Dear Mro Ciklin: I am responding to your letter of February 8, 1983, and your comments concerning recent attempts to resolve development problems for the Melear tract. As I understand your letter, the current major concern with which you are now faced has to do with a "Neighborhood Commercial Pod" within the P.U.D. and you indicate that you have been in- formed that any commercial within the P.U.D. is not acceptable and will be opposed. I believe that you may have misunderstood comments that have been made concerning your commercial podo The City's Code concerning P.U.D. provides that a maximum of five to ten percent of the total land of the P.U.D. can be considered for commercial activities and, therefore, commercial activities are accepted in the City's P.U.D. 1 I. I believe the issues surrounding the proposed commercial activity in the Melear P.U.D. may have more to do with location and access than with whether or not the use is permitted. The City code indicates that commercial uses should serve the needs of the P.U.D. and not the general needs of the surrounding area, that the commercially located land should not generally front on the perimeter streets and that. preferrably, the commercial should be centrally located in the P.U.D. This is similar to the County regulations which require that "access to commercial facilities - Mr. Alan Ciklin Re: Melear P.U.D. February 28. 1983 - ,. -, :tf -2- shall be from an arterial or collector which is part of the interior circulation system within the planned unit development. No commercial facility shall maintain frontage or direct physical access on any arterial or collector bordering or traversing the planned Unit Development tract." I do not understand the basis for the Melear family's "collective decision" that they can no longer afford to continue to give and expend funds without some sort of reasonable positive assurance from the City that the project can move ahead as planned since I believe there has been an indication of a resolution of the den- sity questions and this letter confirms that commercial develop- ment is indeed a permitted part of the P.U.D. However, I respect the Melear's decision to hold in abeyance further discussions on this P.U.D. for a period of time that satisfies their needs. Even though the Melear family has decided that they do not cur- rently have a need for water and sewer connections to the Boynton Beach utility system, it is obvious that these connections will be needed at some time in the future for the eventual development of this tract. I believe it is proper that the utility connection agreement remain in effect as a part of the public records of the City of Boynton Beach. Obviously. the Melear family should make its own decisions con- cerning the proper time to proceed with the development of their land and the City respects their decision process. I hope this responds to your letter and will provide a correct understanding of the factors surrounding development of this tract in Boynton Beach i.e., density levels, commercial activity and utility service. please let me know if I can be of further assistance in this matter. Dear Mr. Annunziato: This is to confirm our meeting of August 30 with yourself and the developer of Melear, P.D.D., in which the developer agreed to certain conditions which would allow his project to meet the requirements of the traffic performance standard. The proposed development is a category A project, i.e., one having a significant impact on a road or roads which are already operating at or above level of service D. As this is the case, the project must limit it's traffic to less than a significant impact on two category A road links, those being Lantana Road and Hypoluxo Road between Congress Avenue and 1-95. Our calculations indicate that project development should be limited to 50% of the residential units, with the balance of the residential units and all of the commercial not being allowed to develop until Lantana Road and Hypoluxo Road are constructed as four lane facilities. Additionally, this project should be required to: 1) Dedicate 108 feet of right of way for and construct Miner Road across the project's north property frontage. 2)a) Reimburse the County for the cost of constructing left turn lanes at the project's entrance on Congress Avenue and at Miner Road. These turn lanes will be included in the Congress Avenue four laning project currently under contract. The County will bill the developer for this work based on unit prices at the time of Congress Avenue construction. b) Construct right turn lanes on Congress Avenue at the project's entrance and at Miner Road. These turn lanes should be constructed at the time the project's entrance road and Miner Road are built. 3) Pay the cost of signalization at the following intersections, when war- ranted, as determined by the County Engineer: a) Congress Avenue and Miner Road. b) Entrance Road and Miner Road. c) Entrance Road and Congress Avenue. 4) Pay "Fair Share Impact Fee" upon issuance of building permits. Congress Avenue corridor will have significant impact upon park and recreation services and facilities. The annexation of this property will strengthen this impact, as 1,005 additional units will translate into over 2,000 people. While this development and others already approved for development do include some private recreation facilities, they generally do not include facilities such as lighted athletic fields, auditoriums, public beaches, boat ramps, major recreation centers, or programs such as youth and adult athletic leagues, day camps, playgrounds, and a multitude of other instructional and social programs offered by this department. The development of Motorola and the Boynton Mall will create a family- oriented population increase which will place greater demands on the above mentioned facilities. We have met, rethought and revised our site plan and development several times based on the input of staff and the City Planning Board. In fact, based on their input and our desire to cooperate, we reduced the density on the subject location from a County recommended 8 to 12 units per acre to 6.5 units per acre. Despite our efforts to cooperate and reach an accord with the City, it appears to the Melear family that each time we ~ive, something else is then required. Each of the site plans that have been submitted to the City reflected a neighborhood commercial pod within the P.U.D. We are now informed that any commercial within the P.U.D. is not acceptable and will be opposed. We now believe that despite our efforts to compromise and cooperate, each time we do so something more is requested. The Melear family has made the collective decision that they can no longer afford to continue to give and expend funds without some sort of reasonable, positive assurance from the City that the project can move ahead as planned. Therefore, based on these factors, the Melear family has decided not to proceed with annexation of the property into Boynton Beach, nor for the use of the water and sewer connections set forth in the Annexation Agreement. Ciklin letter of February 8, 1983/Melear Property consistent with your request, I have reviewed Alan Ciklin's letter of February 8, 1983 regarding the Melear family property . which is located on the west side of Congress Avenue between L.W.D.D. Canals #20 and 21. As noted in Mr. Ciklin's letter, Mr. Melear appeared before the Planning and Zoning Board to discuss the issues related to gross and net density. Following the presentation of plan materials and graphics, it was generally agreed upon that an appropriate gross density for the Melear property would be approximately six units per acre. In response to the Planning and Zoning Board comments, M~. Melear revised his concept plan to reflect density in the gross and _ net which were consistent with the issues raised at the Planning and Zoning Board. The gross density reflected on the revised plan was 6.5 dwelling units per acre. We are ready to appear before the ~lanning and Zoning Board for an informal discussion of the appropriate development of densities for the subject parcel of property. At your earliest convenience, please schedule me for such an appearance so that we make make a presentation to them in an informal setting and to discuss the relative merits of the the Melear proposal and densities. Regarding the other issues as you see them, I offer the following comments: 1. My client has entered into a voluntary agreement to annex the property into the City of Boynton and is ready, willing and able to comply with the terms of that agreement. We certainly agree that the City of Boynton Beach is the appropriate means of supply as it relates to utilities. The only question that continues to arise, is that there is nothing included in the agreement that requires the Melears to proceed through governmental approvals in the City. However, we may not have a problem with proceeding in the City for governmental approval once we have a feel for what the Planning and Zoning Board determines to be an appropriate density for the site. 2. This can certainly be discussed in detail before the Planning and Zoning Board. 3. I do not necessarily agree that the appropriate density for the the Melear P.U.D. is entirely dictated by the utilities the City is willing to provide. If the City lacks sufficient capacity to serve the Melear P.U.D. at the density recommended by the County's Comprehensive Plan (8 to 12 units per acre) then one of the alternatives my clients would have, would be to wait until further capacity is available. Additionally, when we requested service to the City, we indicated at that time that the density allocated to the property was 8 to 12 units per acre and there was no attempt to suggest anything but that density to the City. Based on that representation, the City approved the Agreement for Water and Sewer Service. Additionally, the Congress Lakes P.U.D. approved at 11.20 units per acre is recommended on the previous County Comprehensive Plan at the same density as the Melear P.U.D., i.e., 3 to 5 units per acre. It appears, therefore, that the City did not base its density for the Congress Lakes P.U.D. merely on the availability of utilities or the willingness of the City to grant utilities, but also other factors as well as such as surrounding land use and intensity. Again, thank you for your continued cooperation in this matter. I am still optimistic that once we are to meet with the Planning and &oning Board for an informal discussion, we will be able to come to a meeting of the minds and then proceed to annex the property and obtain our governmental approvals in the City of Boynton Beach. The parties present at the October 27th meeting were Mr.Ciklin, Mr. Hoggard of Gee and Jensen, Mr. Melear, Mr. Morley of the County Planning Office, Mr. Lunney, the County Zoning Director, Perry Cessna and me. The discussions held at the meeting centered on Mr. Ciklin's inability to secure a letter confirming the avail- ability of utilities from the City. The reasons put forth in this regard were Boynton Beach's immediate desire to process the development applications and an unwillingness to enter into a development approval process without a prior understand- ing of an acceptable level of density. Mr. Ciklin reduced the scope of discussion to two principle concerns, one being attempting to secure the utility letter without the benefit of immediate annexation and the other being an attempt to secure from the City an understanding of what level of density the City would offer in return for annexation. With respect to the former, Mr. Ciklin was advised that he could always request the City Council to authorize a utility letter if the administrative staff was unwilling to do so and, with respect to the latter, Mr. Ciklin was advised to send a letter to the City Manager requesting an answer concerning dens,i ty. Beyond this, nothing else was decided; however, the County advised Mr. Ciklin that they would only certify for public hearing purposes, the density which the City would be willing to serve utility wise. Dear Peter: On Wednesday, October 27, 1982, Carmen Annunziato and the County Planning & Zoning representatives met with Larry Melear, Ron Hoggard of Gee & Jensen and myself to discuss a method of resolving the apparent log-jam with the Melear P.U.D. The problem, from our standpoint, arises due to the fact that Palm Beach County has a Comprehensive Plan designation for this property in the 8 to 12 unit per acre category with up to 16 units per acre with a transfer of development rights. The City does not have a Comprehensive Plan recommendation for the site and apparently is using the County's previous Comprehensive Plan designation of 3 to 5 units per acre. We have, of course, agreed to annex into Boynton Beach in exchange for water and sewer service and continue to stand by that commitment. However, the City desires us to go through all governmental approvals in Boynton Beach rather than proceed through governmental approvals in Palm Beach County and then annex. The comprehensive planning progress, as we see it, provides guidelines to City and County Commissions for future development as well as providing property oWners a guideline as to what they can expect to be approved for their property. In the case of the Melear P.U.D., we have that guideline in the unincorporated area, but do not have such a guideline in the incorporated area of Boynton Beach. . Based on the foregoing quandary, Carmen suggested that I request to have the Melear P.U.D. brought before either the Boynton Planning Commission and/or Boynton City Commission to discuss, probably in a workshop session, what they envision to be a reasonable density for the Melear P.U.D. Annunziato City Planner 5UIIIJI!CT Development/Melear Tract On Tuesday, September 28, 1982, I met with Tim Lunny, Zoning Director and Richard Morley, Principal Planner for Palm Beach county concerning the Melear tract. Specifically, we discussed the po- tential for development of this tract and the associated density. The Melear tract is designated Medium-Medium High in the Palm Beach County Comprehensive Plan which correlates with a base density of 8 units per acre. Up to 4 units per acre density bonus may be awarded for developing a Planned Unit Development and an additional 4 units per acre may be transferred to this property from reserved property. This, of course, provides for a range of densities of from 8 to 16 units per acre which may be awarded subject to compliance with the Comprehensive Plan performance standards. Based on these preliminary discussions with the County staff, it is apparent that the owners of the Melear tract would likely receive approval from the Board of County Commissioners for a Planned Unit Development with a density of 9 1 ~its per acre if they can meet the performance standards. Owing to the fact that Congress Avenue is to be reconstructed northward from NW 22nd Avenue to Hypoluxo Road, the critical factor for density becomes availability of sewers and water facilities. Sewer and water facilities may, in fact become the only limiting factor as the County staff would like- ly certify an application for rezoning in the unincorporated county at whatever density the City is willing to serve within the limits of the Comprehensive Plan Land Use Classification.
