be constructed closer than thirty (30) feet from the intersection of the right-of-way lines along local streets. With respect to this requirement, the applicant is requesting permissioh to construct a 12 foot wide ingress driveway within 21.5 feel of the intersecting right-of-way lines. ' section S-142(h)(4) "Back-up Space" requires, among other things, that there shall be a safe and unobstructed distance of eighteen (18) feet in length between the side of an angled parking stall and a public right-of-way~ In this instance, the applicant is requesting to be permitted to provide a lesser distance of 12.5 feet betWeen the first angled parking stall in the north row and the right-of-way for N.E. 1st Street. .... ~ -- - r-- -. -:------ --~ ---~__r_ -2- section 5-142(i)(2) "Maneuvering" requires, among other things, that maneuvering and access areas shall be of sufficient size to permit vehicles to enter and exit the parking lot and parking stalls in a safe and efficient manner. In no instance shall parking lots be designed to allow vehicles to back out into any public alley or road rights-of-way, or segments of private streets, which function as local or collector streets. with respect to this requirement, the applicant is requesting to be permitted to allow for a continuation of the existing situation, whereby vehicles are permitted to back into the right-of-way for N.E. 1st Street. For an explanation of the Code requirement, the nature of the variances requested and the variance justification, please refer to the attached Notice of Public Hearing and Application. The above variances are being requested in connection with the renovation and related site improvements to the former Ridgeway plumbing Building, located at the southeast corner of East Boynton Beach Boulevard and N.E. 1st street. Accompanying these- requests are related requests for site plan approval' and a variance to the building moratorium on Boynton Beach Boulevard. On Tuesday, october 22, 1987, the Technical Review Board (TRB) met to review the plans and documents submitted, and to formulate . a recommendation with regard to the variances requested. After review and discussion, the TRB recommended that all four variance requests be denied. With respect to the recommendation for denial of the variance to Section 5-142(f) "Drainage," ,the TRB recommended denial of this request, as the applicant failed to submit documentation demonstrating the quantity of storm water runoff that could be contai~ed on-site in proposed landscaped areas of the parking lot. with respect to the recommendation for denial of the variances to Sections 5-142(h)(3) "Driveways," 5-142(h)(4) "Back-Up -Space," and 5-142(i)(2) "Maneuvering," the TRB recommended denial of these requests for the following reasons: 1. N~E. 1st Street, which is classified as a local street on the city Thoroughfare Plan, has an existing high rate of traffic flow for a street.Qf this classification, and it is anticipated that this volume will increase in the future, owing to the expansion of the municipal complex,', inclUding the construction of. the parking-garage with access onto N. E'. 1st" Street, and the future abandonment of N.E. 1st Avenue. 2. Proposed access to the site, including the location of the ingress/egress driveways and the parking spaces which back ,into NrE. 1st street, exacerbates the existing hazardous traffic conditions and turning movements, including those which result from the close proximity of the fire station across the street, and the police department across N.E. 1st Street to the south. - '.( ~ -~-::....;,- -~ -~ -3- 3. The 12~' of back-up to the edge of paving plus half of the approximately 19' of street pavement provides 22' of back-up space without interfering with South bound traffic on N. E. 1st .Street (most of the traffic using the spaces in question would be North bound on N. E. 1st Street). The spaces have been shifted West to provide an average 6~' wide landscape strip adjacent to the building where none exists now.
