RE:
Please be advised the Community Redevelopment Advisory Board
(CRAB) met on November 18, 1991 and took the following action:
1. Recommended approval of the site plan request for Seamist
Centre and Marina to raze the Seamist Marina dive shop and
construct a 25,668 square foot marina project to include a
mixed use building of 13 residential units and 12,144 square
feet of office/retail and 11 boat slips on .8 acres. The
motion was made by Mr. Powell and seconded by Mr. Weigle,
subject to staff comments with the exception of the comment
regarding building, window and door color. The Board
recommended the color scheme depicted on the colored
elevations submitted be approved. The vote was 3-1 with Mr.
Scheiner dissenting. (PM91-301)

SITE PLAN
Robert Fetrow, agent for Rose and Albert Love, property owners,
is requesting site plan approval to construct a parking lot and
landscape improvements to serve an existing 1,923 square foot
building located on 508 East Boynton Beach Boulevard. The
property is zoned CBD and marks the west entrance from Boynton
Beach Boulevard to the CBD. Currently no paved parking lot
exists. The Technical Review Board recommends approval of this
request subject to the attached staff comments.

SITE PLAN - DR. LOVE OFFICE BUILDING (PARKING LOT)

Upon review of the above mentioned project, the following list of
comments must be addressed in order to conform with Boynton Beach
City Codes:
1. Provide a copy of the Unity of Title combining all lots into
one site.
2. The total lot area does not meet the minimum requirement
that would allow expansion of the building. Therefore, a
request for a variance to the Zoning Code must be approved
prior to the expansion of the building.
3. I recommend showing the proposed building and site
signage at this time. All signage must comply with the
Central Business District (CBD) Guidelines.
4. Correct the conflict between the location of the site
lighting pole and the required tree landscaping shown on the
plans.
5. State on the plans that the landscape material will be
irrigated with an automatic water supply system. Specify the
water supply source.
6. Specify the type and delineate the location of mulch
material to be used and it's thickness when laid. (Minimum
two [2] inches thick)
7. Delineate the location and boundary of the sod for the
entire site.
8. Delineate the location and specify the type of specie, size,
spacing and total number of each specie for the landscape
material that is required to cover seventy (70) percent of
the required landscape area. The landscape material shall
include trees, shrubs and ground cover, but not lawn grass.
9. Specify on the landscape plan the spread of the proposed
trees and shrubs (Minimum spread seven [7] feet for trees
and eighteen [18] inch spread for shrubs). show on the plan
tree species consistent with the tree species identified
within the Community Design Plan, Chapter 7.5 Article V for
the architectural theme of Coastal Village.

10. To complete the perimeter strip landscaping that is required

In accordance with the City of Boynton Beach, Florida Code of Ordinances,
specifically Chapter 19, Section 19-17, "Plan Required" and Chapter 5, Article X,
"Boynton Beach Parking Lot Regulations", Section 5-142 inclusive, "Required
Parking Lot Improvements", the applicant for the above referenced project shall
submit the following technical data, plan revisions and information:
1. In accordance with Section 5-l42(a) , "Required Lighting", including Section
5-l42(g), "Lighting Standards", the applicant shall submit a photometric
plan depicting levels of illumination which comply with minimum City Standards.
2. Place a note on the plan which indicates that all site lighting shall be
photo-cell activated in accordance with Section 5-l42(g) , "Lighting Standards".
3. The public rights-of-way of NE 4th Street shall be swaled and fully sodded.
The grassed swale shall be fully irrigated and maintained in accordance with
applicable Landscape Codes. Reference Engineering Department Standards for
grassed swales within the public rights-of-way.
4. Provide standard stall striping detail which complies with the requirements
set forth in Section 5-142(1), "Parking Lot Striping", including Section 5-l42(g),
"Striping Standards".
5. Construct concrete pedestrian sidewalks within the rights-of-way of NE 4th St.
Chapter 22, "Required Sidewalks".
6. Confirm sidewalk requirements.
7. Error in water quality calculations (% impervious was 44.9%, should be 67.4%).
Revise trench design accordingly.
8. Need 3 yr. - 24 hr. calculations to verify minimum parking lot grades.
9. Address possible ponding at entrance off of 4th Street.
10. Dead end trench not acceptable.

Site Plan - parking lot
Please be advised of the following Planning Department and
Community Improvement Department comments with respect to the
above-referenced request for site plan approval:
1. Site plan approval will be required, prior to applying for a
building permit, for the future commercial building that is
delineated on the site plan. Part III, Chapter 4, Section
2.1. 2.
2. Complete the land use category on page 3, item 1 of the site
plan application submitted, as Mixed Use.
3. Revise site plan data table and site plan application, page
4, item 10, to reflect required parking for existing
building only. Parking will be evaluated for the proposed
building at the time of the future site plan approval.
4. Revise the title blocks on sheet 1 of 3 and sheet 2 of 3 as
the site plan/drainage plan and the landscape plan,
respectively.
5. Revise the landscaped area calculations on the landscape
plan to reflect 120 square feet of interior green area
required (6 parking spaces are interior) and the interior
trees required calculation as one tree for each 100 square
feet of required interior landscaped area. Chapter 7.5,
Section 7.5-57(1)b.1 and 2.
6. Identify on the plans the existing land use/zoning to the
north, south and west as C.B.D. Site plan application, page
5, item 3.
7. Indicate the distance of any existing driveways to the south
and to the west that are within 100 feet of the site. Site
plan application, page 5, item 4.
8. Dimension the existing front setback from the building to
Boynton Beach Boulevard. Site plan application, page 5,
item 5.
9. The Central Business District (C.B.D.) Desiqn Guidelines,
page 17, item 7 recommends the use of curbing over
wheelstops. If wheelstops are used, the pavement edge can
stop at the back of the wheelstop allowing an additional 1.5
feet of landscaped area per parking space. Since the
applicant is proposing wheelstops, it is recommended that
the parking space design incorporate the additional
landscaped area.
10. Consistent with the C.B.D. Design Guidelines, page 22, item
1 and 2, the existing sidewalk to be replaced and repaired
in the northeast corner of the site should be constructed of
keystone finish concrete, laid out on a 4 foot square grid.

11. The light fixture style and height proposed does not comply
with the C.B.D. Design Guidelines (page 21, item 2). A
round pole light, not to exceed 16 feet in height, made of
bronze anondized aluminum or steel,~ith a round housing
supported over a clear lens, shall be used.
12. Indicate on the plans what type of planters are existing on
the north side of the building (raised or flush with the
sidewalk and material type). C.B.D. Design Guidelines, page
19, item 3.
13. Consistent with Chapter 7.5, Section 7.5-57(1)j of the Code
of Ordinances and the C.B.D. Design Guidelines, page 12,
item 2, page 13 and page 19, item 1 and 3 which anticipates
exterior furnishings and site amenities on all redevelopment
projects, it is recommended that a bench be provided, if one
does not already exist, under the covered walk along the
north side of the building.
14. Consistent with page 17, item 5, page 22 and page 23 of the
C.B.D. Design Guidelines, it is recommended that the two
trees proposed at the parking area entrance and the two
trees on both sides of the private sidewalk at the northeast
corner of the site that are within the designated pedestrian
system, be changed to palms (such as cabbage palms) or small
flowering trees and that ground cover, rather than grass, be
used for underp~anting in these areas. Species shall be
selected from the community design plan landscape standards-
Chapter 7.5, Article V, Appendix III - Coastal Village.

Owners Failure to Complete Parking Facility Construction
Utilization of Parking Facilities which do not Comply with
Minimum City Codes
Please be advised that the parking facilities for the above
referenced projects, relative to the construction of required
improvements pursuant to Section 5-142 inclusive, remain incomplete
to date.
In both these instances, the owners have paved a shellrock area and
have opened these parking facilities to the general public without
benefit of completing the remainder of the required improvements,
such as required lighting, required landscaping, required handicap
facilities, etc.
It is my understanding that Building Department permits remain
effective for a period of at least six months from date of issuance,
but it appears that the owners of these two projects are not moving
forward in a timely fashion in order to complete the subject facilities.
This information is being provided to you as an update in order that
staff may be kept abreast of the lack of progress toward the owners
complying with City Codes pursuant to the site plan approval process
and associated City Commission approvals.

RE: SIDEWALK VARIANCE
Robert Fetrow, P.E., of Gator Engineering Services has submitted
a request for a sidewalk variance. Please schedule this request
on the next available Technical Review Committee agenda.
The requested variance is for a sidewalk along the east side of
N.E. 4th Street, adjacent to Dr. Love's Orthopedics Parking Lot
Addition at 508 E. Boynton Beach Boulevard. This request does
not meet the conditions for variance contained within Section
22-25 (b) of the Boynton Beach Code of Ordinances.
I have discussed the matter with Richard Staudinger, City
Engineer, and he has advised me that alternatives are available
to address rain water retention while providing the required
sidewalk.
It is my recommendation that the Technical Review Committee deny
the request for this sidewalk variance.

Dear Mr. Jaeger:
Per the requirements of the City of Boynton Beach's
Ordinances, Chapter 22, Section 25, it is stated that a 4'
wide sidewalk shall be provided along all secondary roads
within the public right-of-way. Due to a conflict of
planning and engineering design requirements, it is being
requested that a variance be granted to the owners for the
proposed project 'Dr. Love's Orthopedics Parking Lot
Addition' at 508 E. Boynton Beach Blvd. in Boynton Beach,
FL, for the following reasons:
Due to limited available space between the existing road
surface and the existing property line, the sidewalk
installation would not allow proper drainage of the N.E. 4th
st. road surface. In order to provide adequate rainwater
runoff retainage, a swale is required to be installed on the
east side of the N.E. 4th st. right-of-way. By installing the
swale, the sidewalk is unable to be constructed within the
public right-of-way.
This situation has been discussed with both Richard
Staudinger of the Engineering Department and Tambri Hayden of
the Planning Department.
Attached to this letter is a sketch of the area where this
sidewalk variance is being requested and a check for $100.00
to cover the cost of this variance request.

runoff retainage, a swale is required to be installed on the
east side of the N.E. 4th st. right-of-way. By installing the
swale, the sidewalk is unable to be constructed within the
public right-of-way.'
This situation has been discussed with both Richard
staudinger of the Engineering Department and Tambri Hayden of
the Planning Department.
Attached to this letter is a sketch of the area where this
sidewalk variance is being requested and a check for $100.00
to cover the cost of this variance request.
