Florida City Request for Real Property Owner to Construct Hiner Road or Provide Funding Dear Mr. Bisesi: Pursuant to discussions held in my office on May 15, 1991 with Mr. Andy Hertel, P.E. of Palm Beach County Traffic Engineering Division, Mr. Enrico Rossi, P.E. of Rossi - Malavasi Engineers, Inc., and yourself, wherein we discussed your firms obligation to construct Miner Road, as depicted within Master Plan documents for the above referenced property; please consider this letter a formal request for Gene B. Glick Company, Inc. to immediately commence construction of the subject roadway. Coordination of the construction for Miner Road shall be performed in conjunction with Mr. Charles Walker, Jr., P.E. Director of Traffic Engineering for Palm Beach County, as plans currently in his custody will require nominal modifi- ' cations in order to comply with County Standards. Should your firm desire to have Plam Beach County coordinate and execute all phases of construction, submit to my office a cashiers check in the amount of one hundred and thirty five thousand dollars ($135,000.00 US) which constitutes an opinion of cost for said construction as determined by Palm Beach County Roadway Production Division. Glick Company, Inc. shall provide an easement agreement for a temporary stormwater detention area of sufficient size to facilitate the storage and pretreat- ment of stormwater discharges, as determined by Mr. Walker's office. May 11, 1987 Mr. Carmen Annunziato Planning Director City of Boynton Beach 120 N.E. 2nd Avenue Boynton Beach, FL 33435 Re: Melear, PUD Phasing Requirements Dear Mr. Annuniziato, Pursuant to your advice this morning, I am enclosing twenty (20) copies of a new Traffic Distribution Study prepared by K.S. Rogers, Consulting Engineer, Inc., for the Melear PUD. As we discussed, the actual development of the Congress corridor over the past few years has provided much more accurate and detailed information in assessing traffic generation and distribution. The enclosed report provides for a detailed analysis of the traffic existing and proposed to be generated by the Melear project and its effects on the arterial roads in the area. Based upon the conclusions of this report, I am requesting an amendment to the "Agreement between City of Boynton Beach and the Melear family for Construction of Roadway Improvements." Specifically, I am requesting that Paragraph #6 be modified to allow for the issuance of building permits for the final fifty percent (50%) of the residential units and all of the commercial property at such time that Palm Beach County lets the contract for construction of Hypoluxo Road as a four- laned section from Congress Avenue to I-95. This amendment allows for two things. First, this change eliminates the need to wait on the four-laning of Lantana Road which the new report demonstrates is not significantly effected by this traffic. Secondly, the change allows for issuance of building permits at the same time that Hypoluxo Road is under construction with the assumption that the road and the units would be completed simultaneously. Therefore, the new traffic would not impact Hypoluxo Road until it is completed. Annunziato Melear PUD May 11, 1987 Page 2 The requested amendment is more or less technical in nature. There will be no change to the Planned Unit Development Masterplan. Only the timing of the project will be adjusted with the ultimate buildout and impact being the same as initially anticipated when the project was approved. The proposed changes merely reflect the intent of the original approval with better traffic data being available today. I will await you advice on this matter. Annunziato, Planning Director RE: Miner Road PlansjWantman Letter of March 5, 1987 with respect to Mr. Wantman's letter of March 5th, I offer for your consideration, comments as follows: 1. I do not know who filed with the City, the bond for the western half of Miner Road through the Melear PUD, however, it was filed at the same time as the first plat for the Chalet development. In any case, the 21 months was from the date of the approval of the first final plat. 2. Street lights are required on all public rights-of-way constructed in Boynton Beach, consistent with our subdivision regulations. It does not matter that Miner Road is a County arterial. 3. The language cited in item number 6 of Mr. Wantman's letter is correct, however, two issues remain. One, the right-turn lane is necessary regardless of who pays for it, and two, the Miner Road plans require the reduction in the northbound left-turn lane on Congress, with the developer reducing capacity without compensation. According to the agreement Detween the City of Boynton Beach and tne Melear family, it ex'plicitly states under paragraph 3 of construction of road improvements "the owners shall construct right turn lanes ON Congress Avenue at the projects entrance and at I~inor Road. Sald turn lanes are to be constructed at the time the projects entrance road and '.linor Road are built". This clearly states tnat the right turn lanes are required ON Congress AvenUE.
