In further response to your letter of November 2, 1982 relative
to Melear P.U.D., it appears to me that the issues currently
before your client and the City are as follows:
1. Your client has entered into a voluntary agreement
to annex this property into the City of Boynton
Beach as soon as it is feasible. This Agreement
was made in connection with a desire to receive
water services from the City of Boynton Beach for
the purpose of developing this property and was
made in recognition of the fact that the subject
property is within the City of Boynton Beach
Utility Service Area.
2. Because your client's property is within the City's
Utility Service Area, it is appropriate that
utilities be provided by the city of Boynton Beach
and it is further appropriate that the utilities
be provided in accordance with reasonable conditions
established by the city of Boynton Beach.

3. It is recognized that it is appropriate for
your client's property to become a part of
the City of Boynton Beach in order to provide
a reasonable basis for the provision of public
services to your client's property.
4. In a schematic map form, you have provided a
schedule entitled. "Melear P.U.D. Adjacent
Density Comparison", which shows some density
comparisons related to the Melear property.
Carmen Annunziato, city Planner, has prepared
a similar map entitled, "Comparison of Gross
Densities, Melear properties", which shows
further identification of densities in the
area of the Melear property. Your analysis
of densities is presented in the first paragraph
of page two of your letter. Carmen Annunziato's
analysis of densities show that the accumulative
average of gross densities for the projects shown
on his map is 5.62 units per acre.
5. It appears that the County Administrator's Staff
will certify an appropriate density that is con-
sistent with the City's willingness to provide
utilities.
6. I believe it is appropriate to interpret the City's
position on this matter as one that relates to the
provision of utilities to a reasonable and support-
able density pattern.
7. I believe it would be current City policy to
indicate to the county that a letter confirming
the availability of utilities from the City for
this particular piece of land would be supplied
only in connection with the completion of the
terms of the Agreement that was signed on August
18, 1982 which indicates that your client agreed
to voluntarily annex to the City of Boynton Beach
as soon as annexation is possible.

Dear Peter:
Thank you for your letter of November 17,1982. We
are ready to appear before the Planning and Zoning Board
for an informal discussion of the appropriate development
of densities for the subject parcel of property. At your
earliest convenience, please schedule me for such an appearance
so that we make make a presentation to them in an informal
setting and to discuss the relative merits of the the Melear
proposal and densities.
Regarding the other issues as you see them, I offer
the following comments:
1. My client has entered into a voluntary agreement
to annex the property into the City of Boynton and is ready,
willing and able to comply with the terms of that agreement.
We certainly agree that the City of Boynton Beach is the
appropriate means of supply as it relates to utilities.
The only question that continues to arise, is that there
is nothing included in the agreement that requires the
Melears to proceed through governmental approvals in the
City. However, we may not have a problem with proceeding
in the City for governmental approval once we have a feel
for what the Planning and Zoning Board determines to be
an appropriate density for the site.
2. I have reviewed Carmen Annunziato's comparison
of gross density and have no argument with it but for the
caveat that the densities reflect over-all project densities
and not necessarily effective densities immediately adjacent

Dear Carmen:
As you requested, I have reviewed the proposed annexation called
Melear Planned Unit Development.
The Planning Division's analysis indicates the subject property
(154.6 acres) is presentl y zoned AR (Agr icul tural Res idential)
allowing for one unit per five acres. The County's Comprehensive
Plan designates the area as Medium to Medium High having a
potential density range of eight units per acre in a standard
subdivision and twelve units per acre in a Planned Unit
Development. However, the allowable density is determined by the
project's ability to meet the following five mandatory
performance standards: Water Services, Sewer Services, Major
Thoroughfares, Environmental Impacts, and Market Analysis.
It is assumed that water and sewer services will be provided by
the City of Boynton Beach. There appears to be no environmental
impact from the proposed project and according to County
Standards, a market analysis is not required for a commercial
area within a PUD as long as there is no direct access off
Congress Avenue.
The Traffic Performance Standard appears to be the major problem
area of the proposed annexation.
The Traffic Impact Analysis identified over 10,000 trips per day
generated from 1,005 units, causing major roadway links to be
impacted within a five mile radius of the project.
It is my understanding Charles Walker, Director of the Traffic
Division, has been requested to review and comment on the
potential impact of the subject development on County roadway
systems and consistency with adopted Comprehensive Plan policies
and objectives. His comments along with the Planning Division
review will ultimately determine Plan consistency with regard to
the Traffic Performance Standard.

The last piece of land to be reviewed for development on the
west side of Congress Avenue, north of Old Boynton Road, is
the Melear Tract. As you know, the owner of this tract executed
an agreement for water service outside the City Limits (see
attached). with this agreement, they agreed ..."in consideration
of the privilege of receiving water service from said CITY, that the
execution of this Agreement is considered a voluntary Petition for
annexation."
For your information, I have attached correspondence and memorandum
relative to the Melear P.U.D. approval process, which I am forward-
ing to you. I don't feel that the matter should be coming before
the city Council for consideration until after it has been reviewed
by the Planning & Zoning Board and appropriate Staff and Planning &
Zoning Board recommendations have been prepared for City Council
consideration.
You can see from the attached correspondence and a memo to Carmen
Annunziato that it is being suggested that this matter be placed
on the next Planning & Zoning Board Agenda for consideration by
that Body, if the Chairman of the planning & Zoning Board agrees
to including it on the Agenda.

In summary, the proposed overall gross density of 6.5 units per
acre in the Melear PUD is substantially below the density range
of 8 to 12 (PUD) units per acre in the County's Medium to Medium
High Land Use Designation of the Comprehensive Plan for the
subject site. However, the actual allowable density of the
project will be predicated upon the project's ability to satisfy
the County's Traffic Performance Standard as defined by Ordinance
81-6. Depending upon the results of the County Traffic
Engineers' Analysis and the Planning Division's determination,
the density could conceivably be much less than what the County
Comprehensive Plan designates for the area unless major road
improvement are made to offset road impacts.

AMENDMENT AND REZONING/ALAN CIKLIN, ESQUIRE FOR
CARILLA, LARRY AND MICHAEL MELEAR
INTRODUCTION
Alan Ciklin is proposing to annex into Boynton Beach a 154.56 acre
tract of land located on North Congress Avenue, west side, between
Lake Worth Drainage District Canals No. 20 and 21 (See Exhibit 'A')
This property is currently zoned AG (Agriculture) and is undeveloped.
Also, accompanying this request is a legal description prepared by
the City Staff which provides for the annexation of Old Boynton Road
east of Knuth Road.
In connection with this request for annexation, the applicant is pro-
posing that the land be zoned Planned Unit Development with a Land
Use Intensity = 4.00 (PUD w/LUI = 4). This PUD provides for the
construction of 1005 units of which 83 are proposed to be single
family detached with the remaining 922 units to be quadraplexes (289),
townhouses (331), and condominiums (302). The gross density proposed
is 6.5 units per acre. Also proposed within the PUD is a 3.1 acre
commercial tract. Additional major uses of land are 7.6 acres for
Miner Road, 5.8 acres for the interior collector road, 15.1 acres for
lakes and 4.1 acres for buffers.
Procedure
These applications for annexation, amendment to the future land use
element of the Comprehensive Plan and rezoning are being processed
consistent with state statutes, and Boynton Beach Codes, ordinances
and resolutions as follows:
1. F.S. 163.3161: Local Government Comprehensive
Planning Act;
2. F.S. 166.041: Procedures for Adoption of
Ordinances and Resolutions;
3. F.S. 171.011: Municipal Annexation and Contraction
Act;
4. Boynton Beach Code of Ordinances, Appendix A,
Section 3A5(e): Boundary and Zoning;
5. Boynton Beach Ordinance #79-24:
6. Boynton Beach Resolution #76-X:
Procedures for Annexation.
These procedures have been tabulated for informational purposes and
for ease of processing as noted in the attached annexation timetable
(See Exhibit 'B'). Paraphrasing the timetable, these requests re-
quire review by the City Department Heads, newspaper advertisements,
public hearings with the Planning and Zoning Board and the City
Council and Council adoption of ordinances to annex, amend the future
land use element and rezone. Also included is a consistency review
by the Board of County Commissioners. These procedures take approxi-
mately three months to complete.
Current Land Use and Zoning
The property which is the subject of this annexation is currently
undeveloped and it is zoned AG (Agriculture) in Palm Beach County.
The land use and zoning of the surrounding land varies and is presented
for your information in the table which follows:

FUTURE LAND USE AND ZONING
Congress Avenue has and will continue to be an area of intensive
development in the Boynton Beach area. The reasons for this are
many and include the availability of sewer and water utilities,
increases in roadway capacity, the existence of large tracts of land
suitable for planned development and the growth-pole nature of the
Boynton Beach Mall and the Motorola paging products division plant,
characteristically, the intensity of development on Congress Avenue
peaks between Boynton Beach Boulevard and N. 22nd Avenue and then
declines both northward and southward with Hunter's Run Golf and
Racquet Club and the Meadows 300 and Boynton Lakes PUD's forming
low-density anchors south and north respectively.
The Melear tract lies to the north of this intensive concentration
of land uses and forms the bridge between a high density residential
PUD to the south and low density PUD's to the north and northeast;
therefore, the proposed Moderate Density residential land use category
is appropriate for this location. A Planned Unit Development with a
Land Use Intensity of 4.0 is consistent with the proposed Moderate
Density land use category and with the Palm Beach County Comprehensive
Plan future land use category, subject to meeting the performance
criteria for developments of this type.
Concerning the tract of land proposed for commercial uses, the number
of acres proposed is appropriate for a development of this size, how-
ever, the location proposed appears to violate the letter and intent
of the PUD zoning regulations. There are three qualifications sug-
gested in the Comprehensive Standards section of the PUD regulations
as follows:
1. the land proposed for commercial use should serve the needs
of the PUD, and not the general needs of the surrounding
area;
2. the commercial tract shall be located so as to not front
on a perimeter street, and,
3. the commercial tract shall be preferably centrally located
within the project (See Exhibit C attached) .
The location proposed for commercial uses is on the south side of the
entrance road at Congress Avenue, directly across from the Dos Lagos
development. This location is in apparent conflict with the three
qualifying statements listed above. This inconsistency is substantiated
by the traffic impact analysis which demonstrates that 75% of the
3000 anticipated trips per day are generated from outside of the
proposed PUD.

Comprehensive Plan policies
There are three policies in the Comprehensive Plan which address
annexations as follows:
1. "Annex only property which is reasonably contiguous
to present municipal boundaries;"
2. "Annex property only after the preparation of a study
evaluating the fiscal benefits of annexation versus
the cost of providing service;"
3. "Annex only properties which are of sufficient size to
provide efficient service and on which urban development
is anticipated."
In order to determine the consistency of the Ciklin annexation re-
quest with the Comprehensive Plan policies, each of the three policies
will be addressed individually.
POlicy 1 - "Annex only property which is reasonably contiguous to
present municipal boundaries."
The Melear property is contiguous with the present corporate
limits along its entire eastern boundary (approximately 2571 feet).
In addition, contiguity exists for 2774 feet on the north and 1301
feet on the south. In total, the Melear tract is contiguous with
existing corporate limits for approximately 60% of its entire boundary.
Policy 2 - "Annex property only after the preparation of a study evalu-
ating the fiscal benefits of annexation versus the cost of
providing services."
In response to Policy 2, you will find accompanying this
memorandum, Exhibit 'D' which compares projected ad valorem taxes
with required expenditures.
POlicy 3 - "Annex only properties which are of sufficient size to
provide efficient service and on which urban development
is anticipated."
As previously stated, the Melear tract is approximately
155 acres in size, and because of the availability of public utilities
and existing and proposed roadway improvements, will soon experience
urban development.
Based on the findings of fact noted in the discussion of the
Policies as applied to this annexation, it is apparent that the
Ciklin request is consistent with the Boynton Beach Comprehensive Plan
policies concerning annexation.

Recommendation
The Planning Department recommends that the applications submitted
by Alan Ciklin for the Melear family for annexation and future land
use amendment be approved as requested and that the rezonings re-
quested be approved subject to the staff comments which accompany
this memorandum as Exhibit 'E'. These recommendations are based
on the following:
1. the parcel is contiguous to the corporate limits;
2. the parcel is in the path of urban development;
3. the request is consistent with the Comprehensive Plan
policies for annexation;
4. the land use and zoning categories requested are both
consistent with the land use plans and policies of Palm
Beach County and Boynton Beach;
5. the requested annexation and zoning will not impair
the surrounding properties in a manner that will inhibit
future development; and,
6. the cost/benefit analysis of this request indicates that
the impact of this proposal on municipal staff and programs
will be substantial but that the taxes realized will off-set
the projected municipal expenses.

Civic Dedication - Melear
Please be advised that the latest offer received from Alan Ciklin,
attorney for the Melears, with regard to the civic dedication, is
as follows:
1. The applicant will agree to dedicate a three-acre
site with the following conditions:
a. that any building constructed be limited to
no more than two stories in height,
b. that when the property is developed, a forty-foot
buffer be provided adjacent to the land,
c. that if the City ever desires to divest itself
of this property, the property would revert to
the dedicator, and
d. no open storage is to be permitted on site.
2. That the City continue to make progress toward adopting
a civic dedication ordinance and that this ordinance
adoption procedure be completed within six months.
3. That the City will grant the applicant credits for
two acres of land where the water re-pump facility
is, in connection with his dedicating same.
4. That the applicant be permitted to pay capital facilities
fees by plat, as opposed to up front, for the use of the
master facilities installed by previous developers.

Re: Melear PUD
Dear Carmen:
I've discussed the results of our on-going conversation with
Larry Melear, representing the Melear family, and he has agreed
to the following:
1) The Melear family will dedicate three (3) acres to
the City for governmental services at the corner of
Miner Road and Congress Avenue. The dedication is
subject to the following: a) a 2-story height limitation
on any building; b) a 40-foot landscaped buffer between
the 3-acre site, and the abutting residential properties;
c) no open storage; d) if the property ceases being
used for governmental purposes, it will revert to the
Melear family; e) the Melears will be able to continue
to use the 3-acre site until the City notifies them
in writing that construction will commence within sixty
(60) days.
2) The Melear family will dedicate between 1.3 - 1.5-acres
to the City for a water repump site to be located at
the N. W. corner of the property. The Melears will
receive a credit against the City's required payment
of capital facilities fees. The amount of the credit
will be determined by the current fair market value
of the property, which will be agreed upon by the
parties, or if the parties fail to agree, by an appraiser
to be chosen by them. Upon dedication of the water
repump site, the City will, within six (6) months,
agree to fence the property and buffer along the property
lines with trees, that when full grown will provide a
visual buffer from the repump facility. In the event
the City is able to locate an alternate site on adjacent
property (i.e. Knollwood) suitable for the repump

facility, then, in that event, the repump site will
revert to the Me1ears; they will pay the City any credits
previuos1y taken, and will reimburse the City for fencing
and landscaping.
3) Water and sewer charges which are required to be paid
by developers within the City will be paid on a plat
by plat, or phase by phase basis. The Me1ears will
not be penalized for this payment arrangement unless
amounts due have not been paid for a specific plat.
4) The City will agree to adopt an ordinance requiring
land dedications for public purposes or cash in lieu
thereof, within six (6) months from the date of approval
of the Melear PUD.
You have indicated that this matter will be scheduled for the
November 1, 1983 meeting of the City Council, whereupon it will
be removed from the table, discussed, and voted upon. I will
assume that the matters set forth herein are acceptable to you,
Mr. Cheney, and Mr. Cessna, unless I hear to the contrary.
I appreciate your cooperation in this matter, and I believe
that through the on-going discussions between the City's Staff
and the Melear family, both parties will be proud of the end
result.

Accompanying this memo you will find a copy of a proposed
agreement with the Melear family which will allow the Melears
to annex and meet the requirements imposed by the City. This
agreement is substantially consistent with the discussions
carried on over the last month. There is, however, an
additional stipulation listed as Ie), although this does not
appear to be a significant problem.
At this point, I recommend that we proceed with the annexation
and zoning of the Melear property based on the enclosed agree-
ment and other staff comments.

POLICE DEPARTMENT: This annexation, along with all other construction
planned in the northwest area of the City will
impact upon manpower needs in the future. The
future needs have not as yet been determined.
ENGINEERING DEPT.: Administration for construction of new subdivisions
increases the work load, but the direct impact of
this annexation alone is not significant as far as
the Engineering Department work load goes.
ENERGY DEPARTMENT: Developed public rights-of-way will presumably
mean additional street lighting requirements at
approximately $72 per year, per light, operation
and maintenance only.
BUILDING DEPT.: All annexations effect our department in the future
pertaining to personnel, overall cost, etc. as the
land is developed.
UTILITIES DEPT.: Developer will be required to furnish capital costs
for utilities. One developer will not increase
manpower except meter reading, ultimately requiring
added men.
FIRE DEPARTMENT: See attached study.
RECREATION & PARKS: See attached study.
PLANNING DEPARTMENT: Billboards are to be removed within sixty (60) days
of annexation.

I approved the concept of the master plan subject to their
providing an appropriate sized piece of land in the northwest
corner of the property.
This land will be approximately 250' x 300' in diameter.
This is to accommodate a 2 million gallon ground storage
re-pump station which will be approximately 25' high with
a building to house the necessary pumps, controls and would
be quite similar in'design, except for diameter, to the one
on Woolbright Rd. and congress Avenue.

COMMERCIAL STANDARDS. Commercial uses lo-
cated in a PUD are intended to serve the needs of the
PUD and not the general needs of a surrounding area.
The maximum area within a PUD which may be
devoted to neighborhood commercial uses, including
required off-street parking requirements, is governed
by Table I, section 4 and section 9C. Areas designated
for commercial activities shall not generally front on
exterior or perimeter streets, and shall be preferably
centrally located within the project.
